CHP to Crack Down on Eating, Applying Makeup While Driving (Not Just Cellphones)

The California Highway Patrol has had some trouble, in the past, explaining where the no-texting law ends and dialing a number into your phone (which is technically legal) begins.

"When you look for loopholes, the whole issue of cellphone use, texting or distracted driving becomes confusing, if not overwhelming," CHP Officer Steve Creel told the Mercury News last spring.

But the CHP will be swinging to the harshest end of that spectrum for its 24-hour distracted-driving crackdown this Friday and Saturday:

Officials tell Fox40 that from 6 a.m. on Friday to 6 a.m. on Saturday -- just one day before New Year's, when we're all perhaps a little giddy -- they'll be pulling over drivers for eating, reading, putting on makeup or anything else that sways their attention from the road.

Talk about "zero tolerance." According to the Los Angeles Times:

While there is no law saying someone can't eat while driving, a distracted driver is in violation of the law.

Under California's vehicle code, a driver can be ticketed $145 to $1,000 for having "wanton disregard for the safety of persons or property." Officers will also be tracking these distractions and the number of distracted drivers, because there are not very good data on just how many distracted drivers there are.

Guess our morning makeup/breakfast routine will have to be planned a little further ahead of time tomorrow.

"There's no specific law for somebody eating a cheeseburger and driving a vehicle," another CHP officer tells Fox40. "But unfortunately we have some drivers who don't have the ability to multitask." (Thanks for ruining the commute for the rest of us, guys.)

But the question still remains: Where do we draw the line? Can we blow our nose? Drink coffee? Change the radio station?

"I think it must be a poorly written law," San Jose State professor John Clapp said in the Mercury News piece from springtime. "I think we should be able to do better." Indeed, any law that allows officers to use such a wide range of discretion leaves more room for discrimination, he-said-she-said, etc.

One more fun fact, for the road:

Since California's law requiring hands-free devices took effect in 2008, the CHP has written 518,161 citations statewide. They have written 11,634 tickets for texting while driving.

You know what is funny here… how many cops I see on duty in their official cars driving around while talking on their cell phones, texting, eating and writing. Their "training" exempts them from the law?? I think not. So next time I see a cop with a phone in hand, I am pulling a citizen's arrest. IDIOTS. This is a SCAM to make $$, break the back of the Prison Industrial Complex

I totally concur with the no texting, and no cell phone dialing laws. If you want to talk on the phone, use a hands free devices. So now with the CHP deciding to ticket for "distracted" drivers, are these devices no longer to be used as well. Many Californians spends hours and hours commuting every day. They are some of the best drivers in the world because of it. With 30 million drivers on the road, once in the while Darwin pops up. No amount of laws and "crack downs" will change that. They are going to crack down with out any data of how many people take a sip of coffee? They are going to crack down when there is no law in place? Wtf? I believe what they will wind up doing is turning California drivers into a nation of sneakers. Sneaking is a bigger distraction than just doing it. What it boils down to is revenue..If they don't generate it, the CHP macho studs won't be able to protect their $135,000 + benefits salaries, and their 100% paid for pensions. They are going to crack down? Sounds like they are going to harass! Don't fail to pay that fine by the way, that's what they are hoping for, because then in true California Government on your ass fashion they will triple it. Oh that will make it easy for you to pay. We need less government. End the police state here and now. Vote on election day and fire each and every one of their overpaid, over indulged jerks. Arnold's answer to law enforcement was just to hire more and more...now we have too many of them. It's time to to cut back. Too much of a good thing is bad too. It's time to start laying off and furloughing just like we do with any other government employee. It's time for all those high school football jocks to find another line of work. Really it's all kind of like welfare for men. With all the different law enforcement agencies we have layer upon layers of police, sheriffs, marshals, state police, etc..etc..Not everyone can be a 911 hero. Kinda tired of all that bullshit. Enough is enough! I don't want to live in a police state.

Fire them all, we don't need CHP, because sadly that ditzy blonde, or that cell phone talking idiot on the 5, will ALWAYS be there.  The CHP can't fix it, and by creating laws its just more make work work.  Police yourselves, you see some asshole talking on his cell phone, give a cop a break, personally take the cell phone, and smash it right in front of dudes stupid face.  If your woman is that dumb bitch putting on makeup while driving, then your kids deserve to be in a horrible wreck.  Why can't the state back off with the socialist agenda and just let the dumb ones kill themselves off, cuz those of us that aren't socially braindead, can multi-task, drive a car, and avoid the dumbass mother fuckers that apparently need to be school yard monitored.

Fuckin america, such stupid fucking people there.  i mean here, why the fuck do I still live here?  Gah!  The land where 85% of people believe in a fairytale bible and think that more cops will somehow solve problems...  Hmmm... mebe that's why we always elect the TOTAL FUCKING IDIOT Candidate... wait, it's exactly why.

Today's cars are sold by advertising all the new driving distractions imaginable.  I'm surprised that manufacturers have not come up with; makeup robot, robot that stuffs your face for you, etc.  Problem is, drivers have become "cagers" (term used by motorcyclists) with the belief that their cage will protect them from getting hurt and while they're in the their cage, why not eat, turn music up to 10, read the paper, put on makeup, etc.

I'm pretty sure smacking another's car with yours is already illegal. This is the logic of preemptive war taken to a lesser, subtler extreme. Fines are an act of aggression at their heart.

Given that each uniformed CHP officer costs the state of California about $300,000 per year, it would be disingenuous to conclude the CHP is concerned strictly with our safety.

Basically, this a probable cause "snoop and poop" tactic to get the chance to determine if the driver has been drinking, and to generate more revenue. Overly tinted windows, oversized tires, raised suspensions, and blaring stereos are also a violation. Why not go after those too?
