Barry Minkow Will Plead Guilty to Federal Charges of Insider Trading over Scam Against Lennar Corp.

Federal prosecutors have struck an agreement with Barry Minkow to plead guilty to criminal insider trading for actions that damaged the stock price of one of the nation's largest home building companies two years ago, sources familiar with the case told the Weekly.

Minkow, the supposedly reformed Los Angeles con man, intends to plead guilty, according to a statement issued by his San Diego-area church. Neither Minkow nor his attorney have returned calls the Weekly placed to them just after 6 p.m.

Update: Neither Minkow nor his attorney Alvin Entin have returned calls from the
Weekly. But Entin told Bloomberg this morning that, "Barry is looking
forward to getting this behind him and on with the rest of his life." Minkow
faces a maximum five-year sentence under the proposed deal in which he would
plead guilty to a single count, Bloomberg reported.

The one-time business whiz kid served seven years in prison after his conviction in the mid 1980s of running a Ponzi scheme that defrauded investors in his ZZZZ Best carpet cleaning company of as much as $100 million.

After his release from prison, Minkow announced that he had undergone a religious conversion. He became senior pastor of the Community Bible Church in Mira Mesa and began working as a fraud buster, aiding the FBI and other organizations.

In recent years, however, Minkow began issuing reports critical of major American companies, including Lennar Corp., the home building giant.

In most if not all cases, Minkow would take a "short' position on a company's stock before issuing his report. His reports usually sent stock prices lower, which meant Minkow profited by short selling the stock.

But Lennar proved to be a formidable adversary. After Minkow issued a report laced with unsubstantiated allegations against the company and its executives, Lennar filed libel and extortion lawsuit against Minkow in Miami. Minkow's report had sent Lennar's stock price tumbling $500 million in two days--the equivalent of 20 percent of its value.,

Lennar sought to use the lawsuit to force Minkow to verify his allegations. But Florida State Court Judge Gill Freeman threw out Minkow's defense in the case, finding that Minkow gave false testimony, withheld documents, destroyed evidence, concealed the identity of key witnesses, willfully violated court orders and tried to "cloud his misconduct."

Freeman ordered Minkow to pay sanctions, estimated to run into the millions of dollars.

Until Tuesday, however, the public knew nothing about a pending criminal case against Minkow. His church disclosed it in a letter to parishioners.

The letter, signed by church elders, said:

"Today Barry resigned as our senior pastor as he is no longer qualified to be a pastor. Pastor Barry no longer considers himself above reproach as he has agreed to plead guilty to a criminal count related to the Lennar lawsuit."

The letter asked parishioners to pray for Minkow and his wife and sons.

The federal case against Minkow stems from a report he wrote about Lennar on behalf of Nicholas Marsch III, a former business partner of Lennar's who had a falling out and was suing the company--an effort that was ultimately unsuccessful. As Marsh continued to press his litigation in late 2008, he hired Minkow to look into Lennar. Minkow responded by recommending "an all out blitzkrieg" against the company.

Minkow wrote that a cascade of bad publicity could force Lennar to settle the lawsuit brought by Marsh. Minkow issued his scathing report against Lennar in January 2009.

The letter from Minkow's church elders Tuesday made no mention of a burglary at the church earlier this year in which Minkow claimed thieves stole $50,000. The burglary remains unsolved.

The break-in is quite similar to phony burglaries Minkow has said he staged in the 1980s to collect insurance money when he was short on cash.

Robert Morze, who was a financial consultant for ZZZZ Best Carpet Cleaning (Z Best), helped perpetrate one of the most notorious business scams in recent memory. Working with 20-year-old wunderkind Barry Minkow, Morze helped turn a small carpet cleaning business into a Wall Street company valued at more than $200 million. Eventually both were sentenced to prison--Morze for five years and Minkow for 25.

Minkow's charges have also been revised- Now he's being charged with conspiracy to commit securities fraud, and Entin says that he will likely get 15 to 24 months in prison-

Now take out Antar's name and put Minkow's name in it's place. Looks like Minkow followed Antar's game plan to the tee.

Birds of a feather flock together and Minkow and Antar are 2 Ex-Con's who defrauded investors out of OVER $100,000,000.00 each.

Forgot to add that Minkow put out lies against the following Corporations AND NEVER PROVED a thing against any of them. ALL of these stocks plunged after Minkowput out his numerous lies against these companies. Again! He NEVER proved a thing against ANY of these companies.

Minkow shredded documents, planted henchmen on Yahoo finance message boards to spread lies against the above companies, lied to the judge NUMEROUS TIMES and his own attorneys, lied to his Church board, spread false information NUMEROUS times and over YEARS! His Church was also robbed and he hung out with another Ex-Con who also defrauded people. This Ex-Con Sam Antar's own wife sued him and put out a restraining order against him.

Minkow's sin lasted YEARS and during this time, he preached like a good, honest man to a deceived flock and Church board. How anyone can believe him is beyond me. All of the information above are HARD PROVEN FACTS!

I would also add, that it is one thing to observe and forgive someone for some transgressions, a little falling away, making a big mistake, yes for sure- But we have a whole different animal here (referring to the situation, not Minkow) - What we have here is persistent, continuous sin, yes, but sin that has left a trail of bodies and 50 miles of bad road in its wake- Multiple people have been hurt, from all i can tell multiple millions of dollars have been needlessly lost, and a legitimate company lost $500 million dollars in one day because of a 20% stock drop, based on absolute fabrication, and zero proof- how do I know this? Well, I am going by a judge's ruling, who found that Minkow had lied to the court; showed no respect for the court/legal system/legal process; tampered or interfered or whatever he did with key witnesses; destroyed evidence- What more do we need???!!!

BUT on top of this, when I watched Pastor French's sermon from last weekend, he quoted Minkow verbatim, with Minkow confessing to Pastor French and in turn, the entire congregation, that he had been warned over and over again that either what he was doing was wrong, he was falling away, etc. We don't know the nature of the warnings, but we'll assume it was from God/The Holy Spirit at the very least- My point here is Minkow is not innocent here, but what's really being called into question is his motivation overall- I think in the early years he got his fix by being the focus of the attention of the church, being in that leadership position, and then the money came back to haunt him again, over time, and now here he is again, likely going to prison over, money....

So in the end, we can all comfortably conclude that minkow DID execute some, at the very least, criminal behavior, will very possibly go to prison again for up to 5 years, and regardless, will likely never take on the role and responsibility of pastor again-

I and many others I know have also concluded that Minkow should have never been put in such a position of authority or leadership as quickly as he was back in the late '90s-

What I would recommend for him at this point (in addition to paying back his debt to America) is to simply and humbly just SIT IN A PEW AND LISTEN for the next 10 years-

It always amazes me how "Christians" seem to the first to criticize and condem. Pastor Barry and CBC have made a wonderful change in all areas of my life over the past 5 years as he has done to thousands of others by being positve, uplifting, and encouraging. I have always felt the Holy Spirit working in me thru Pastor Barry's sermons. He loves his church family and I believe that he is hurt deeply by the recient events. He teaches the Gospel of love and grace. I guess not all that attended heard him. Through all this we remember that GOD is in control. Let us not judge but in "prayer and petition, with thanksgiving, present your requests to GOD" I love Pastor Barry and I will continue to pray for him and his family.

Pastor Barry is an amazing teacher of Gods word but he is a man.....a man!!! NO one is perfect and we ALL are sinners saved by Gods Grace. He has done no harm to the church/CBC...the church is the people NOT the Pastor!! Duronfamily: Your loyalty toward your Pastor says a lot about your heart. To stand firm for someone you have come to trust and love is a character trait that God praises. And yes, Barry is just a man and no man is perfect, all are sinners. However, Barry has a long history of conning people. I know that's hard to believe from your prospective. He's really good at it and he has left a lot of damage in his wake. I'm not passing judgement on him, please understand, that's God's job not mine. I am, however, stating facts. The Bible teaches that you'll know a man by his fruits. The fruits of Barry's labor says a lot about HIS heart. He needs a lot of prayers (I'm just not sure he will ever truly repent - but then stranger things have happened) His family members are probably at the top of the list of people he has hurt and they need a lot of prayers.

Barry is always acting. Whenever I was a kid I went to his church and the way I could tell he was fake is I would look directly into his eyes when I talked to him. Whenever he smiles or does any attempt to convey emotion there are no feelings in his eyes. It's like looking into pools of murky darkness.

Minkow is the scumiest of all scum, he should serve out the remaining 18 years of his previous sentence in addition to the maximum 5 sentence for this for his lying, greed and deceit. Too bad his stupid "flock" couldn't see the obvious flaws in this as.holes character, he came across as an egotistical used car salesman lying out of the side of his mouth in every youtube video he appeared on. The board of his church should be sentenced, too, for allowing him to remain in his position as pastor despite obvious red flags that had been appearing for years. I went to his church fir a short time and my family was there for a long time. The whole deal seemed like a scam and a joke run by a crook. Church was another easy scam to get free money hahahaha people would hang on his every word even as he confess how he was so good at scamming people every servus. Sad people like him us church as a business and people and gullible enough to give all their money and time that they could be spending on and with their kids and wives and husbands. I always told people he was a crook but they said he has repented hahahaha yeah right.

Like Greg1s, my husband and I really, really tried going regularly and getting involved at CBC, but never connected with people and never had a peace about it. At the time, I thought it was because Barry's preaching induced a lot of feelings of guilt and condemnation, now I believe it was the Holy Spirit giving us discernment.

I do pray for Barry, for his true repentance, and I pray for all the congregants, that this wouldn't hinder their walk with the living God. Also, I pray for Barry's wife and children.

Barry was a very smart pastor but he can look shady and the elders have done poorly concerning him and concerning how they spend their money. Focus on the people, not GETTING more people. If you lose half your congregation it is because of charismatic fluff. Teach the whole Bible and all that God provides, go teach others and don't get caught up in activities or get togethers.

It is true that many were at CBC to see the Barry Show-- that happens though with any charismatic leader. I think the same can be said of our current president but I wouldn't say the current administration is cult-like. There are some wonderful ministries that have come out of CBC; purely evangelical ministries and purely social justice ministries. It's hard for me to imagine that everyone that was involved in those ministries was there for Barry. Yes, I think everyone at CBC loved Barry and always wanted to believe the best in him but I believe the majority of people attending CBC felt that God was working through Barry and at the end of the day it was God that they were and will continue to seek.

Whether CBC will survive is yet to be seen. I pray that it will but I don't know. I do know the God I serve doesn't change regardless of what church I go to.

To me, the saddest part about all of this maybe, is that I'm not even sure Barry is repentful of any of this- I believe he is sorry HE GOT CAUGHT, but to be pulling this for 2 years under the "flock's" eyes, without any abatement in his behavior, to me is reprehensible- And yes, I agree with everyone that the tone of the email, which I did receive, made it sound like the Elders were the ones who were almost repentful, that they HAD to let him go, couldn't stop him-

The chruch became, and has been for a LOOOOONG time, too dependent on Barry's quasi-celebrity status-

I couldn't have said it better myself.

My husband and I left CBC in the middle of 2008 and then felt God drawing us back there in Dec. 2010. Beginning in early Jan. 2011, Barry's attitude (a check in my spirit) and the eventual break-in made me do a lot of research on this. We laid out our findings to a few members and to some of the leadership.

I am sickened that Barry wasn't forced to resign sooner.

The Elder Board MUST be held accountable for covering the case at hand since Barry's indictment in 2009. Keeping it from members and allowing "business as usual"was a gross error. Not examining their Chief Pastor's behaviors against the criteria set forth in the Bible for Pastor's and Elders alike proved their mismanagement and in doing so may have very well disqualified themselves. Genuine believers unite!We are the remnant that can rise from the ashes!

I must say that when I received the email earlier today the inclusion of the Elder Board concerned me as did the exclusion of any pressure on Barry to leave, actually the contrary was conveyed, their letter made one think they were sad Barry chose to go.

In the few instances where I have been in where spiritual leadership deceived their flock or allowed their flock to be deceived, there needed to be a major "house cleaning" before God began working again and His blessings flowed.

Charles, I will add however that this really is more of a "devastating event" for the church, for really, this church was all about a cult of personality of you will- We would sporadically go to the church, but in all honesty, we just never had a peace about going there and committing ourselves to there- Not that we're such geniuses, far from it, but now that I see this, it makes me wonder...

Anyway, it's hard to say whether the church will continue- It seemed that everybody was there for the "Barry Minkow show" - Now he's gone and it's the.......

That "lack of peace" was the Holy Spirit speaking to you. Barry Minkow has damaged, hurt, and in some cases destroyed thousands upon thousands of lives in one way or another with his scams. People like him learn how to manipulate others into following them and believing in them. I believe it's an evil spirit that controls them. But, they need discerning people to call them out, make them accountable, AND to pray for them. If we don't take a stand as Christians we ALLOW this type of evil to DAMAGE the reputation of God in the eyes of non-believers.

Yes I agree with what you're saying Penny- To give a little more detail, I really thought for a time, really around 4-5 years ago, that we were meant to attend his church, become very involved in the church, and that I was going to have a closer relationship with him- In fact, I was working on a Christian book that dealt with the topic of money that I felt he could really relate to, and that I felt would really benefit from his endorsement, etc. This book wasn't some kind of fantasy, I am already a published author, but in any case, I was surprised that I never really was able to bring myself to get very close to him- I had met and spoke with him about spiritual issues on occasion, this was some years ago, but like I said, for some reason, at the time inexplicable to me, I just never was able to push myself to get very close to him, or even bring up the subject of the book, as if the motivation just wasn't there emotionally or spiritually, although I thought it was intellectually-

Now I know why! I thank God for protecting myself and even more importantly, my family, from this man-

Too bad the letter from CBC didn't say "the elders have removed Barry from his position because ..." rather than "Barry resigned" and "Barry no longer considers ..." It makes me wonder about the authority and competency of the leadership. I hope and pray by God's grace this is an opportunity for Christ to be the star of the pupit and the power of the Word to be what impresses, not the charisma or salesmanship of the preacher. When that's the case, the loss of a preacher is very sad but not a "devasting event" as the CBC email stated it. My prayers go out to CBC.

It's so hard not to look at a story like this and blame God for what people do but Barry is a man, not God. If history has taught us anything it's that mankind given the right circumstances is capable of really bad/dumb things. The church is right, the man and his family need prayer and Christians need to be more diligent about who they chose as their leaders. I am glad he's out of the pulpit. Now my husband and I might consider going back to CBC.
