Legal Marijuana Users in California Can't Buy Guns, Federal Gov Says

If you legally use medical marijuana in California the federal government has just revoked your constitutional right to bear arms.

In other words, if you use weed, forget about buying a gun. Well, enforcement is another matter (more on that below).

You see, the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) issued a memo last week clarifying its stance regarding selling firearms to medical cannabis users:

Don't do it is what the ATF essentially told gun sellers. The bureau has long held that you can't have a gun if you're a user of any federally outlawed drug, a group to which marijuana belongs.

And, the memo, first reported by Lee Newspapers and echoed in this AP report, says:

There are no exceptions in federal law for marijuana purportedly used for medicinal purposes, even if such use is sanctioned by state law.

Even though weed is legal in California, and you have a constitutional right to get your gun on, the federal government doesn't recognize bud as a legit medication, despite your "back pain."

But ... (and this like, a Kardashian/J-Lo sized but) ... there's not much gun stores can do to ensure they're not selling to a medicinal stoner.

If you don't volunteer a medical marijuana ID card, if you answer "no" to a required federal form that asks, among other things, if you're a controlled substances user, and if the seller doesn't think you look or smell like an obvious addict, then you're probably getting your gat.

Of course, we're not suggesting you lie. That would be illegal. What we're simply pointing out is that gun stores are not going to check to see if you're on any med-pot list.

So go ahead, get your gun, you non-weed smoker you. But for God's sake, don't use your weapon when you're legally "medicated."

This makes me laugh. How many pill poppers and people addicted to methadone will still be able to get them? Any, right? Why? Because, the government gets kick backs from big pharm to drug up people and keep them addicted legally!

i have never seen aadicted m/j user and i have seen alot of smokers in my day but the real fact is they are the atf and dont know anything about smoking i think that ciggeretts are more adicting than mj does the atf take there rights away no because they get all mighty taxes oh than the booze was ileagal to until someone said we can make money on the taxes ya lets make it legal ok now booze is legal not only do the gov. makes out on tax but the police than get to fine you when you have had to much booze so when the gov. gets off its ass mabe m/j will be legal they dont take the drunks guns away oh well thats life in the freedom bearing country we live in thanks

If you are a FFL an ATF Memo has a lot of power.  Although they may or may not be able to prosecute someone who uses medical MJ, and owns/buys a gun, they can take the FFL's License if they sale to people known by the to be Medical MJ users.

If you don't tell the FFL then they won't know.

That's not point. They are talking about 5 to 10 year prison sentences, not just a revocation of a gun registration or denial of a permit.

mr. romero you are aware that the bill of rights the consitution is the highest land of the law.  It is what this country is based upon.

a memo is not a law.

a memo does not over ride the constitution of america.

If you are a medical cannabis user guess what you still have your bill of rights, and the right to bare arms 

no matter  what memo the ATF decides to release!

Don't forget the ATF sells guns to mexican drug cartels.  The ATF has no moral high ground from which they can issue their "memos"

extremely petty and a weak grasp at power!

The constitution, the bill of rights, the 2nd amendment,  stands above and beyond any memo issued by any government agency.

Mike please understand Dennis is a paid typist.  

He is literally paid by the status quo to keep the status quo's ideas theories etc in the mainstream media.  

Dennis does no research he just types an article on a subject that someone orders him to write.  then an editor has to carefull double check dennys work because he can't publish things for himself like a real journalist.

So the ATF says not to sell guns to U.S. citizens but encourages selling to the Mexican Drug Cartels?  Makes a lot of sense.

precisely  and dennis romero fails to mention something so important .

the atf is an agency that has NO MORAL high ground from which they have any real authority.  

The ATF is just a mafia group with a bunch of guns.  No different from any other gang....

and gangs work with gangs which is why the ATF was supplying the narcos down south.

Dennis Romero is too cowardly to report on what is really going on in LA ; so don't expect any real journalism from this typists.
