Honda Civic Owners, Better Check Your Brakes; Class-Action Lawsuit Claims it Could Save Your Life

A little more than two years ago, Rivella Dunner of Los Angeles bought a new 2009 Honda Civic at a dealership in Woodland Hills. She, like most Civic owners, was psyched that the car was both affordable and supposedly reliable.

Thirteen months and 10,433 miles later, however, Dunner was shocked when she took her car back to the dealership and was told she needed new brakes.

What's more, Dunner says, she was informed that the new car's three-year, 36,000 mile warranty would not cover the cost of the repair because Honda took the position that nothing was wrong with the braking system.

Pissed off at Honda, Dunner has now filed a class-action lawsuit in federal court against the Torrance-based auto giant, claiming the 2008, 2009 and 2010 Civic's brakes wear down prematurely, causing safety risks, and that the American Honda Motor Co. will not fix the problems and refuses to tell purchasers about the vehicle defect.

According to the lawsuit, first reported by Courthouse News Service, Dunner did initially pay to repair the brakes, as suggested by her mechanic, but 11 months and roughly 10,000 miles later, she brought her car in for service again and was told the same thing: she needed to replace the brakes once more.

On behalf of "hundreds of thousands" of Civic owners, Dunner claims that the front brakes, which should last at least 30,000 miles, wear out after 10,000 to 15,000 miles, thus requiring far more frequent replacement than the norm.

She claims this not only costs Civic owners lots of money in unanticipated repair costs, but also endangers Civic drivers' lives.

"The braking system defect causes the pads to wear at such an accelerated rate," according to the lawsuit, "that the vehicles' on-board computer system does not warn drivers that the brake pads require inspection or are suffering from dangerous levels of brake pad wear."

This is certainly not the first class-action lawsuit Honda has had to fend off with regard to brake issues.

Last spring, the company agreed to settle a lawsuit with customers who claimed the rear brakes in 2008-2009 Accords and 20009 Acura TSXs wore down too quickly and that the auto manufacturer refused to fix the brakes under the new-car warranty.

Dunner is suing the American Honda Motor Co. for unfair business practices and breach of a written warranty. She is seeking restitution and an order from the court prohibiting the car company from continuing to engage in the alleged unlawful activities.

Thank god my friend showed me this article - now I KNOW I am not alone!

I purchased a 2008 Honda Civic LX April 2008 in Tysons Corner, VA.

Brake replacement #1: April 2009, at 17,838 miles (I did a lot of driving back and forth from VA to Pittsburgh, PA).  I didn't go to a Honda dealer, but to Sears Auto Center. I moved back to Pittsburgh that month.

Brake replacement #2: May 2010 at 28,695 miles (also replaced at Sears Auto Center). Along with replacement #2, I also had to get new front rotors...at 28,695 miles....is this normal!?

Brake replacement #3: August 2011 at 44,557 miles (this time I went to my local Honda dealer). They also resurfaced my rotors.

Brake replacement #4: April 2012 at 54,034 miles (this time I also went to my local Honda dealer). They also resurfaced my rotors.

Brake replacement #5: October 2012 at 61,773 miles (this time I also went to my local Honda dealer). They also resurfaced my rotors.

The brakes from Sears lasted 1 year, the brakes from Honda, 6 months. In the past YEAR AND A HALF, I have had to get my front brakes replaced, THREE TIMES, about to be FOUR because I need new brakes, AGAIN! This time I am buying the parts myself and taking them to a friends mechanic shop. We'll see how long these ones last.

I'm really anxious as to see how this lawsuit turned out. You take your car to the Honda dealer and they say it's due to heavy driving or your braking patters....BULL CRAP. The fact that alllllllll of these people on this forum have the same problem is a little suspicious, don't you think?! It's ashame because I've never had any other problems with my Honda (knock on wood), and I love it. I just wish their Customer Service was reputable!

On Tuesday 3/12/13, I almost lost MY SON!!  Thank God , God was watching over him.  It started like an ordinary day,  my son was driving his 2011 Honda Civic LX-S with only 13,968 miles which we leased on 3/26/11.  Mind you, this vehicle was serviced at Scott Robinson Honda in torrance, 3 times, 1 for a recall item (8/09/12) and the other 2 for regular oil changes.  On august 09, 2012 the vehicle was recorded having 8467 miles on file. The service invoice stated that the vehicle's rear brakes were at 4mm and the front were at 6mm remaining. All 3 times there was no mention I needed brakes. He was traveling on the 405 freeway northbound going to CSUN.  At approximately 10 miles from school, Traffic began to slow down.  My son pressed on the brakes, which did nothing to slow the car, which was traveling at about 60-65 MPH. He then used both feet on the brake, but the vehicle continue to slide. He had so much time, that he even pulled the emergency brake as his last resort!. By the time he stopped, he had slammed into the rear of a Cadillac Escalade.   The civic practically was underneath the truck. Finally the vehicle had stopped, and the civic is now totaled.   Lucky for my son there was very light traffic that day and escaped with minor injuries. I need to get on this class action lawsuit. I have already reported it to odi.nhtsa.dot.gov/ivoq.  Any advice or suggestions?

Count me in regarding the back brakes!  My 35,000 miles, 2008  Honda Civic Coupe just had its rear brakes AND rotors replaced.  They said the front ones were fine to run for a few more miles.   This is exteremely weird because the front ones always go first, not the back ones.  There must be something wrong with the car to begin with...I recall having my oil change at the dealership in summer 2011 (too expensive, don't go to Honda too often) and them telling me my rear brake pads were starting to get low-that was probably at 15,000 miles.  Your rear brake pads should not be so low at 15,000...

Hi. I have 2012 Civic HF. Just last Friday, with plenty of space between me and car infront of me. I stepped on the brakes going maybe 15mph and they sank to the floor and I rear ended the other car. I was completely stunned, no where to go. Foot to ground on the brake. Just felt like was sliding. Omg! $7400 damage to my car. Lil paint of my car. on theirs. I have 18 k on my car and have had it since Mar 15 this year. Loyally took it in just before I was suppose to. Service guys r trying to tell me the abs was working. WTF? I don't think so. The only thing that stopped by car was the other car. No resistance in putting brake to floor. Nada zero. Just glad this wasn't on the hwy. the reason for my miles traveling from my dads in IE to LA. Also glad there wasnt a person or an animal in the road. Btw. Road wasnt wet. Nice sunny la morning. Input anyone. ? I could use it. We r looking into master cylinder failure I asked the bodyshop to chk this out too.

@adamsimonis6 Same thing just happened to my 16 year old.  2011 civic. Just started off from a red light, car in front of her stopped and she slammed right into him.  She said she hadn't even "got going" and stepped on brakes and nothing.  But it has been braking just fine ever since.  Was your braking issue a one time only thing?  Curious.

When our 2005 Civic needed replacing we looked no further than another Honda Civic (2010 model year) because we had had such great luck with our previous ones.  BIG MISTAKE!!!!!   At 40,000miles we needed our 3rd set of front brakes (at $200 a pop).  After being told repeatedly by  the dealership that the problem was our driving habits, they finally admitted  that the problem was a known design problem in the 2008 thru 2010 Civic and it was fixed in a later series.  I was told flat out by the Service Manager that Honda has no intentions of fixing or offering any compensation to owners with models with this design problem.  Does anyone wonder why Honda has lost so much market share?  Just another example of how much they care about their customers.  They are not the only game in town nor the best anymore.

I had to replace my breaks in my 2010 Honda Civic at about 18,000 miles... and now at 30,000 I am having to repce them again. I thought that Civics were reliable as well. Lesson learned.

I had to replace my 2002 Civic SI brakes at about 8k miles, and had to replace the clutch at about 30,000 miles... both of which were outrageous. I assumed that it was a "printer ink" scam, and this proves it. My replacement brakes (high-end aftermarket) cost me $50 and lasted 70k miles. My replacement clutch is still going strong now that I'm at the 110-120k mile mark (which is good, because you have to PULL THE MOTOR to replace the clutch - which means a very, very expensive service).

 

My Civic SI is going to be my last Honda.

Yep- I had to have my front brake pads replaced at 18,000 miles on my 2009 Civic. They were already showing a lot of wear ay 10,000 but thought the dealership was just trying to pull a fast one, so I waited until I heard the telltale screeching. Nice scam, Honda.

This is so true.  We have a 2011 Honda accord and at 12k miles, the brakes are grinding into the rotors.  I knew this was not right and this validates my thoughts.

Can we include the 2011 Civic as well?  I just went in for an oil change and tire rotation and was told that my front brakes need to be replaced - I have had the car for 12 months and have 18,000 miles on it.  Damn!

I bought a 2011 civic and it has 9k miles on it and took it to to the shop and was told that pads need to replace and the hand brakes needs to be adjust and I will be charge for the labor..do you have any idea what should I do?

I'm going back to the dealership this afternoon to complain about my brakes being replaced at 15,333 miles (2011 Civic, in 1st yr of lease). I'm relieved that I'm not the only one having this problem. The service manager drilled me about how I drive my car and acted like they couldn't believe what I did to my brakes! I have a clean driving record and men actually compliment my driving!! lol I always flow with traffic and rarely hit the brakes. I drive highway and city daily.

THEY DID THE SAME THING TO ME.. this is the third time i'm getting my front brakes changed and i've only had my 2011 honda civic for 18 months!

Ive had the same issue as everyone else here. The brakes wearing at 10k or so. I called them and they gave me the same crap "must be the way you drive" or "its normal." Anyway I had my dad take it in anyway and they said it needed cleaning. cleaning? wtf? anyway the issue went away...for about a week and the noise started up again. now im getting crazy noise out of it...especially when i go in reverse. Anyway for whoever wants to make a formal complaint here is the website I found to do so.

Count me in!! I am pissed at Honda! Had to replace my breaks after 1 yr 5 mo of owning a brand new car and now my main harness wiring has gone bad and Honda has quoted me 1589 to repair it, im still inder warenty too, when I could have just spliced the wires and had the problem solved for less than 100. You can not trust Honda servicing centers! Never had I had to spend this much on a car and it's the newest car I have ever owned!

I came accross this site when I took my 2011 Honda Civic in to the Honda Shop this morning because I heard a weird sound coming from the front driver side tire.  At 25k miles I had been told I have to replace my front brake pads.  This car is a lease and I don't even own it.  Out of shock and outrage I called the customer support center and complained.  They told me it was normal wear and tear and couldn't help me.........ridiculous!  $175 down the drain.

My daughters 2009 Civic is in the shop, as I  type, for front brakes. She has 17000 miles and according to the dealership pads, 1 new rotor, 1 turned rotor, lubrication costs $340. Honda will cover all but $150. Odd, huh?

I have a 2009 Civic LX.  Brakes replaced at 20,555.  Brakes replaced again at 35936.  Brakes again replaced again at 53150.  Ridiculous!  Honda refuses to acknowledge that there is a problem with the Civic brakes.  Blames the premature wear on how the car is driven.  Im 52 years old been driving for 36 years.  Never had this problem before with any other car.

I have 2010 Civic with the same brake issues.Replaced original pads at 15,900 miles and the new pads lasted only 12,500 mile. 3rd set of pads with under 30,000 miles on the car.

I am currently having my 2010 civic's brake pads replaced at 15,993 miles. Complete BS. I will never buy  another Honda again! Also, the paint started chipping after 12 months and it's my fault they tell me..

I brought my son a brand new 2009 Civic LX 2 years ago.  I have to change the front brake pads at 11,000m,i and then at 20,800 mi the dealer said I have to change the brake pads again and plus the rotors!  I'm currently negotiating with Honda American to get my payment reimbursed or I'll take them to Small Claims Court!  The brake is obviously defective.  I believe the car probably too heavy for the brake system they have in the Civic!

I have a 2011 honda civic and only 9600 miles on it and i already have to replace my front brake pads. I was also told my warranty didnt cover the brakes when i've only had the brand new car for a year which i think is a bull shit. HONDA has the worst brakes ever!!

I have a 2010 Honda Civic I had to get new front brakes at 9,000 miles!! Than again at 16,000!! The service department at Honda told me that it was my fought that I am to hard on my brakes!! They refused to listen to me!!! I called Honda headquaters to inform them of the problems I'm having with my brakes they told me if it happens again to give them a call. Now i just have to wait and see if I need new brakes in 3 months..

I recently purchased a 2012 Civic.  I discussed the brake issue on my 2009 lease vehicle with one of the sales managers.  He explained that on modesls from 2004-05 to 2011, the rotors were too small for the pads, given the increse in vehicle weight.  As such, the pads wear out prematurely.  He said there was a similar problem with the Accord.   According to Honda, the newer models have larger brakes.  I shall see.  I love the drive of the vehhicle.

I own a 2001 Honda Civic.. and Now I know what is going on...!!!!.After replaceing several pads after approx 11,000-13,000 miles and replacing the rotor and  caliper I was told it was a lubricant issue around key area of the  brake pad ....Did that and still the pads (simi-metallic) wear out prematurely. 

This will be my last Honda as even CONSUMER REPORTS has drop HONDA from there recommended list...Uff your Honda...!!!!!

Also... They did admit that they're having a problem with the back brakes,(not safety wise... so they say)  not the front. Calling will make a difference. I'm having a problem with both and I told them that.

Call Honda HQ, I did and I'm now going through the process of getting financial support for my brakes. The more who call and actually say they are having problems with their brakes the better it is for all of us. The # 1800-999-1009. We can't let them get over anymore!

 thanks! i have a 2011 bought new and not only the brake pads are going out fast but the antilock brakes kick in even at normal stops, kind of jumping. anybody have that?

2010 Civic, pads 14k miles free from dealer, now 24k 2 new front rotors free but i had to pay for the pads.  Definitely a problem.  I am moving close to work, so the car will last longer now, but at 35k miles, I am selling this car to buy another brand!

I have a 2010 LX after 11,000 miles I just replaced my front brakes and I'm now replacing my back brakes... how do I join this law suit?? because when I called the dealership and said that something was wrong, they told me to stop riding the brakes... I could not believe this employee said this to me!! I've had cars prior to this one and have never had a problem like this, can someone please tell me how to get in contact with these people involved in this law suit!!
