Earl Ellis Green, Man Accused Of Killing Riverside Officer, Could Have Been Kept Behind Bars Until 2012

Earl Ellis Green could have been behind bars. Instead he was allegedly shooting a cop.
Updated after the jump with a response to Green's arrest from the Los Angeles police union. First posted at 3:09 p.m.

The man suspected of killing a Riverside police officer with his own gun was considered a "low level" non-violent parolee who received the state's minimum level of parole-officer supervision, records obtained by the Weekly show. He could have been behind bars until 2012 but was let out early following a spousal-abuse conviction.

Earl Ellis Green was arrested outside a Riverside Target store Tuesday night after Sunday night's shooting death of Officer Ryan Bonaminio.

Records show he was released from prison in February, 2009 following a conviction on corporal spousal injury. He was not part of the state's controversial early-release program known as non-revocable parole.

In fact he seemed to get relatively easy treatment because the state considers spousal-battery convicts low-level offenders.

His conviction would have allowed him to stay behind bars until February of 2012, according to state records.

According to the Riverside Press-Enterprise:

Riverside County court records reveal that a man with Earl Green's name and date of birth has a record of at least 13 cases stretching back to at least October 1990, when he pleaded guilty to two felonies: receiving stolen property and battery on a police officer and was sentenced to one year and four months.

On May 19, 2007, a Riverside County sheriff's deputy responding to a report of a domestic disturbance on Arvonna Drive in Moreno Valley encountered a disheveled and bloodied Green and two cars that had been vandalized, according to a court transcript.

Green's hands were bloody, he told Deputy Daniel Engels, because he had punched his car and that of his girlfriend, Tyronica Johnson. They were having troubles and he was upset, Green told the deputy.

Authorities allege Green was behind the wheel of a stolen big-rig tractor Sunday when Bonaminio tried to pull it over and ended up in a traffic pursuit. Green allegedly jumped out and ran, with the officer following on-foot.

The cop, authorities believe, was eventually shot with his own gun, which they say was recovered when they arrested Green.

Green was tracked down through a fingerprint on the truck, police said.

Here's a good question: Why is someone who beats up their spouse considered a low-level offender worthy of early release? That's a violent offense, after all, even if the state deems it "non violent."

Update: The union representing LAPD officers, the Los Angeles Police Protective League, posted this response to Green's arrest on its blog:

Green has a long criminal history spanning almost three decades that includes convictions for domestic violence, battery of a police officer, drug dealing and vehicle theft. In 2007, Green was found guilty of felony vandalism and sentenced to three years in state prison, but served fewer than 20 months. He was released as a low level, non-violent parolee with the next-to-lowest level of supervision. Hardly a non-violent person, even Green's own family had recently sought a restraining order against him, according to a KNX report.

These facts raise two important questions for the California Department of Corrections and Rehabilitation (CDCR) that warrant complete and honest answers.

1. Why was parolee Earl Ellis Green, who was on parole for domestic violence and who also had an extensive criminal arrest history, designated a low level, non-violent criminal and subsequently assigned to the next-to-lowest level of parole supervision?
2. Does the CDCR consider domestic violence to be a violent offense and if not, why not?

Was it protocal for an officer to chase a criminal into a dark park ? A witness states the officer shot at unarmed Earl...If someone is shooting at you and catches you, with or without a badge, what do you do ? Some say a lot of cops that have been to Iraq have a little Rambo mentality. I was a victim off a beating in LA, my granparents,parents also witnessed this. Remember Rodney King ? Black folks will never see cops the way white folks do. They are feared by minorities. Earl was screwed up and should have done his time epecially for hitting a women. But look at all the facts before judging.

As for anyone who kills an offer of the law protecting the sheep from the wolves, lethal injection, as prescribed by law, will fix this problem for good.

This guy fixed my car. He fixed my friends cars. He helped me move from one house to another and sat at the dinner table for a meal with my family. I had no clue of his background. He was very respectfull at all times and was always willing to lend a helping hand. I am not ccondoning his actions against the officer nor all of the violent acts he committed over the years but how many times does an individual have to get in trouble before he either gets help or gets the key thrown away ? I personally have turned away hudreds of people for jobs because of background checks. Lock them up then turn them loose with no hope. Criminals are gonna eat one way or another. Spen the money on rehab not war !!!

With so many laws on the books and so many behaviors criminalized, the vast majority of people get to commit certain crimes. To say that most people should be put down is pretty stupid. Stupid people are far more dangerous than most hardened criminals.

I agree with you tere80, the state should severely punish these multiple offenders. I don't know if I would say through torture, but definitely bring back the firing squad. I also believe the execution should be nationally televised as a warning to current and potential felons.

December 1990: Battery on a Banning police officer for breaking an officer�s nose in a scuffle, and receiving stolen property. Sentenced to one year and four months in prison, served 10 months. A charge of vehicle theft was dismissed.

November 1993: Transportation, sale or distribution of a controlled substance for possessing five bags of rock cocaine in Riverside. Sentenced to three years in prison, served two years and two months. Charges of sale of cocaine base, vehicle theft, unsafely fleeing a police officer while driving, receiving stolen property and resisting arrest were dismissed.

May 1997: Vehicle theft for stealing a 1990 Toyota Corolla. Sentenced to three years in prison, served two years and eight months. Charges of being a repeat car thief, receiving stolen property and resisting arrest were dismissed. Enhancements of committing a felony within five years of a previous felony conviction were stricken.

November 1999: Inflicting corporal injury on a spouse or cohabitant for cutting the face of girlfriend Wanda Blackburn. Sentenced to three years in prison, served one year and fourth months. A charge of damaging a telephone line was dismissed. Enhancements of committing a felony within five years of a previous felony conviction were stricken.

October 2003: Inflicting corporal injury on a spouse or cohabitant. Sentenced to five years in prison, served two years and seven months. A charge of dissuading a witness or victim from calling police was dismissed. Three enhancements of committing a felony within five years of a previous felony conviction were found to be true.

July 2007: Vandalism of more than $400 for punching windows out of girlfriend Tyronica Johnson�s car in Moreno Valley. Sentenced to three years in prison, served one year and seven months. Enhancements of committing a felony within five years of a previous felony conviction were stricken.

And people complain about the cost of keeping people in prison. They can rarely be rehabilitated and it isn't worth the risk. This would be an exact case proving my point. And people arrested for non violent crimes don't just do non violent crimes. It just so happens that they were caught doing something less aggregious than a violent crime when they are arrested. On many other days most of them were out there doing the hustle screwing over honest people and caring only about themselves. I'll pay more taxes if I know it goes to keep felons in prison for their entire sentences and makes it easier for them to return when they mess up. Because, they will mess up. It is only a matter of time. We need better funded police and parole agents. It only takes once when your family member is a victim for you to realize this. I hope you never suffer as most victims of violence do.

The thief stole the truck and he was running from the law. Don't you get it? That is what is wrong with society. I can amagin that the parents of the youn man killed in oakland by a policeman who didn't alledgely know the difference between his service revolver & a stun gun and yet, I have yet to hear the officer being called scum of the earth as they are with Green. Until we address the situation from all sides fairly, then we will continue having these sensless crimes!

Oh please!!!! It was not his intention to commit murder on a police officer!? Well, that just makes it all better doesn�t it!? It wasn't his intention to steal the truck either I suppose! Oh, and maybe it wasn�t his intention to hit someone with the stolen truck, and run! Was it his intention to keep going when he saw the flashing light behind him? Someone else must have been in the stolen truck with him, holding on to the wheel, and pressing the gas pedal. Did the other person in the stolen truck shove him out of the stolen truck and make him run?? Just keep on making excuses for these harden criminals!! Oh the poor thing has a disease of drug addiction, or maybe it is the disease of alcoholism, or maybe it�s because his mommy didn�t breast feed him when he was an infant� BULL!! He made the choice to murder Officer Ryan, a man who daily put his life on the line even for the low lives who make a career out criminal activity; a man who made choices to say no to the drugs, and say no to the temptation of wrong choices that face all of us every day. Stop making excuses for these criminals, whether they are your family or not. He wouldn�t have had to worry about going back to jail if he had never been there in the first place, and he hadn�t stolen a truck!! The moment he acted on his choice to still the truck and ran, the murder of Officer Ryan became intentional!!! Stealing is against the law and wrong! Hit and run is against the law and wrong! And Verbally threatened my life' Saying " I Don't care if i go back to Prison. If i followed through, W. persueing legal action. against Greens Garage & Informing' Code enforcement' that he was living inn a trailer behind the Hm. of Moses Green. Shop Owner. Greens Garage had file a illegal Lien-Sale against my Limo Bus , which i had taken to them for installing a motor. he was a long time neighbor' and never, gave me receipts... Cash Only transactions. Earl green also Came to my Hm. Banging' on my front door' at 11pm inn a threatening Manner.. I called the Police. Filed a Report' they did NOTHING ! I asked them to atleast confront him... That isn't why. God, why must people be so darn ignorant to wave the race card every time. The law considers domestic violence to be centered on the specific victim. If your anger isn't being projected to others outside your significant other, they assume that the person is the trigger and that most people won't be harmed by the offender.

I don't agree with this at all, but have been told this by family law lawyers and domestic violence advocates alike. The fact of the matter is, had they locked this guy up (any race) and threw away the key a long time ago, our close friend, Ryan would not have been murdered by this piece of trash.

He's not worth the death penalty. He should do the state a favor and take himself off the docket.
