How Not to Get Deported: A Guide for 'Illegal' College Students

The anti-deportation movement, which has been inching toward the mainstream as of late (against all Arizona odds), just made its boldest move yet:

A group of DREAM Act diehards released a manual called "Education Not Deportation: A Guide for Undocumented Youth in Removal Proceedings" this morning.

It's nothing that immigrants' rights groups haven't said before --

But it's more accessible, conversational and comprehensive. And since it's directed at undocumented youth who had no choice but to grow up without papers -- who came to America "at an age when they were too young to understand the consequences of their actions" -- it's more likely to inspire sympathy in the hostile reader.

Prerna Lal, the DREAM Act posterchild from San Francisco who's currently in the middle of her own deportation proceedings, is vetting the guide all over her blog and Twitter today. Here, some of its more basic pointers:

After being served with the Notice to Appear, you will be scheduled for a court date. ... If you miss your hearing, the immigration judge may order you deported in your absence. So, it is critical that you keep your address up to date with the court.
You should most definitely have an attorney to represent you in Court. [And if you can't find one by your first court date:] You should not answer any questions, particularly questions about your foreign birth or how you entered the United States. ... Ask the immigration judge for a continuance. To make your request stronger, you should document your efforts to obtain an attorney before the hearing. Keep track of the names and dates when you talked to attorneys.
If you are eligible to pursue [some form] of immigration relief, ie. Cancellation of removal or Motion to Suppress, you should do so with the advice of an immigration attorney. ... For example, if you believe that ICE violated your constitutional rights when they arrested you, you might want to think about a Motion to Suppress evidence of alienage.
Requesting deferred action, which can only be done once removal proceedings have been initiated, should only be a strategy of last resort for a DREAM Act student when s/he does not have any other options left... and is facing an order of removal by an Immigration Judge.

From there, authors suggest that student aliens get letters of recommendation from teachers to use in court, contact local politicians with heart-wrenching anecdotes and "go public" -- aka, talk to the media, post videos to YouTube and pass around a petition.

A couple telling excerpts:

Immigration Customs and Enforcement ("ICE") has the power to stop anyone's deportation at any moment, however they only use this 'discretion' for cases that are very compelling. Your job is to show ICE that your case is compelling and worthy of discretion, i.e. deferred action.
Search your facebook profile, old albums and find some pictures that define you. By using pictures you intend to show the public that you are just like them, or maybe get them to feel as if you are like a friend they know and how could they sit back while a friend is going through this situation? Be creative. The goal of your story and picture is to make a personal connection.

During a recent case a DREAM student focused a lot on their love for animals, as a result many stepped up to help just because they too were animal lovers.

Kind of makes the whole thing into a joke, doesn't it? The fact that college students who grew up in the U.S. should have to recite their canned sob story at all becomes a ridiculous, expensive waste of time. In other words, the manual also acts as an advertisement for the federal DREAM Act, which would grant citizenship to undocumented students who've been accepted to a U.S. university.

Maybe then we could avoid the media-circus section of this guide, admittedly making us feel like complete tools with tips like "Reporters are not your friends" and "Never go off the record."

But we gotta admit: They're kind of right.

Too bad the guide is only for those immigrants who've had the perseverance and wherewithal to climb their way into our higher-education system. In the windowless border houses of Tijuana and Mexicali, we've heard a trail of horror stories, from fathers deported for selling crafts on the subway to teens picked up while walking home from work ("suspicious behavior"), then kicked out of the country without so much as their wallet or a call to let Mom they're OK. (Well, as OK as they can be.)

As long as Secure Communities is in place, this'll continue to be the norm. But at least some options are starting to open up for the DREAMers.

MOST AMERICANS ARE IGNORANT!! Actually they too aren't fully Americans.. You are only considered American if your family or yourself are native to this land. That means that you were here before europeans immigrated, yes immigrated to this country. In my perspective so called "Americans" are afraid of the undocumented youth because we are smarter than many Americans. We know more than one language and still are able to compete against them for jobs :) well, furthermore, I believe that this country is very unconstitutional when it comes to the rights of undocummented people (by the ways we are NOT all Mexicans, nothing against them, but we come from every part of the world)

The sense of entitlement here is amazing. You call Americans ignorant and you claim illegal youth are smarter than Americans yet you want to become a citizen via amnesty. That's funny. I have an MBA and speak three languages, I'm not afraid of anything you have to offer.

The US has some of the softest immigration laws in the whole world.  Nothing unconstitutional about them at all. They are just not enforced. Illegals have plenty of rights granted to them already because so many cities and officials look the other way when it comes to enforcement and don't want to hurt the feelings of a group of people that have no business being in this country.

By the way, my third generation Mexican/American wife of almost 15 years came up with the entitlement remark.

How nice, illegals want, want, want and scream and yell at the top of thier lungs when things don't go there way. Well, boo hoo. Because of people like this, every state, city and municipality is broke, I can think of 3 good friends of mine that are out of work and would jump at the chance to earn a paycheck in the constrcuction industry. Our schools are overcrowded, hospital ER's are overcrowded, they are benefitting from food stamps, wic cards or ebt cards etc...

I have zero problem with people coming here the right way, 3 of my best friends have done it. I am tired of illegals wanting everything done for them all the while not doing one damn thing to become a legal citizen.

As a California taxpayer, who has seen the state fall headlong into bankruptcy and seen some 15 billion dollars/yearly go down the drain funding illegals and the children of illegals, I say enough is enough!  Our own native students have enough competition in trying to get into college without illegal scofflaws being treated on an equal basis.  The limbo state their parents placed them in is NOT the responsibility of the California taxpayer.

Many illegal children whose parents invaded the US have just been in the country a few years and would be covered by this DREAM.  And guess what, children suffer due to the decisions their parents make all the time, so they should hold their parents, and not the US taxpayer responsible.  Whiny freeloaders go home!

Why should we have an secure, egalitarian immigration system that welcomes people from diverse countries around the world that are genuinely poor (not just moderately wealthy corrupt dysfunctional cesspools like Mexico,) when we can get the large majority of our immigrants from a single country that can't be bothered to educate their poor beyond the fifth grade or teach them about birth control/overpopulation before pushing them across the border to suckle on the teet of the American taxpayer!

It takes real courage to do the right thing: to return to the country of birth, get into line & wait your turn to enter legally.  One would think that those illegal students who have already acquired some education would jump at the chance to help their home country, and consider it an honor to do so.

Dear Jim, I am an undocumented college student and let me tell you that I work to pay for my college tuition. I am not out partying, being a lowlife, nor am I out getting money from the government to pay for my tuition. Those are the ones that ruined this country because they get money from the government and then don't pay it back. Sad sad, but so true. We pay taxes. In fact, just in Texas alone undocumented people contributed with $18billion to the state's economy. We don't claim that back. BLACKS HAD THEIR RIGHTS GRANTED TO THEM... NOW IT'S TIME FOR OURS!!!!!!

I'm sure others have responded to your simplistic reply but I will anyway...chances are excellent these students were brought here very young when they did not have a say in whirr they would live but followed the direction of their parents. You know that. I thank God that I am not held to task for all of the choices and decisions MY parents made 15-20 years ago. The fact of the matter is, like others posters have stated, these kids have little or no connection to their countries of origins. If they fulfill the requirement of the Dream Act, as I understand them, they will be great contributors to our country's future and the only people who could or should have a problem with that are the ones who are challenged/intimidated by driven, intelligent and hard-working Competitors. Frankly, I believe iron sharpens iron and a good competition makes us all bring our A-game. What are you afraid of. These college-educated young people will RAISE our society...get on board. If OUR CHILDREN are not prepared to meet such criteria to compete, shame on them and shame on us! (this is why MY kids have taken Spanish for 5-6 years....'cuz in 10-15 years, if you're not bilingual, YOU will be cutting grass and buzzing tables.....

Most illigeals have jobs that take taxes out of their checks (usually 30%) and goes straight to the Government (city, state and federal) becuase they are here illigeally they do not can not file taxes unless they want ICE knocking on their door so by my thinking the American society mooches off the "illigeals" because I pretty sure you file your taxes and can't wait until you get your big refund in April. Oh and the comment about bussing tables I know he is probably the first to complain at McDonald's when they don't have anything good to eat on the dollar menu.
