Marijuana Dispensaries Could See Tighter Restrictions, Licensing Under Calif. Ballot Initiative Proposed by Pot Advocates

If you look at the marijuana dispensaries around L.A., you might conclude that the pot-shop game is a far cry from the laws voters approved in order to allow the "seriously ill" to share homegrown, nonprofit weed.

It has become, even by some of marijuana most-staunch advocates, a for-profit game worth millions, maybe billions of dollars.

Marijuana backers, organized and somewhat unified in their failed ballot push for full legalization last year, are taking responsibility. They're even ...

... wondering aloud if California's loose regulation of medical marijuana invited the U.S. Department of Justice to declare that dispensaries here are in violation of federal law and should be shut down.

The Sacramento Bee:

Dale Sky Jones, chancellor of Oakland's Oaksterdam University, the cannabis trade school that became the nerve center for the Proposition 19 campaign, said recent federal enforcement actions underscored a need for an initiative dealing specifically with regulating medical marijuana.

A representative for the United Food and Commercial Workers Unions, which is organizing California cannabis workers, and Steve DeAngelo, director of California's largest medical marijuana dispensary, said they are also working on drafting language for the potential 2012 initiative.

The language is still up in the air but backers told the reporters at a San Francisco news conference that they would lean toward regulation of the type seen in Colorado -- with inspections and state licensing.

"Right now, zip is happening," Assemblyman Tom Ammiano, a supporter of medical marijuana, is quoted as saying.

Did any of this occur or not?  The people of LA deserve to know!!

  It is time for the City Attorney to answer questions and be responsible for its actions.  The LA City Attorney is either withholding information in regards to how many Medical Marijuana Dispensaries were open back in June 2010, or they made a false statement and took no action concerning the information gathering back in 2010.

Why is the LA City Attorney now making statements contrary to what it issued back in June 2010 for Medical Marijuana Dispensaries having shutdown and their "closed sign up"

Do you believe what the LA City Attorney was telling you in June 2010 or now in 2011?

Most everyone has heard about the RAND study were there was a correlation between an increase in crime around areas where Medical Marijuana Dispensaries had been ordered to close in Los Angeles during June 2010.  Most don't understand that now the LA City Attorneys office is back pedaling on their statements from June 2010.  JUST NOW IN 2011 LA City's Attorney Jane Ushner was informing the people of LA that many of the Medical Marijuana Dispensaries remained open back in June 2010!!!

BUT in June 2010 when LA's new Medical Marijuana Ordinance went effective and over 400 shops were ordered to close CAN you recall what the LA City Attorneys office told the people of LA?

DO you want to know what the LA City Attorney was telling the public back around June 2010 after over 400 letters went out?

Lets first analyze NPR a fairly middle of the road slightly liberal media outlet

NPR makes the declarative statement to the readers 

"Police officers will begin closing down 400 unregistered dispensaries now operating illegally."

Immediately followed by a direct quote from Asha Greenberg LA Assistant City Attorney

"The sky isn't going to fall down," says Asha Greenberg, assistant city attorney. "LAPD isn't going to go around kicking down doors, etc. Initially we're going to be doing information gathering."

Greenberg says L.A.'s new ordinance makes it a misdemeanor to run a dispensary without city approval.

"Anyone who is operating a medical marijuana establishment, who is violating the city's ordinance is subject to arrest," Greenberg says.

The people of LA want to know did any of the things Asha Greenberg said actually occurred?

Was anyone arrested ?  

---> Apparently Asha Greenberg says "we're going to be doing information gathering." <--- where is this information?  Was it done?  If not why?  Why was this statement made if there was no plan to actually do any information gathering?

Who will be the first in LA to write about LA's 4th medical marijuana Ordinance? Romero, Singh, or bosshog Hoeffel?  Only one can get the scoop about the new medical marijuana ordinance?  Why aren't any of you guys posting the prerelease or at least commenting about it?

In overturning a Long Beach ordinance, the court said the city went a step beyond California’s action in 1996, when state voters eliminated criminal penalties for patients who used marijuana with a doctor’s approval.

Deciding not to prosecute someone for drug use doesn’t conflict with the federal ban on marijuana possession and distribution, the court said. It also said a city’s restrictions on marijuana dispensaries, such as limiting their locations and operating hours, wouldn’t violate either federal or state law, Bob Egelko reports in the San Francisco Chronicle.

But by issuing permits that let a certain number of pot collectives operate within city limits, the court said, Long Beach has put a stamp of approval on an activity that federal law forbids and is interfering with nationwide drug enforcement.

you fail to comment on the fact that creating regulations and guidelines for medical marijuana by a city .  is in effect a city authorizing a medical marijuana dispensary which might i add federal law prohibits.

any los angeles medical marijuana ordinance which restricts via zoning regulations also indirectly authorizes the medical marijuana dispensary location by giving such guidelines which permits the use of a location which federal law prohibits.

so i wonder how LA will create an ordinance authorizing something they aren't supposed to authorize or regulate?

Oh well i guess more overtime for the city lawyer$ !!

Dennis how precisely should a Medical Marijuana Dispensary be run?  The state gives no guidelines what so ever as the the details....

seems like you are complaining about a problem our politicians have created by keeping medical marijuana in a complete grey area sense prop 215 passed in 1996!

All medical marijuana law is chopped liver except prop 215 which was created and passed into law by direct will of the people of California and not with any elected official.  VERY very few laws have the distinction of not having a politicians carry them into creation SO prop 215 has a bit of gravity to it shall we say?  To underscore prop 215 is to underscore the direct will of California voters and that can be proven from a numerical standpoint so as it cannot be argued from a lawyer with a silver tongue.  

The lawyers are circling on the legal faults of the cities, states, & federal government's implementation of ordinances , sb420, & prop 215 through the judicial system.  the lawyers are feasting as always even the governments' lawyers too who are billing a nice overtime here and there.

First there was an industry from Medical Marijuana Pot Shops.  Now there are an assortment of Marijuana Lawyers for keeping Marijuana people free and Dispensaries operating indefinitely regardless of federal or state threats or letters.

Due to recent judicial decisions (Croskey ruling cities can't authorize marijuana collectives & Mohr who declined to take into account Croskey ruling said  he wouldn't provide an injunction to any of the LA Dispensaries for the LA Medical Marijuana Ordinance that in effect authorizes large scale production and dispensing of medical marijuana on a level unseen for any city in the USA.  Croskey saying STOP and Mohr saying GO) being at logical odds with one so as to become double edged in the future for any politicians who attempts to create a new structure based off of a court ruling, and costly from how many resources the courts must now use to battle off/delay judicial decisions / progress from legal challenges

courts are a business too and legislatures will have to attempt to come up with something!

the government is having more and more difficulty keeping medical marijuana in a completely grey area. but the government at every level is merely a tool of large businesses rather then a democratic republic.  

The recent activity in the closed LA City Council hearing concerning the new Medical Marijuana Ordinance was interesting but it will again be easily challenged in court!

There is a way to ensure the federal government doesn't raid anymore medical marijuana dispensaries.  We need to remove its power via legislation.  Pass H.R. 2306 and limit the federal government's power to enforcing only cross-border trafficking.  Regardless of how you stand on the marijuana debate we can all agree it should be left up to the states and the federal crackdown is an abuse that any state that supports marijuana reform should not have to tolerate.

Only way to safeguard the medical use of this plant and lives of millions who depend on it is to end prohibition, period.  The quickest way to do that is force our federal government to acknowledge the medical utility and relative safety of the herb, which is precisely what they are trying like hell to avoid because they are corrupt to the hilt.  Make no mistake, marijuana is not the problem here; it's not even our failed drug policy, it is rather a federal government which has no concern for following laws or protecting people.  They work for pharmaceutical companies and other vested interested heavily threatened by the potential of cannabis to steal market share by offering a better product which also happens to be sustainable and good for the environment.  Our government is now collapsing because of this insane greed...

Colorado's 100s of pages of byzantine, stifling, privacy invading and impossible Regulations, and the bankrupting $10s of thousands in license fees, have destroyed the MMJ industry and needlessly driven up prices to Patients.

It's a sucker's bet ... and no guarantee that DEA won't still attack and imprison the Dispensary owners, as has already happened in Colorado.
