Medical Marijuana Dispensary Operators Convicted as Drug Dealers in Long Beach

Oh boy. There are some unhappy cannabis advocates in the LBC today.

You see, they were watching the case of People vs. Joe Grumbine and Joe Byron with high hopes. And we're not being facetious. The pair of dispensary owners were accused of being run-of-the-mill drug dealers. But their hot, celebrity attorney fought back and got the justice system to accept their "medical marijuana defense."

They're legal purveyors of weed under California's medical marijuana laws, argued Allison Margolin, who claims to be "L.A.'s dopest attorney."

Not so dope, apparently.

And besides, juries are retarded and they'll convict your frigging grandmother of jaywalking even if she didn't have enough time to push her walker across the street on a green light.

Despite Margolin's noble efforts the jury late yesterday decided these two were just drug dealers after all.

Joe Grumbine and Joe Byron were found guilty on all 13 felony counts filed against them. They included drug sales and filing false tax returns as part of their operation of the dispensary, according to the Long Beach Press Telegram.

The jurors' reasoning appears to have gone something like this: Even though the duo was operating a dispensary like many others, California law doesn't really protect you if you're retailing weed and making a profit -- and hiding such profit from Uncle Sam.

That was, at least, part of the argument by prosecutors. Deputy D.A. Jodi Castano told the jury, according to the P-T:

This case is not about whether people have the right to medical marijuana. This case is about two wolves in sheeps' clothing. It's about two men who were out to line their pockets ... with millions of dollars.

More than $2 million, to be exact.

So, as medical pot advocates scream how dare they, remember, California law really just lets you share pot with the "seriously ill." Nothing in there about making millions.

Christ everyone knows whats up with the medical program. It's bullshit we have to act like bureaucrats (call what we're doing something else so it's legal) to pursue our God given rights. Why can't a man make millions being a farmer? Yet some men make millions off the Prison–industrial complex?

Funny how the gov has no problem issuing patents for medical cannabis to a private corporation in ny state... But by all means leave it in a complete grey area so the gov can bust anyone at anytime

exactly.. I don't get what is inherently wrong with having a business that makes money, at the same time I applaud those that are in the business to help the sick, those in pain, and help by giving access to what should be readily available without the Feds intrusion in peoples medicine and choice of which herbs that they can and can't use.

Such a total load of injustice. This case should care the he'll out of everybody. You mention the millions in profit. Where was the evidence? Where was all this so called money? All prosecution fabricated crap to paint an unsupported prosecution. Then the judge doesn't follow the rules of evidence. No proof but yet prosecution is allowed to make these claims without any suppot. Justice gone wild with an 80 yea old judge who thinks he writes the laws rather than rule and support the laws. Now the real kicker......$2,000,000.00 on this pathetic attack. While I watch nurses standing on the streets in LB striking over money, fireman laid off, teachers laid off. But this is how our asshole employees of the state piss away our tax dollars. This isn't about weed. This ran right over to freedom and rights being trampled.

You don't have to defend criminal conduct to defend patients. If there's one thing everyone agrees on -- or should -- it's that good operators are being tainted unfairly by the actions of bad operators who set up shop to make money first and foremost, just like prosecutors say. The fact that patients benefited from safe access to medication through the subject dispensaries is laudable, but when the operators pocket $2 million in the process, that's plainly wrong.

Don't confuse the type of business -- in this case, the storefront dispensary -- with the operators of those businesses. To say all stores are bad is ridiculous, and it's equally dumb to say all dispensaries are bad without taking location, ownership and other factors into account.

Unfortunately, if the good dispensary operators say anything publicly about their profiteering neighbors down the street, they're accused of being narcs or worse. They also invite attention to their own business operations, which may not be entirely legal either even if they're less profitable and more patient-centered. The industry has proven unable and unwilling to police itself, and in the absence of reasonable state regulations, 2011 will go down as a year where prohibitionists won the battle. In 2012, patients strike back, and they'd better not pull their punches when it comes to people and businesses that are in it for the money alone.

the whole california medical marijuana program is a scam. it is supposed to help those with severe medical conditions (mostly chemotherapy), yet the average age of the patients in this program is 24 (and trending lower), and 3% of the entire state has a "medical prescription" from their doctor. it was a noble cause in the beginning, now it's a farce, like the occupy movement.

A scam? No where remotely as close a scam as what this government did when they put mother natures plant under prohibition (and all of the greedy laws since then) and no where's close as what Pfizer and many of the other Pharmaceuticals engaged in over the years. Sir, you must be kidding! Seriously! Did you know sir that the U.S. gov owns a patent on Cannabinoids and is now in talks with a NY based company to process cannabis (even while its still under Schedule I). You have no proof that the system is a scam. I'm a patient and have done reams better on Cannabis than I ever did with Big Pharma. In fact I got rid or Methyltrexate, Vicoden, and Ibuprofen in exchange for Mother Natures plant. Its been two years since I started smoking/eating and i'm now 46 and now running where I couldn't walk. Tell me its a scam. My two daughters will let you know reality too. They watched me go from a man that couldn't walk to a father who can run and participate with them as a result of MJ. Call me and I'll tell you my story. I'm not scared to go public like you are with your anonymous name. Right now I can only think you work for the Pharmaceuticals since you sound like it. Call anytime day or night although I'm a little tired and relaxed since its 11:30 and I ate an edible 2 hours ago and real sleepy. But I can still write and think clearly. Fuck it.
