Art Walk Accident Downtown Takes Life of 2-Month-Old Boy

An accident during downtown L.A.'s monthly Art Walk Thursday night took the life of a 2-month-old infant boy and appeared to have put his mom in a hospital, according to authorities and reports.

It happened about 9:15 p.m. at Spring and Fourth streets, police said. Reports vary about how it happened, with City News Service stating that two cars collided and one of those vehicles hit the victims and CBS2 reporting that the driver of a Cadillac lost control during a parallel parking maneuver.

The driver of the Cadillac wasn't arrested, according to CBS2.

Added: Blogdowntown reports that a parking meter hit by the Cadillac outside the El Dorado Lofts might have been what struck the mother and her child.

The site says that as many as a half dozen other people might have been injured.

The car's driver, about 22-years-old, is said to have passed initial DUI investigations and doesn't appear to have been under the influence of anything.

Update: LAPD Officer M. Lisenby of the Central Traffic Division told the Weekly late Thursday this is how police think the accident happened:

The vehicle was southbound on Spring and they were attempting to park along the curb. The driver, while trying to park, lost control, jumped the curb, hit pedestrians and in the process hit the mother and her infant in a stroller.

The driver, she said, "was not under the influence and stayed at the scene." The man was not in custody, but the "investigation is still ongoing," Lisenby said.

She said it's possible others were injured but that this aspect of the story is not clear at this point.

"There was a large gathering there for Art Walk with 100 pedestrians on the sidewalk, so it's conceivable" others were injured, she said.

The driver "first hit the meter then (the car) went onto the sidewalk," Lisenby said, but it was the car rather than the meter that hit the victims, police believe.

Update No. 2: LAPD Central Division Lt. Paul Vernon was at the scene and tweeted the driver of the Cadillac is a 22-year-old from Ladera Heights.

It apparently happened as about 35 food trucks had amassed in the area to serve Art Walk patrons.

Some Weekly commenters (below) say they witnessed the tragedy, with one saying that the baby's siblings were crying as the infant was taken away by paramedics. One said the driver was going fast; another said crowd members might have prevented him from leaving.

One commenter wonders why the street wasn't shut down with so many pedestrians around. Some have criticized the event in the past for getting too big and, possibly, unruly.

Update No. 3: Three police officials, including Central Division Lt. Vernon, Central Traffic Division Sgt. Jeffrey Siggers, and LAPD Media Relations Officer Richard French say the baby died, with Siggers saying the death came overnight. (Various outlets, including the Los Angeles Times and City News Service reported this morning that the infant was clinging to life).

"What happened it was surviving ...," says French. "Just before 2 a.m. the child did die from the injuries in the accident."

Four people, including a police officer who rushed to the scene right after the baby was hit, and the baby's 28-year-old mother, sustained minor injuries, police said.

The officer was taken on a backboard by paramedics to a hospital to get checked out, said Vernon.

Vernon said the driver was trying to parallel park nose first when the vehicle went forward, jumping the curb, hitting a parking meter, and striking the baby, its mother and a few other people.

The driver is "moving forward into the parking space, hits the gas, goes up on sidewalk hits the baby and others, and on-duty officer is running up behind, and the guy puts it in reverse and hits officer, who sustained minor scrapes," he said.

It was just an accident, Vernon said, and it doesn't appear that the driver will be cited.

Responding to criticism that perhaps too many people were crowding the street Thursday night, Vernon said he was actually watching the scene from a building as the accident happened. Though he couldn't witness the tragedy from his vantage point, he emphasized that all the victims except for the officer were on the sidewalk.

"It's not related to issues in the street as far as I could see," he said. "While it happened at Art Walk this guy was just trying to paralel park. It was just a tragic accident."

Update No. 4: The infant was identified by coroner's Assistant Chief Ed Winter as Montebello resident Marcelo Vasquez (he specifically said "one L" in Marcello, but a commenter below and the Los Angeles Times have it as "Marcello"). His age was one month, 25 days, Winter said.

An autopsy is pending.

A commenter (below) says a prayer vigil was scheduled for 8 p.m. tonight at the scene of the accident.

Update No. 5: LAPD traffic Det. Felix Padilla told the Weekly Monday that it's possible the driver could see a charge of vehicular manslaughter. That would ultimately be up to the District Attorney's office, but the D.A. could send the case to the City Attorney's office, where misdemeanor vehicular manslaughter could be considered.

Padilla confirmed that the 22-year-old had never held a California drivers license. However, that's not the core of his problem: Simply put, he allegedly made an unsafe move that ended someone's life. Thus the possibility of vehicular manslaughter, the detective says.

"He committed an violation of the vehicle code," Padilla says. "It was an unsafe start.
He was trying to park and went up on the sidewalk."

He wouldn't release the driver's name.

The LAPD will likely send its evidence to the D.A. within about two weeks, Padilla said. The driver could face one year in jail or probation -- or both -- if this ends up in court and he's successfully prosecuted.

Update No. 6: Mayor Antonio Villaraigosa told Streetsblog Los Angeles that it would be wrong to blame the success (and crowding) of Art Walk for the tragedy.

It's irresponsible to blame Art Walk for this crash, from what I understand it was a freak accident ...

What I don't understand, Romero, is why you aren't continually scrutinizing art walks and their event organizers.  Look at the facts:  1) An underage participant died. 2) There may have been drugs/alcohol involved. 3) The organizers of the event neglected to provide a safe environment (i.e., did not arrange for the overflow of several hundred people into the open streets).  To not see the parallels between this and EDC 2010--and not to similarly scrutinize art walks--reflects either ignorance or obstinance. In your case, probably both.

To remain consistent, you must now *always* report on this incident in your coverage of *any* large art event.

Good point. Don't forget to report on this whenever you're blogging about art festivals. Look into the organizers' legitimacy and find people to interview who will tell you they set things up improperly and basically asked for this to happen.

Vigil on the sidewalk???Are you kidding me???!!!What about a vigil in front of City Hall to stop the madness of Art Walk??Four years ago Art Walk was a small adult gathering put on by the various galleries in the Historic Core of Downtown.Last night it was a travesty.Anyone walking the streets last night could tell this was way out of hand and then someone died.What is wrong with this city?How can they sit back and allow this to happen?Bert Green the founder of Art Walk sold his gallery and washed his hands of this thing months ago for this very reason.The food trucks do not belong and have added to an element that has ruined the spirit of this evening.The streets are now filled with thugs - shit heads and drunken drugged out clowns.The city of LA was warned about this.The city of LA contributed to this.The city of LA is responsible for this.Art Walk should be shut down until the city of LA can figure out exactly how this happened - how they can better control the crowds and whether or not in the end anything at all is worth the price of the life that was sacrificed last night.I am embarrassed to not only say I live in this shit hole of a city but also that I am part of what is considered Downtown LA.

I can't believe some of the blame throwing here.  I was filming an art piece just about to get finished directly across the street when this accident happened and sadly I have the entire thing on tape. The driver DID try to flee as his tires screeched in reverse.  The cops grabbed him and the female passenger as his reverse lights were on.  The driver came out of the car and was only wearing socks... so I have no clue what that was all about. I do feel that if artwalk continues the streets need to be completely blocked off.  There was so much commotion just from LAPD every minute from people jay walking and running in between traffic, it's simply dangerous for motorist and pedestrians.

In CA, a witness to a crime-- "alleged" or otherwise-- has no legal duty to report it, Moral duty-- perhaps. If a tree falls in the woods and nobody is around to witness it, does it make a sound? And, by CA law, once a witness comes forward, they are protected by law from threats and coercion of any kind. Total voluntary civic duty to help and set the record straight is what this artixtic admission will amount to.

I am deeply saddened by this news, but more so that out of this comes so much blame and pointing fingers.  Let's figure out how we can prevent this as a community instead of standing on the sidelines riffing about who knows what.  My heart goes out to the 2 month old boy's family...

The crowds at Art Walk have been out of control for a long time, and a year and a half ago I warned the readers of Blogdowntown that somebody could be hurt at this exact intersection.

There has long been a need to actively disperse crowds away from the historic centers of Art Walk (5th and Main / 4th and Spring), and this is what my husband Richard Schave and I did, with input from LAPD Senior Lead Officer Joseph, when we put the Art Walk into a non-profit, before being forced out of its management in November 2009.  At that time, this direction was abandoned.

If the Art Walk were, as it was conceived as a non-profit (see Mission Statement link below), a series of curated official events spread throughout the Historic Core, the numbers of people who attend Art Walk could be safely sustained, and the sidewalk bottlenecks that are the fundamental challenge of Art Walk could be avoided.

But the commercial element at Art Walk takes advantage of these bottlenecks, setting up to sell their wares and exacerbating the dangerous situation. The Art Walk's official "lounge" and map distribution center is also steps away from where this child was fatally struck. 

For shame if this is what it takes to make the basic, intelligent crowd control changes needed to make Art Walk a safe event for the community.

Any new parents (or parents who have children) are given a class before they leave the hospital letting them know that they should NOT take the baby outside BEFORE three months.  newborns are prone to infections and cannot handle ANY kind of impact.  Why, as a mother, would you take a 2 month old NEWBORN into a crowded, alcohol filled NIGHTTIME event?  I am definitely saddened by this loss of life, but as a parent you have to take every precaution to not put your child into dangerous situations.  It is unfortunate in all areas.

I agree with you 100%.  An infant cannot make his own decision not to go to the Art Walk.  It is the parents' role to protect him from harm.  This was a preventable accident.  Auburn, you have to put blame on the parents because the Art Walk is not a place for children.

Thank you David.  I am deeply saddened by this event, incredibly upset - but sometimes people lose focus on the safety of children.  I agree with you, this was preventable in all areas. Yes, the streets should of been blocked and this newborn should of been left at home in the trusted care of someone.  Sometimes a situation doesn't have a right and wrong - sometimes it is 2 wrongs.

No, you absolutely do not need to place blame on the parents. Not unless you a gigantic douchbag that is. The baby wasn't killed by a marauding gang of drunken art patrons for fuck sake, he was killed by a car in a horrible senseless accident. It could have happened in a grocery store parking lot and some faceless idiot on the internet would find a way to blame this poor family for the misfortune of standing in the wrong place at the wrong time. The only thing these parents deserve is empathy, prayers and well wishes. But you can go on believing that you are somehow immune to horrible accidents due to your perfect parenting. I sincerely hope your arrogance is never challenged by such a tragedy.

This wasn't "wrong place, wrong time". Going to the grocery store to pick up diapers is where parents should be.  Roaming a crowded downtown at night filled with drunk people....yeah find a babysitter.  I'm not immune to accidents, but then again my parents never took me an event that included 1000 of people AND alcohol when I was 2 MONTHS OLD!

NO, this could NOT of happened to a child of any age, because any DECENT parent knows the fragility of a newborn baby is not the same as a two year old, a five year old, a ten year old - WAKE UP PEOPLE! You don't get to hit the bars with a NEWBORN.  Being struck in a grocery store picking up diapers is not the same as what happened at this event.  a NEWBORN does not get to CHOOSE which situations it is placed in, they also don't have the ability to get out of the way! if you have children - GUESS WHAT?! your life changes - IT'S NOT ABOUT YOU ANYMORE, MAKE SMART DECISIONS.

a child of any age is certainly prone to serious and even fatal injury after being struck by a MOVING CAR.

whether he was 2 months or 2 days doesn't matter.  they were on the SIDEWALK.  it's not like they were in a gang-infested area and were hit by crossfire.  the last time I checked, walking on a sidewalk was safe.

and I lost my own son at 2 months, so I know what the mother is going through.

THE STREETS SHOULD BE CLOSED! That's all there is to it, there are way too many people, the sidewalks are over crowded. cars shouldn't even be allowed around that many people. it is not even fun anymore

I've always been amazed how easy it is to get a license in the US, and how difficult it is to have it revoked.  In some countries in Europe it takes YEARS of lessons before they'll let you get behind the wheel, and even there there's all kinds of restrictions.  Stateside, we pass out licenses like candy and this is what happens.

artwalk is NOT what it used to be. i am saddened by what happened, but as a parent you need to be aware of whether you are bringing your child to an unsafe environment. while artwalk used to be a family event, it is NOT anymore. this accident could have killed anyone, an adult, a child, a dog for that matter. the point that needs to be made here is that DTLA desperately needs to figure out a way to ensure the safety of EVERYONE at artwalk. the crowds at artwalk are too big, and DTLA does little to control the madness. i live on spring street, and refuse to leave my apt on artwalk.

i have also spoken with the director of artwalk and suggested closing of (at least one lane on) spring street. no dice apparently due to some city regulations.

If you can close the 405Fwy, and Colorado Bl for the Rose Parade, you can close one lane or the whole street.  All it takes is political connection or common sense from the City leaders.

I think that the director of this artwalk needs to take action and come up with a "real plan". Maybe this project is too big for him and should be reconsidered.

I was there too. But the guy wasn't drinking or infused with drugs. But it was an accident. So yeah, i cried last night because I thought the baby was dead. But how do you think the person driving the car feels? If that baby died he wouldn't be able to live with him self. This was all just a big accident. I was around ten feet away when I saw the police come. The baby was hurried into the ambulance and I saw the father run in too. The whole thing was a mess. People everywhere were screaming. So this is why I am so grateful to have such a good family and life, because that mother or father may never be able to see there baby boy again.

I live downtown and we often take our three year old daughter out to artwalk to visit the galleries and eat at the trucks.  Maybe it's a crowded booze infused adult crowd to you Judie cuzz you're drunk, but the artwalk isn't meant to be that and we want to keep this a family event.  I live on Spring and am not interested in the inconvinience of closing down the streets so people could get drunk.  I was at the first artwalk and now that I'm a parent I plan to continue sharing this with my kid.  Judie, I think you're the fool.  the drunk fool.

First off the mother is fine and 2nd 2 cars did not collide that idiot did not know how to park thank god my sis and her family were ok unfortunately for my other sis, that idiot took my 2 month old nephews life and he should be put behind bars. I don't know what kind of a law degree you have, but I heard the guy wasn't even drunk or on anything....so that means he probably tried to back up and hit the wrong peddal. It really sucks that an innocent child was wheeled into this chaos and lost his life, but I don't see this as a criminal offense. What about a charge of child endangerment against the family? I wouldn't even walk my dog out there.

An accident is when you accidentally drop your phone. Surely we can come up with a better word than 'accident' for when someone who clearly can't handle their car makes a mistake that costs human lives.  How about 'criminal negligence'?

I, too, take my kids to ArtWalk and Food Truck events.  It's a great opportunity for them to learn.  The mom shouldn't be blamed for bringing the kids out.  And the streets probably weren't closed down because the ArtWalk didn't want to pay for it.  Blame the driver!!

I'd just like to say that you are an inconsiderate asshole for evening questioning why the child was there, its honestly none of your business. Maybe the mother couldn't get a babysitter or maybe they were trying to leave when the accident happened. But no matter the reason what matters is that an innocent life was lost and you should send the family your condolences. It was a horrible freak accident that could have happened at a park so get over yourself and be considerate of the family. Smh at douchebags these days.

My heart is breaking for this family and specially the mother. I am a mother of a 2 month old as well and was there at the artwalk with my son, but decided to leave once I saw the crowds growing and saw everyone going to the bars instead of the art shows. My heart goes out to you guys and the little angel that was struck that night and is now in a better place :.(
