Christina Casey Mauled to Death by Neighbor's Pit Bulls; Brother Sues City of Moreno Valley

If your neighbor's vicious pit-bulls repeatedly tunnel under your fence, only to one day maul you to death, take note:

Your family can sue -- not the owner of the beasts -- but the city, which presumably has much deeper pockets.

Such is the case in the tragic death of Christina Casey, and her brother's recently filed lawsuit against the City of Moreno Valley.

As was widely reported last November, 53-year-old Casey was found dead at her home after her neighbor's dogs dug a hole under a wooden fence separating the properties and took a chunk out of her throat.

Bill Casey, her brother, said that Christina Casey had told the city's animal control authorities on at least one prior occasion that the aggressive animals had tunneled free into her yard, but that the city did nothing about it.

Now Bill Casey is suing the city for not preventing the deadly attack.

Bill Casey claims that the city knew the neighbor's dogs had behavioral problems and were insecurely confined by the fence.

According to the lawsuit, first reported by Courthouse News Service:

Despite [the city's] direct knowledge of the predatory and aggressive nature of the dogs, their knowledge of their ability to escape confinement ... [the city] took incomplete, insufficient or no remedial action as required ... to remove the threat of harm the dogs posed. As a direct consequence of [the city's] failure to discharge their duties ... [the city] caused or contributed to the incident which resulted in the dog-mauling death of [Casey's] sister.

Making the death all the more tragic (as if it were possible), Bill Casey has said that his sister was two days away from moving to a new home in order to get away from the dogs.

I knew Chrissy, she was an echo tech. She looked at hearts for a living. She could tell if your heart was working well or if you where heading for trouble. You get that skill after looking at hearts for 20 odd some years. These dog use to chew through the fence and dig under them to try to get to her and her dog. While her dog lived she did not. Considering how she loved her dog. There is a good chance she got between the dogs that were trying to attack. The owner knew he had vinous of that had bad behavior. One of the dogs tried to come after me, Chrissy beg me not to go to the animal control or the police becuase she didn't want to get kicked out of the rental home she was in. She could not afford to move and was saving up to move out.

My neighbor's (who are renters) own an aggressive pit bull who has chased me several times. It happens when I am getting out of my car to go into my home. I called the owner, who called me a b----, and stated that he has a one million dollar insurance policy for such incidents, should I get mauled. This does not make me feel better. I was told that said insurance policies are null and void in California. I called animal control, and when they arrived, the dog showed up and chased the officer. I took pictures, the officer went to court, the people wer told to fence the yard in, and neuter the dog. They did so, now they try to run over my old cat when she is crossing the road. What can I do. (I talked to them about the cat, they blew me off verbally) can someone tell me what I can do

Le sigh. Pits in the wrong hands are like loaded guns left around for kids. Good breed of dog made bad by stupid lazy humans who mistreat, breed incorrectly and reward bad behavior. Sad for the family of this woman,

This breed is just plain ugly & vicious.  If cities are not willing to ban it, then they should be sued.  Bankrupt this damn city & any other that allows this breed to exist.

A person should not have to leave or sell their home to get away from viscious dogs. I hope this man wins, suing not only the neighbors but the city as well. And I hope he gets so much money that it will look like the treasuries of some countries. Pit bulls terrify me as I am certain they do many people. We should not have to live with them near.

So sad for three reasons. The person getting killed, the city over reacting, AND the people (of course) blame it on the dog breed and not the dog indvidualy. Sheesh, this article can't even get their own pic. They had to borrow one of the infamous ones off google.

The city "over reacting'?  It sounds to me as if they under reacted, too little too late. It is true this one breed really gets a lot of press for these horrible incidents, and on occasion it is another breed, but what is the percentage? Is it pit bulls 90% of the time? Another death is too many. It is too bad the woman did not have a gun to protect herself from this viscious animal. If it had been me, I would have shot first and asked questions later. Clearly the neighbors did not care in the least about their viscious animal tunneling under the fence. I think they should do time for this since they are mostly to blame.

Animal control should have removed the dogs from the owner's yard, because this person was obviously an irresponsible jerk who shouldn't have been allowed to have a pet cockroach.  That being said, the city is hardly responsible: it is the NEIGHBOR who's at fault, and suing the city is not only a reeach, but could result in a paranoid banning and even more killing of dogs who are good pets.  Sue the neighbor!

First off I didn't say I was calling he cops.I calld the city.thell get a letter,then a second one if it persist.and the 3rd time the city will do something about.

You want me to go to talk to someone that lives in south cental? Lol ur funny. What happens if I do,then he dosent listen.then the city gets involve?I'm sure he won't retaliate againts me right?

I disagree, he should sue the city as well and be allowed to. Clearly the city Animal Control should have been on top of this situation and it was not. Their negligence caused this woman to lose her life. She had notified them that the dog had tunneled under the fence, what more should she have done. I am not a gun owner and do not believe in having them. However this is one case where a gun might have helped. Once the dog got into her yard, I think she should have shot it. Clearly it was one viscious dog.

Idk this is kinda sticky situation...I'm actually calling the city today for my neighbors pitbull. They keep it in the front yard,while 100% of the time the car gate is wide open and only 60 percent of te time its on a very extremely thin leash. I've walked by and have it bark at me while on no leash with the gate open.

ALL dogs bark!!!!  Barking is NOT a crime!  If that's all the dog does with an opportunity to go after you, the neighbor's dog is probably a well-trained, well adjusted dog who is NOT a problem except in the case of a paranoid neighbor.

Though I tend to agree that dogs in an unfenced area should be leashed for the DOGS SAFETY, I can't help but wonder if you'd feel as threatened if it were a poddle or a yellow lab barking at you. It is this kind of fear and ignorance that led to the holocaust. Not all of a breed is bad because of certain incidents, just as not all of a race is bad just because of certain people. Yes, this situation is truly sad and unfortunate, but is it the dog to blame or the owner that wouldn't take necessary safety precautions? Should that dog have been humaely euthanized before this happened? Perhaps-but it wasn't. So is it his fault? Historically, the APBT (there is no breed called "Pit Bull, incidently) was referred to as America's "nanny dog", we used them in our war posters, to watch our children and they were stars on television. I went to the vet recently with a very large American Staffordshire Terrier with cropped ears and little beady eyes-he looks like he would eat anyone that got close yet is the biggest baby. Who were the people NOT afraid? The older people, saying, "Oh, I had one like this as a kid. So sweet." To ban this breed is the same as playing Hitler-have we learned nothing from our history?

The point is you only feel unsafe because the dog is barking at you and is a pitbull!  You calling the police, instead of TALKING WITH YOUR NEIGHBOR, could be an excuse for the cops shooting the dog instead of saving his life, as you claim to have done.  Cops shoot pitbulls just because they are pits, just as neighbors are afraid of them for no reason other than what they are.  We can thank bad owners and media scare stories, which emphasize the dog and not the irresponsible owner, for that. 

How do you know the dog isn't trained to stay in the yard?  I've had neighbors whose dogs wouldn't leave no matter WHO walked by: kids, dogs, cats, other people- it didn't matter!  I would also guess you'd know if they have an invisible fence, but if the dog hasn't gone after you yet, or anyone else walking by, and has remained in his yard DESPITE ALL THE DISTRACTIONS, he will...  unless someone does something untoward in relation to a human being or other pet.  Then I suspect you'd be glad he left the yard.

While that might be true.....What happens when its a child,and the child freaks out,causing the dog to get confuse and bite the kid?

Just because its a nice animal and is train its not an excuse for being irreponsible with your pets. By they way me calling I probaly saved that animals life.That's what a true responcible animal lover would do.

Also forgt to mention I live in south central were dogs are kept/train to be agressive.
