Graffiti House Celebrating Heal The Bay Targeted by Santa Monica Officials

Art in the Santa Monica streets -- and country club-adjacent.
Update: We're told the artwork is coming down Monday. More deets at the bottom. First posted at 1:20 p.m. Friday.

Shortly after the unveiling of pro-Heal the Bay graffiti art in front of a four-story Santa Monica home yesterday, the place was visited by the cops, then code enforcement.

The work, by West Coast legends Risk and Retna, is not legal, authorities say. They needed permits.

The idea behind the so-called Heal the Bay House was to make neighbors aware of the pro-ocean movement while making an abandoned house a little more palatable. Santa Monica police Sgt. Richard Lewis, however, tells us ...

... neighbors, apparently not happy with the artwork, called, an area neighborhood resource officer paid the place a visit, and city code enforcement got involved.

"He [the officer] went out there and discovered it was a vacant, unoccupied house with no permit," Lewis says. "Whatever they did needed to be permitted and it was not."

The artist Saber claims the project is "up to code."

The Heal the Bay House, with its scaffolding-supported panels that declare "RESTORE AND PROTECT THE WORLDS OCEANS" and "OCEANS AT RISK" was the brainchild of area local Adam Corlin, a Heal the Bay supporter who recently bought the place as a distressed and foreclosed-upon property. (We have a call into him).

The Santa Monica Daily Press says quotes code official Ron Takiguchi as threatening to order a complete take-down of the art.

One neighbor called it an "eyesore."

Corlin had planned to keep the artwork up until Sept. 17, when Heal the Bay celebrates the statewide Coastal Cleanup day.

Heal the Bay communications director Matthew King told us that the organization is happy with the art:

We think it's a powerful and beautiful way of reminding people of the value of the ocean. ... From Heal the Bay's point of view Santa Monica has a rich tradition of supporting public art and environmental awareness, and we're really hopefull the city and the homeowner can work something out and these panels car remain up.

You would think you can pretty much paint your home as you wish but, in this case, because it involves panels and scaffolding, Santa Monica might see it as illegal, commercial-type signage.

We also have a call into Takiguchi to see if we can get some clarification on this. Stay tuned.

You would also think that neighbors would prefer some museum-quality art (Risk and Retna both starred in MOCA's record-breaking "Art in the Streets" exhibition) over an abandoned eyesore with a homeless woman reportedly living on one floor.

But hey, this just ain't Santa Monica. It's north-side Santa Monica -- near the Brentwood Country Club.

Update: The house's owner, Adam Corlin, got back to us. He says the city did indeed cite him for -- get this -- having an unsafe structure on the property.

That unsafe structure?

The scaffolding and the art it holds up. Corlin argued that the scaffolding is designed to hold much more weight than that of the art and that he's never, in many years of building structures in Santa Monica, had his scaffolding inspected or cited. He said his structural engineer has pretty much signed off on the thing as safe.

Corlin says he did not get any permits to build the thing but, again, notes that he's never had to get a permit for scaffolding in the past. He also doubted whether the city would have approved it anyway.

He also argues that at Halloween many homes in the area feature temporary, unapproved structures such as haunted-house entryways and elaborate decorations that stay up for days.

The citation lays down the potential for $2,500 to $5,000 fines for each day he refuses to take down the "structure."

Corlin says, however, that a city official told him Monday was the day Santa Monica expected to see it come down. He said he couldn't do it safely any sooner anyway, but he's going to see if there's any way to keep it up longer or have it moved elsewhere.

Already, the homeowner says, a friend came forward and offered to pay the fines in order to keep the art up for another week.

The city, Corlin says, is threatening to take its case to the L.A. County District Attorney's office is the pieces aren't taken down Monday.

"I think they just used the build department as an excuse to get me to take this down," he said. "There's a double standard going on here. Somebody doesn't like the art or the message or the artists."

The homeowner says the scaffolding and art was build to be mobile and that he would like to see it displayed elsewhere.

He said he didn't think controversy would have erupted if the project did not contain street art:

"I feel I'm being squashed by the man."

Update No. 2: Corlin told us the art was staying up for now, at least until he hears back from city officials whom he says have failed to return his phone calls.

"I would love for them to come out here and give me any corrections they have in mind," he said. " ... I wish the city would work with me."

He also expressed dismay with our headline's use of the term "graffiti house:"

I really wish you would call this the graffiti house. It's unfortunate. I don't think this is graffiti. It's art. Retna is an artist. If you want to see a graffiti house the city should have come here when I purchased it.

Update No. 3: Corlin tells LA Weekly's Shelley Leopold the art is coming down Monday and that he planned this all along. The pieces were put up to celebrate Coastal Cleanup Day, which is Sunday.

What a joke!! Corlin made a fool out of the media and Heal the Bay. Have you seen this "eco" friendly house? It is over 5000 sq ft with a bathroom in every bedroom. It is about to come on the market so in a last stitch effort to attract attention for this soon to be over prices turd, Corlin hosted a huge party with a big, bright art installation. Yes, neon lit art which has been running, on electricity, for over 3 days, 24/7. I have to laugh when I read his comment above "rethink your consumption habits." Since when is a 6 bedroom, 6 bath house not consider conspicuous consumption? Shame on you Heal the Bay for playing right into Corlin's attention grabbing hands and shame on the person who purchases this turd.

this just goes to show how ridiculous SM is, keep in mind this is the same city that will fine you if you take your dog to one of THEIR dog parks and are not a resident.

It's your home, do as you wish with it so long as it does not harm someone else.

Heal the Bay! That implies an element of "Respect". This owner lied straight to my face many times saying he had permits while he was working on it. He should feel lucky because any other person in SM would be thrown in jail for this kind of action. Is this a message we want to promote to Kids? Break laws, lie to people, disrespect the neighbors and invite others to help you? Worse is the fact they put up Kids posters to try and gain an element of sympathy. Not cool at all! I have surfed up and down the coast, swam with sharks and dolphins and picked up the trash left behind by others for 40 years. If I did this in my front yard my neighbors would not like it at all. I am calling "Taggers" in LA, bring your paintball guns and TAG it. Let's touch it up! Hurry before it comes down!

What you don't see in this article, is that no such ordnance existed making this display illegal, until the neighbors complaints caused the jerkoff councilmen (or women) created a reason to cite these inspiring Artists with an ordnance they created on a whim. Specifically for this. It's bullshit and censorship, if you are a legal home owner you should be entitled to display whatever you deem fit. If someone created a law to ban your fabulous Christmas display and decorations simply because they dont like looking at it, you'd feel targeted, and that's exactly what's happening here. Santa Monica is one of the leading Cities in the Nation with Signage Codes. There are many restrictions on signage and I think the City looks much better for it!

Hmmm, a couple days of visible art gets neighbor panties in a bunch, and more importantly The City Man is on top of this egregious breach of public safety in just a few hours.However, live next to irresponsible dog owners who allow their animals to generate excessive noise - at all hours - with chronic barking and you are in for many months (year-plus, now) of true suffering.  Torture, actually.Don't like the art?  Turn away.  Can't stand the barking?  Suck it.Stick it in the news, everybody shows up with a camera to film complaining snobs missing the message anyway.  Poisonous noise injecting into your space constantly?  Suck it, it can't be photographed by lazy reporters, the only reason The City Man takes action.What's worse?  Sonic torture for years with no Man enforcing clearly written noise ordinances, or temporary visual art with a message that only - momentarily - offends snooty-snobs?Seriously.  Priorities.  As hyperinflation squeezes off the flow of blood to your brain you should consider what it will take to live with your neighbors through WW3...

Not to take anything away from this story - which is interesting and relevant, but what if you, your friends, and your neighbors were outside in the backyard sans great-big-art and whatever you were trying to accomplish back there was accompanied by either non-stop barking at nothing (psychologically damaged animal) and/or a dog barking at anything that passes its perceived territory (maladjusted animal) (there are many more variants of badly managed dogs, these are just two)?

Here's my point again in terms of your experience: The City Man will respond to big-art only because it is easy to hold City Man accountable when there's a picture of "the problem."  Now, you, your friends and neighbors are having a Friday night BBQ and Irresponsible Dog Owner #1 has left his animal in his yard all day and #1 has decided to meet someone after work.  Doggie ain't on his normal sked and begins whining, then howling.  On the other side of your sanctuary ne. backyard it Irresponsible Dog Owner #2, who is actually at home but - for whatever reason - is not concerned over #2's dog barking at every target that passes, and in the early evening and especially on Friday night, there is a constant procession of barkable targets within range...

You, friends and neighbors in your backyard.  What can you do as the barking has destroyed your evening?  Call police?  If it was a party/music noise complaint (potential revenue/kudos in arrests for illegal subs/underage/second-call fines, etc.).  Chronically barking dogs (imagine EVERY ONE of your Friday's, big fella, and your Saturdays, Sundays and every other night of the week.  Wait, add EVERY MORNING.

What say you now, fella, when every logical remedy refers you into a que (a "line") that takes more than a year to resolve, if ever?

That backyard you're paying for (not to mention the rest of your property)?  USELESS, fella.

Suggestions?  Or are you one of those people who are more concerned more with how it looks rather than how it is?

I think Santa Monica has lead in many areas! Especially Art! They may not issue many building permits, and chrony capitalism may still be at work. But in terms of Environmentalism, Sustainability, even the jail last time I was in it was pretty humanistic.  SM has a been a leader among cities in the Nation. Santa Monica High School places more Kids in Harvard, Yale , Princeton, than any HS in the USA. People don't want their Kids in SM School District for nothing.
