Illegal-Immigrant Impound Policy Elevates Into Political War: Mayor, LAPD Chief vs. City Council, Police Union

Bad news... for drunks and aliens.
It's common knowledge, by now, that DUI checkpoints around L.A. County double as illegal-immigrant crackdowns.

It works like this: Illegals aren't allowed to hold driver's licenses in California (a public-safety outrage for another day), so when they're asked to show their licenses at a DUI checkpoint, their cars will inevitably, under state law, be impounded and held for 30 days. Immigrants rights advocates argue that the policy works as an indirect tax on undocumented aliens.

So LAPD Chief Charlie Beck recently made the executive decision to do away with the impounds...

... at the obvious bidding of Mayor Antonio Villaraigosa, who depends upon liberals and Latinos (and liberal Latinos) for political support.

Now, under Beck's checkpoint amnesty, license-less drivers will have a small window of time to call a licensed friend to come drive their car away before it's impounded.

From the get-go, this politicized padding of state law has infuriated L.A. police unions, whose prerogative is, of course, to make life easier for LAPD officers. (And muddling the state's unlicensed-driver law clearly does the opposite.)

The latest ally to come out against Team Villaraigosa/Beck is a bit more unexpected: The L.A. City Council. In today's LA Daily News, councilmembers claw the policy to shreds, arguing they should have been allowed to vote it:

"It's unbelievable that this is even being proposed," said Councilman Mitchell Englander, chairman of the City Council's Public Safety Committee, which will discuss the issue today. "It is policy and it's a bad one. People are getting killed."

... The council motion, introduced by Councilman Bernard Parks [Ed note: Parks formerly served as chief of police] and to be discussed in the Public Safety Committee today, calls for L.A. police to continue the 30-day hold until the council could review its impact.

Apparently councilmembers are more worried, in light of upcoming elections, about crucial campaign donations from union coffers than trying to keep up their strained facade of unity with the mayor's office.

They've now aligned themselves with two of L.A.'s biggest police unions -- the Los Angeles Police Protective League and the Los Angeles Airport Peace Officers Association. The unions have come out swinging against immigrants rights groups for calling the impounds racist.

The LAPPL's latest angle was the death of a 60-year-old pedestrian in Panorama City. She had been hit by an unlicensed driver in an SUV:

"The tragic accident in Panorama City shows how the mayor's new policy can result in innocent people being injured and killed," Paul Weber, union president, said in a statement. "The Mayor's directive puts politics above public safety and should be rescinded."

Then there was this recent presser from the LAAPOA.

In a move that can only be called bizarre, the Southern California Immigration Coalition (SCIC) is holding a press conference to remind unlicensed drivers to "drive safe during this holiday season."

It is stunning that, the SCIC is urging unlicensed drivers to continue to break the law drive on Los Angeles roadways. Predictably, the SCIC also applauded the upcoming move pushed by Mayor Villaraigosa to change LAPD policy and disregard state law by ending the 30-day hold policy for vehicles driven by unlicensed drivers.

This war between L.A. Latinos and law enforcement -- and the politicians who pick either side -- is indicative of a larger conflict raging throughout the country. Where to draw the line between ensuring public safety and discrimination? Fingerprinting and privacy invasion?

And on a local level, the police chief's devotion to the mayor's stance on impounds is another portrait of the Krazy Glue bond they've formed these last few years. From the premature press conference to reveal Bryan Stow's attacker, to the choreographed LAPD raid of Occupy L.A., Beck seems to have turned into Villaraigosa's shiny hero puppet. Regardless of our stance on impounding the vehicles of the defenseless, their budding bromance is sketching us out to the extreme.

Shame... Shame.... Shame!

The truth is we need to conquer these guys that run our government and handle it ourselves. Why the hell do we have to deal with this bull****? I mean we pay taxes and have our rights!! Why do i have to wait in line to go to college???? Why does my car get hit by this undocumented idiot who runs away and no one does anything about it? So its OKAY??? Why do i have to pay for some young girls life who decides to have sex and have baby while she is ditching school? WE AMERICANS WANT AN EDUCATION AND THE MAJORITY OF THESE LOW LIFES GET A FREE PASS???? JUST BECAUSE THEY ARE IN OUR COUNTRY??? We pay you!!!! SO GET THE JOB DONE!!!! Stop WASTING TIME BY TAKING THEM TO JAIL  OR EVEN SEEING THEM AT THE HOSPITAL WHEN THEY ARE HURT FROM SOME GANG FIGHT! JUST DUMP THEM BACK! TAKE CARE OF YOUR OWN!

I am an undocumented resident of Los Angeles. My babies mama is a U.S. citizen. I have a clean driving record (well if it was on record you would see that its clean).

I drive my kid to school in the morning and then continue driving to work. After work, I usually  pick up dinner for the family at El Pollo or MickyD's drive thru window before driving the rest of the way back home.

I can't get a driver's license because I am undocumented. I want to be a responsible daddy for my baby and her mama - that's why I make sure to carry extra liability insurance on the car I drive. The car is registered to my babies mama.

I drive a pretty decent car. Its in good condition and has a very good safety rating for its class.A few months ago I got stuck in one of those DUI checkpoints. I never drink and drive, but I don't have a driver's license - so the cops had my car impounded and placed a 30 day hold on it.

Would you believe that when when the hold was released and me and my babies mama went to get the car - the towing and storage fees were $1,200?

My baby was crying like a baby when I broke the news - ballet lessons and karate class cancelled until further notice.

So me and my babies mama sat down and did some thinking. We know that the laws are there for a good reason. The law says 30 day impound for unlicensed driver. We don't have any complaints about the cops. They are just doing their job.

But we have to make choices for our family - and me and my babies mama chose to give our baby back her karate lessons. We want to make sure she can keep the karate lessons and maybe start back soon with ballerina lessons.

Thats why I sold the car. I still drive my baby to school in the morning and then drive to work just like before. Now I drive a hooptie. Its a salvage title - not too safe over 45mph, but it runs.Its not insured. Actually, i havent even filed a transfer of title on the car.

I can always find an old hooptie in the classifieds for $450 - $600. Thats why I don't worry about the checkpoints or the 30 day impound rule.

Next time I will be smiling as I hand the cops the keys to my uninsured hooptie. I won't be seeing that car again. I will call my babies mama to come get me at the DUI checkpoint. I'll tell her to bring the paper so I can start checking the classifieds. I need to buy my new hooptie right away. Got to drive to work tomorrow morning and I'm supposed to pick up my baby at 7pm from her karate class.

The LAPD can't just decide  not to enforce the laws. They must enforce the law when they can clearly see it has been violated.

Oh thank goodness - finally the LAPD will be issuing citations for vehicles and motorcycles violating the California Vehicle Code by encroaching into the Bicycle Lane.

Our fair city will soon be cleansed of cigarette butts and food wrappers on the sidewalks and streets. Can't wait to see all those litterbugs having to pony up the $1,000 fine or spend 10 nights in the clinck.

Lets suspend the drivers license of anyone who has been declared by the court as in arrears for child support payments. Then if they are stopped at a DUI checkpoint - their vehicle can be impounded for 30 days. What if the "father" can prove that the child is not his "biological offspring"?That has no bearing on the issue in Los Angeles County. The birth certificate provides the name of the legal father. When the birth mother completes the paperwork for the birth certificate she can decide who will be the legal father. You say "that you only met the girl once when she was dating your friend"? Too bad, because you're listed as the father of her child on the birth certificate. The court needs to collect child support in arrears. Your wages will garnished, your tax refund will be confiscated, your drivers license will be suspended, your vehicle will be impounded and sold at auction to pay towing and storage fees.What are you going to do about it?So you think you may just give up and leave the country?Ha, Ha, Ha - too late, buddy. Your U.S. Passport has been revoked.

I find it funny that anybody can not see why the police Chief is in favor of this policy. With a Mayor like Villaigosa , who is so pro ILLEGAL ALIEN  and Latino at the expense of all the rest of the people of Los Angeles City. They are in effect breaking STATE Law. When is this going to stop? I think when they are gone, eithier by end of term, or impeached from office.  Since the Mayor spends more time in front of the cameras stuttering and trying to pick up on women, than he does city work. His removal from office would not be missed. The Illegal Aliens  have more rights in Los Angeles City than do AMERICAN CITZENS.

The ACLU snakes are going to be suing every day because a cop gave one illegal immigrant 30 minutes and another one only 28 minutes. And how many people are going to be killed while the cop is standing there waiting for Poncho to come and drive the car away?

 California - and Los Angeles specifically - has been colonized by Mexico. While US citizens were screaming about securing the border, to stop the avalanche of illegals, our elected officials were picking their noses and smoozing with special interest groups.   Texas, along with about 10 other states, is doing it right. They decided to tow all cars which were uninsured. Sure enough,the Dallas lot was full within 9 days, and accidents have gone down 50%.  And traffic congestion has been substantially reduced. The uninsured drivers have to pay a hefty fee to get  their car out of impound, show evidence of insurance, and pay for the towing service. The cars are sold within a couple of months if the driver is a no-show,  and the proceeds go to the city. We just have to start ENFORCING THE LAW that's already on the books. Illegals have broken the law by: (1) crossing our border illegally (2) participating in ID theft to create a false identity (3) driving illegally without licenses or insurance (4) fleeing the scene of hit-and-run accidents (5) using our hospitals without paying for them (6) using welfare benefits that are for US citizens (7) not paying their fair share of taxes (8) overcrowding our schools and colleges - again without paying taxes to support them (9) overcrowding our prisons without paying taxes to support them........  Oh yes, and in case I didn't mention it, I was nearly killed 20 years ago in Pasadena, CA by an unlicensed illegal alien. Will the last US citizen to leave Los Angeles........please remember to take the US flag with you!!!

As an American citizen, I am so sick of our elected officials and civil servants giving a pass to foreign nationals to break any damn law that makes their poor life harder, yet american citizens have to follow the rule of law while foreign nationals pick and choose.  Our safety is at the root of all of this, follow the rule of law.  Secure the border, follow the rule of law.  Amazing how easy it all would be if you just followed our laws that are on the books right now. Nothing racist about it, its the law!  God forbid the only way these people will see the light is when there car is hit and their family impacted by one of these drivers.

This policy is absolute nonsense. L.A. has a larger illegal alien and anchor baby population than any other city in America. It's not even close. Consequently, it is unbelievable that every opportunity to make the lives of the undocumented uncomfortable, thus causing them to move elsewhere, would not be embraced.  After all, it's not as though we have the money to continue subsidizing their presence here.

The illegal, unlicensed drivers should be DEPORTED. However, that will not happen in CA, Mexico has already colonized it.

In time period of 5 years, 5000 people have DIED and 250,000 accidents have been reported in California due to unlicensed/suspended License drivers, and I am sure our mayor and police chief Beck are fully aware of this...and i cannot wrap my head around how they would even attempt to change this law/procedure with complete disregard to these facts. You would think being a leaders of this city they would care about the well-being of their community.

Makes perfect sense to me if you don't have a license, you lose your car. The ban on impounds is nothing more than pandering to special inmterest groups.

"Clearance Auto Insurance" will give you a break if you buy two or more types of insurance. You may also get a reduction if you have more than one vehicle insured with the same company.

Dennis, way to go!! I like the way you tell it.  Plain and simple this is not a racial issue. Its Public Safety.  Unfortunately, no one is educating illegal immigrants and many friends who live in  Latino communities say more illegals are now driving.  I think they are misunderstanding the media.  Even if a cop stops an illegal and they get a ticket,  illegal immigrants have no paper trail so they won't pay the ticket. Shocking the Mayor would be so naive as to blatantly tell people to continue to break the law and I'll help you along with Beck.   For once the City Council has grown a pair.   This is going to be a good battle.
