A Sacramento TV station is reporting that Sen. Roy Ashburn, R-Bakersfield, was arrested for drunk driving early Wednesday after leaving a gay nightclub.

Ashburn, a father of four, has apologized for the DUI, but has not commented on the nightclub allegation.

The California Highway Patrol pulled over Ashburn's Chevy Tahoe at about 2 a.m. Wednesday. The CHP stated that there was a male passenger in the state-owned vehicle, who was not identified.

CBS-13 notes that Ashburn has opposed every gay rights measure to come before the Senate over the last eight years.

He is termed out this year.
