Porn Stars Could See Mandatory STD Testing, New State Rules For Their 'Workplace'

It looks like porn stars in California will see stricter safety rules on how they do their thing on-set. Just like a construction worker has to wear a hardhat, they might have to don condoms and submit to tests.

At least according to our reading of coverage of a state workplace-safety meeting on the topic, and according to our parsing of a statement put out by the AIDS Healthcare Foundation.

Deborah Gold, seniors safety engineer for the California Division of Occupational Safety and Health (Cal/OSHA), said new amendments to state rules would be presented to an advisory meeting in downtown L.A. June 7, where you, the public, could weigh in.

While California already requires condoms in porn (but doesn't really enforce the rule), the new language would specifically address "routine and post-exposure medical services may need to be adopted to reduce these risks" of contracting non-blood-born STDs, Gold said last week, according Adult Video News.

Sounds like mandatory testing to us.

AHF thinks condoms will be more specifically addressed. State and federal rules say you shouldn't be mixing blood at work. Sounds good to us. Cal/OSHA officials say that means condoms.

But state officials "are drafting rules that are specific to the industry" for the first time, AHF spokeswoman Lori Yeghiayan tells the Weekly

"It is our hope is that the amendments will make specific reference to condoms," she says.

The porn world in L.A. already tests its performers regularly. But that hasn't stopped diseases, including an HIV-positive scandal for one gay performer last year.

The industry argues that forcing condoms on it will only push production outside the San Fernando Valley and into the "underground," where there will be no testing.

Michael Weinstein, the group's honcho, states:

As a global HIV and STD medical care provider, we've seen it as our duty to pursue action on this issue of safety in the workplace--in these instances, unprotected sex acts taking place in albeit non-traditional workplaces--the porn sets located in the San Fernando Valley and throughout California. We heartily thank Deborah Gold for her tireless work on this issue and for speaking out publicly on Cal/OSHA's behalf last week about these proposed new safety amendments.

As someone who actually attended the CalOSHA Standards Board meeting referenced in the article, Mr. Romero seems to make Deborah Gold's "draft proposal" (which isn't even completed yet) into established law—which it clearly isn't, at least not yet. Considering that requiring condoms (and dental dams and goggles and face shields) for every adult video scene would be the death knell of the adult industry in California, it's far from certain that the proposal AHF petitioned to have enacted will in fact be enacted.

Yes and no, Mr. Romero. "[R]outine and post-exposure medical services may need to be adopted to reduce these risks" does not necessarily mean condoms -- and HIV testing as a condition of employment cannot be made mandatory under California law. That is one of the reasons AHF does not lobby for testing, but instead wants condoms mandated. The other reason is this campaign of theirs represents an attempt to use adult movies as a marketing tool for the AIDS fear and hysteria from which men like Weinstein profit.

Here's an excerpt from an email that Weinstein recently sent, which was forwarded to me:

"[W]e think that the porn industry is doing a terrible disservice to society in general, and young people in particular, by saying that the only kind of sex that is hot is unsafe."

AHF's Michael Weinstein is obsessed with "the message" that non-condom movies send to the public -- in other words, his issue with it is CONTENT-BASED. He wants to alter the content, and use pornographic movies as propaganda for the condom peddlers, because in his mind that is the proper role of adult entertainment. He conveniently forgets that this archaic "educational purposes" standard has long faded into memory -- that's why we no longer see the old stag movies with men wearing long white coats asking women to undress so they can tell them all about where babies come from.

More thorough STD testing (perhaps to include herpes and HPV testing, for example) and/or more frequent STD testing would fit just as well into the category of "routine" services, and post-exposure services have nothing at all to do with condoms.
