Clarification: Are You Sure I Don't Have to Pay My L.A. County Red-Light Camera Ticket?

And the saga continues into late October: "Calm Down, L.A., You Still Don't Have to Pay Your Red-Light Camera Tickets."

In the month-and-a-half since we published "L.A. City Council Says You Don't Have to Pay Your Red-Light Camera Tickets," we've received dozens of panicked emails from drivers who were caught red-handed, squeaking through an L.A. intersection.

"I wanted to confirm if in fact I am not obligated to pay this ticket," reads one such note. "Do yo know the consequences of not paying the ticket or where could I get more information about this matter?"

We've been asking ourselves, and many evasive officials, the same question for wayyy too long now. It's time to clear this thing up for good.

Sherman Ellison, a star L.A. attorney and longtime skeptic of the Superior Court's biggest moneymaker -- traffic tickets -- says that, in his exhaustive search for an answer to this question, he has deduced that:

"It won't go on your DMV record. It won't go on your credit record. But it will remain in Superior Court as an unresolved matter."

So, in choosing whether or not to pay your humongous, highly irritating $470 ticket, "it's a function of whether the person who receives a ticket is willing to walk this line that has a lack of clarity to it."

Here's what happens to your ticket, once that beady little stoplight lens does its job.

Ellison says that when a city issues the ticket, it goes straight to the L.A. County Superior Court. The court then puts it in their traffic record system. If you havent responded to the ticket by its due date, you'll receive a letter saying that within a few weeks, a $300 civil-assessment fine will be added to the existing $470. If you ignore that letter, the Superior Court tacks on the $300 and sends it to GC Services, its official collection agency. GC Services then sends you a collection letter, making super scary threats about what will happen if you don't pay your $770 bill. (Aka, garnish your wages or file a lien on your house.) Ignore that letter, and they'll send you another, filled with even scarier threats.

But from there, the Los Angeles Times reports that GC Services is instructed not to send it to the nation's three credit-reporting agencies:

Under state law, court officials have discretion over how they pursue those who do not respond to camera-generated citations. Los Angeles County Superior Court officials, as a matter of fairness, said that for the last decade they have chosen a less forceful approach partly because the person receiving the ticket may not be the person who was driving the car. ...

The court may seek payments via collection agencies, but failures to pay do not show up on personal credit reports [or DMV records], court officials said. The policy applies to tickets received throughout Los Angeles County, said Greg Blair, the court's senior administrator for traffic operations.

Neither Ellison nor the Weekly has been able to confirm this with GC Services, where reps refuse to answer the credit question. Instilling more fear is a new message on the Superior Court's website that reads: "Anyone issued a red-light citation must resolve it within the specified time limits or face certain penalties as prescribed by law."

But that's vague -- and likely only posted in last-ditch hopes that the most freaked out of the violators will fork over the court's much-needed cash, just to qualm their nerves.

In July, L.A. City Councilman Paul Koretz said of GC Services, "They'll never actually make you pay, and they won't put it on your credit.'' And to this day, L.A. City Councilman Dennis Zine sings a similar tune, adding that the tickets definitely won't show up on your DMV record.

Phew! In conclusion: You do not have to pay your red-light-camera tickets, as previously reported. The only consequence we've been able to identify, so far, is that the ticket will remain in Superior Court, in awkward limbo, for court personnel to view.

L.A. Superior Court communications director Mary Hearn tells us that once your ticket makes it to court, it is out of a city's hands. So the above advice applies to all red-light-camera tickets in Culver City, Beverly Hills, West Hollywood and the rest of L.A. County, even though their camera programs are still in place.

However: If anyone notices anything show up on their credit report, or experiences any other repercussions for not paying their ticket, please contact us. And stay strong! The Ellison-led fight for red-light-camera amnesty only has a chance if we all continue to give cameras the finger. Or the gorilla mask, as the case may be.

PERMANENT RESIDENTS, DON'T IGNORE IT!  I got a camera ticket in La Habra, barely outside of Covina, this April on my brothers car. So he ends up receiving the ticket for $495 (half a grand! a-holes!)  in his name but my photo. Me & my brother have been permanent residents for 20 years. Unfortunately I can't ignore the ticket cus that's putting him in jeopardy. Plus I read the part about the ticket remaining in court records, so that means taking a risk to be denied citizenship when finally applying in the near future. If you're a permanent legal resident & you plan to apply for citizenship, it's a no brainer, don't risk it. Pay the half grand in community service if you have to.

Is there anyone who has competly ignored the letters in riverside county? Im planning to do it as my brother did and nothing has happend to him til now. That is 2 years ago. Ill keep people updated it in my case.

I got multiple of them(red light camera tickets) within a month, cuz the camera is just a block from live - Walnut, CA.  And I just moved there!

I do rolling stops there all the time.  And when I got the flash, I couldn't tell if it was on me or not.  Then after a few times, I realized there must be something I'm doing wrong.  I noticed that the camera starts flashing as soon as I pass the first pedestrian line.  For a few times, my car got past the first pedestrian line just a few inches.  Gosh...

After my research on Google, I decided to ignore these tickets.  So far I got 3 of these tickets.  Together that's like $1500.  More may be coming...

If you are gonna ignore, it has to be total.  If you contact the court for any reason, such as to take an extension, you have acknowledged receipt of the ticket, and you will be reported to the DMV if you fail to follow thru.

@henryheigh Agreed, ignoring the red light ticket has to be from the very beginning. If you file for extension, too late, you can't ignore it anymore. Ignoring the ticket is based on the fact that there is no record that you received information about it, so once you file for an extension for example, you have officially acknowledged that you received it.

@nataliechirinos keep on ignoring it...I got a redlight ticket in Sept 2012 as well and just now getting notices from the Court (Dec 2012)...plan to ignore everything from GC collections as well. If you go thru this entire thread there are people that ignored everything for over a year now and nothing has happened...

Do you think I could call the court as a "Just curious" citizen and ask if they know? They probably wouldn't give me a answer right?

Hi, I got my red light ticket back in April in L.A. county (City of Commerce). Just a couple days ago I got a notice from collection agency to pay a fine of $780. I ignored my original fine of $480 and absolutely did nothing. Would anyone recommend me to ignore this GC notice as well? Please advise, thanks!

hi how about in Inglewood we receive this ticket last month.. do we have to pay for it?. im a tourist and driving my moms car when i ran into a red light. is there any chance that it will not be credited on my mom's record?

So what happens if you get arrested or pulled over in the future. I have bad luck with these things. Will they pull out this from superior court and destroy you with all the fines they threatened you with? I want to blow it off just got one

Well the obvious question is what happens if your pulled over or get another future ticket or arrest and the last fine is in the system will you be fucked to the full extent of the law or NOT? please help thanks for the article

-Got the violation from the Culver City PD-Was driving my dad's car-He sent a form back transferring the ticket over my name instead

In lieu of the fact that he sent in the switch-over, what should I do?

Kevin... Your dad ratted you out, similar to testifying against you of your accused crime. The paper he sent with your info, if i'm not mistaken, was an affidavits. Evidence to be added with traffic photo. Just from grammer skill from your post you seem to be intelligent. But who am i to make that assumption. My deductive reasoning says:-when you get the new "notice of violation", look @ the return address to see if it's from out of state.-Does it say "Notice of Violation". When receiving a ticket from an officer the top of the ticket says "Notice to Appear".-Read D.G.'s post two months ago.

Now use your deductive reasoning.

Hi,

Appreciate the advice.  What you mentioned above was exactly what I was afraid of :-)  

I was hoping that the whole process would simply reset all over again when my name gets added.  After looking at the tickets, I'm still somewhat hopeful that may be the case.

For what it's worth, the letter I received and the one my dad received are almost identical (except for the fact that mine has my name / address / info).  

-It is a "Notice of Violation" and the top of the ticket says "Notice to Appear" from the Culver City Police Department.  Though the "Automated Traffic Enforcement" # is different from the original one my dad received.-It is in fact from out of state - Arizona to be exact, and the "Certificate of Mailing" is signed by a gentleman of Redflex Traffic Systems (again, the signature is from a different individual than the original ticket my dad received).

All this being said, it does seem as though the initial paperwork gets handled by a 3rd party outside of the court house before it gets officially processed.  The mail-to address is:Traffic Enforcement OfficePO Box 42034Pheonix, AZ 85080

Since it's a 3rd party handling what seems to be some of the filing for the court, could the cycle have been completely reset when my dad requested the ticket be sent my way?

very strange..those people from 3 or 4 months ago that said they would ignore the ticket never respond me back when i asked for updating news..T_T.. i got the ticket 2 weeks ago and has 2 weeks left to respond it.. it said it wont be on the record, but, i am still worry because i am planning to apply for my citizen ship in 2-3 years..T_T

Got one and the wife got one at a later time. We never wentonline and never called. Just threw them away. This was in O.C. though... I was told by my brother who isa corp. atty that they have no proof of recpt of the ticket if I don't make contact. This was over 6 months ago and I even went and renewed my driver’slicense the other day without a problem. They can't prove it was recv'd at my home and since several people (kids) get the mail and are told to toss the junk mail, well... who knows what happened to it. DON'T DOANYTHING WITH IT! THROW IT OUT AND DO NOT LOOK IT UP ONLINE!

I recently received by mail a photo red light ticket from the South Gate LA county area.  I looked it up on line!  Does this mean that theynow have confirmation of me receiving the ticken and now must pay the outrages amount of $480?

Here's official confirmation - at the highest level - that people can ignore their tickets - and are doing so in large numbers. 

Assemblyman Gilbert Cedillo has launched a bill - AB 2147 - which if it passes will require LA County judges to issue bench warrants on the tickets issued by the 47 red light cameras operated by the MTA, if those tickets are ignored. 

If the potential passage of this bill worries you, contact your assemblymember and your state senator, and ask them to vote NO on Cedillo's bill.  If you want to read the other current bills affecting red light cameras, go to the Legis page on the website highwayrobbery daht net.

Wow!  Thanks for posting this.  My ticket was from one of those MTA cameras, and I have been ignoring the tickets.  I was just sent to GC Services, and I sent them a Cease & Desist letter (which I'm now wondering if I should have done that by the high amount of people here saying DO NOTHING!).  It makes me so angry that we were all told as of last July that this program is defunct and unenforceable, and yet the city & county is still using tax payers' money to send out tickets, waste court time, and pay collection agencies to scare money out of people THAT THEY DON'T LEGALLY OWE!!!!  How can they say one thing and do another?!  They are saying that the cameras are being abandoned and won't be used anymore, but people are still getting tickets!!!  This city's government is filled with so many thieves and liars, it makes my head spin.

The "ignore" advice applys to all cities in LA County, and the City of Santa Clarita, which issued your ticket, is in LA County.

My daughter has 2 red light camera tickets and she didn't pay. yesterday her drivers license was suspended. collection agency says they will reinstate if she pays of the ticket.I hear everyone on the net saying to ignore and I wish we could but that doesn't seem to be an option for us. any suggestions.

David didn't say whether her tickets were in LA County.  And he didn't say if she totally ignored the tickets, or contacted the court then broke off.  (If you are gonna ignore, it has to be total.  If you contact the court for any reason, such as to take an extension, you have acknowledged receipt of the ticket, and you will be reported to the DMV if you fail to follow thru.)

I received a red light ticket and tried to fight it because on the photo they sent me. It showed my brake lights were on as the light was red.  I showed the Judge, he said you VIOLATED THE LINE..  I inquired what line, he said on the pavement.  I replied I was not watching the ground , I was watching the signal.  Anyway I lost, and could not pay, and asked for Community Service,and have had it post poned a few times because of sickness in my family. However, my insurance from Hartford (AARP ) went up, and they quoted it was because of the ticket, I thought this was not suppose to have happened.  What can I do .. Thank you, Dorothy Walker

AA...if you were to get stopped, say for speeding, and the cop runs your lic #  will he see that you have an unpaid moving violation ticket?  Are there then repercussions, do you know?

I just got a red light cam ticket 2 weeks ago in WeHo, and I am not paying it because it will end up costing $700 when all is said and done...ridiculous...just can't do it...I am hoping for the best!

I can tell you that I've been stopped about 4 times since I've had this...

Once for speeding, and about 3 times for tinted windows.

This has never been an issue...

Stay strong!  Don't give in!

It's not our fault Los Angeles can't balance it's budget, and I refuse to give in by contributing to this type of "shake down"...

TRUST YOUR INSTINCTS, YOUR WALLET, AND YOUR COMMON SENSE, NOT EXTORTIONISTS, AND CERTAINLY NOT THOSE THAT ALREADY PAID, -THEY FELL INTO THE MONEYTRAP.

If they tell you to jump off the same bridge they did, will you follow them? Or, will you listen to those that confirmed this is not enforceable?

Channel 7 news just had an update on this very item, three days ago. They said it was no longer an active program in Los Angeles County, but then they added that Beverly Hills will still be enforcing theirs! !@#$%^!!!

I thought Beverly Hills was also in Los Angeles County. How can they demand this in their city ONLY? Are they above the county's law? I will be watching to see what happens in that city!

BTW: If this is true, then cities can go against all county laws, then state laws, then federal laws, right? How is any of this constitutional?

Thanks so much AA...I will ignore.  They should charge a reasonable price if they need money.  This is simply greedy.  And Mayor V has signed a law that illegal aliens cannot be cited for not having a license...because he feels they have enough "hardship"...well I would argue  $700 is a hardship for most people!!  This is the reason we can't respect the lawmakers!!

Thank you for the info.  I found it curious that there were so few on this thread that ACTUALLY hadn't paid, but  a lot of people just saying don't!!  Hard to trust!!

You want proof that ignoring is the thing to do?

My violation date was on 9/8/2004.  It was in Hawthorne, CA.

Due date on my ticket was 10/28/2004.

Today is 3/27/2012.  I have no points on my DMV.  My insurance has not gone up.

My friend is my insurance broker and he runs my DMV record.  I can CONFIRM that there is nothing showing up on my DMV record.

But just as the article says, the ticket still appears in the LA Superior Court database.

The reason I'm looking this up now is because I just received a new letter about LA's Ticket Amnesty Program (from GC Services) saying they will give me a 50% discount if I decide to pay now...

That letter just went in the shredder...

This is unenforceable, folks... that's all there is to it.

I did not.  I've received one or two letters in the mail over the years (literally, one or two).  But have never received any phone calls.
