Jay Cincinelli, LAPD Cop Taken Off Duty After Injury, One of Fullerton Officers in Deadly Confrontation With Kelly Thomas

One of six Fullerton cops placed on paid leave following a confrontation that left a 37-year-old homeless man dead in the street is a former LAPD officer who lost use of one eye in a 1990s shooting that put him on that department's permanent disabled list.

Those facts -- circulated by an anonymous caller to KFI AM 640's John & Ken -- were confirmed according to a Tuesday night report by Fox 11 News' Chris Blatchford.

... Jay Cicinelli. He was shot six times in an on-duty attack in South Los Angeles in 1996. The former Marine was said to have been only two weeks into his first job as a cop when that happened. The confrontation took his left eye, gave him a permanent stay-home pass, and put a disability check from the city in his mailbox.

But according to this account, then-77th Division Capt. Michael Hillmann stood by the rookie's side and, after the LAPD pushed him out, he kept him in mind.

Hillmann moved to the Orange County Sheriff's Department and Cicinelli said he believed it was the former LAPD captain's relationship with former Fullerton Chief Pat McKinley that got him back on the street, in Fullerton.

Now Cicinelli is one of the six officers taken off duty, with pay, during an investigation of the July 5 fatal beating and tasing of Kelly Thomas, who was suspected of possessing stolen goods.

Cops that night were called to the Fullerton Transportation Center, 123 S. Pomona Ave., to investigate reports of someone breaking into cars. The suspect allegedly spun away from the officers, prompting them to take action.

A witnesses on video taken from a nearby bus said Thomas, who is mentally ill, was pushed to the ground and beaten violently by the officers.

Thomas was hospitalized but was taken off life support by his family on July 10.

The FBI is investigating the incident as a possible civil rights violation.

And residents packed Fullerton City Hall Tuesday night to call for the department to release another video in its possession said to show the confrontation clearly.

One of those residents was Thomas' dad, Ron Thomas, a former Orange County Sheriff's Deputy clearly upset with his fellow lawmen.

Michael Schwartz, Cicinelli's attorney, told Fox 11 News that his client is "very well liked and thought of" and had a clean record "in the field" during his 13 years at that department.

He added:

The public never had the full picture and never takes into account what officers are experiencing at the time.

Killing is killing.  If a person chooses to uphold the law then they cannot be excused for breaking the law.  Murder in the name of I was shot before should apply to every soldier who has faced combat.  Should we let them off if they kill someone?  The system is corrupt and failing.  Gay is now ok and the system has tossed out any respect for God.  They follow the ape to appease their desire for crap on their penis and try to justify by saying we are the government.  God gets the last word.  I want to see pork butt when he stands before God.  He's going to regret all his pork butt ways.  And yes, like the others said before me.  You going to take it in the ass the way you like it. Jay Cicinelli is a good citizen that served his community and country! I pray for everyone involved. Maybe we should look at our government and the state of our country, instead of just this one man and his actions. It wasn't just him. He truly is a good person. Why are the mentally ill out on the streets? Police are not social workers...this man needed medical attention...he did not deserve to die...but nevertheless, I stand  by Cicinelli!

On Wednesday, May 18, Fullerton Police responded to a report of a fatal accident between a BNSF freight train and pedestrian, near the train station in Fullerton.

Fullerton Police Sgt. Andrew Goodrich said officers were called to the scene at shortly before 5 a.m. The pedestrian is described as a white male in his late 20s. He is believed to be a local transient. Police are not releasing his identity pending notification of the next-of-kin.

Goodrich said the freight train was east bound through the Fullerton station at about 50 mph. The pedestrian was walking on the tracks, and was struck by the train just east of the train station.

Goodrich said east- and westbound train service is continuing at this time. Orange County Coroner investigators are on-scene.

Just goes to show that they should do more back ground checks on the police. And monitor them more often in order to prevent situations such as this re-occurring.  And imprison the police who do such atrocities against civilians in my opinion. That group of "thug like police need to be taken down once and for all." With videos and witness's this is exactly what general population needs to have in order to control those paychecks and lifestyles of those who are hired to protect and serve instead of , seek and destroying mentalities. Imprison them and put them in general population and let the prison gangs take care of them.

Reading the vicious, hateful "comments" here makes me sad, to live in a violent "me first" society, where mentally ill people drift into being vulnerable to (possible) police abuse. The other day, an 18 yo "me first" kid failed to follow police orders, was tased in the chest and died of heart failure. I've had cops come to my home and threaten me as a witness against their boss. You "me first" USA USA USA types don't know what's now coming to Weimar America: ARGENTINA police. You have no idea what kind of "cops" will return from Iraq and Afghanistan.

The death of this person is horrendous and totally unexcusable. When you become a victim or someone in your family is abused, harmed or murdered by city, county or police you begin to realize how bad the problem is. The positive thing is THIS CASE is getting attention and people are taking action. Sadly many other cases have gone unprosecuted and ignored by the DA, Police, FBIand others. Had this event NOT been captured on video as so many are not, nothing would have been done and it would all have been lied about as police and courts often do. Judges who won't allow video cameras in their courts are murdering seniors, children, veterans and the disabled for cash. Estates are stripped of every penny by lawyers who bill hundreds of thousands of dollars in fake legal fees.Lee Peters is DEAD due to judge Aviva K. Bobb who was moved from family court due to the death of a child. Judges like police are moved from county to county when they are caught committing these crimes AND murder. I’ve read many of the news stories about and reactions tothe Kelly Thomas murder and think that something very disturbing is takingplace. The larger, more systemic, and disturbing issue is a lack of selfrestraint, self discipline, and possibly training of some in law enforcement.While I respect the fact that their duty is to serve and to protect, reactionsto situations by some officers often go too far and there is a mentality ofreact first and ask questions later which leads to these types of unfortunatesituations. From what I’ve read, many times fellow officers who speak out aboutmisconduct  are ridiculed or censured.This mentality marginalizes and calls into question the ability of officers  to do what they were sworn to do. My brotheris a schizophrenic and I often worry about his safety. It pains and saddens meto learn that out of six trained officers, not one stepped in to intervene in asituation that ultimately resulted in Kelly’s death. This tragic and avoidableevent does not help to affirm any trust by a public they are sworn to protect.There does not seem to be enough accountability for the actions taken by those inlaw enforcement and not enough policing of the police and unfortunately much ofthis responsibility has fallen on the public. This should also serve as acautionary warning to those in law enforcement that wherever you go andwhatever you do, we’ll be watching you.

 Actually there ARE consequences when cops wrongfully kill civialians or otherwise abuse their authority - they get a PAID stay at home vacation and when they return to work they often times sue and win to get compensated for potential overtime pay and missed promotions that they "potentially" would have earned while they were on time out. So yeah they have it tough just like everyone else who might mess up at their job.

To Blackflag (or should it read black shirt??), yes the police is there to procted the public. It's their job! However, to kill by beating to death an unarmed homeless person that had mental problems (oh, yes by the way six of them beating on one guy...how brave!!!) it is not there job and it's not what I want them to do.
