Alleged 'Sex Game' Teacher Mark Berndt Went Free for Over a Year: How Did LAUSD, L.A. Sheriff Let This Happen?

It's hard to imagine child-molester charges more horrific than those pinned on ex-Miramonte Elementary School teacher Mark Berndt, 63, yesterday.

The L.A. County Sheriff's Special Victims Bureau arrested the teacher, who had been at the school for over 30 years, for binding and gagging at least 23 third-graders. He allegedly let cockroaches crawl on their faces and spoon-fed them his own semen. Investigators say they confiscated over 400 photos of the in-class "sex game," which they believe recurred over a two-year period (from 2008 to 2010).

If true, this would clearly be one of the most sickening abuses of power ever to go unchecked in an American classroom. Yet the amount of time it took to put Berndt behind bars ...

... even after officials had seen some of the photos is near incomprehensible.

LAUSD Superintendent John Deasy told reporters this morning that Berndt was banned from campus as soon as a Redondo Beach film processor turned the photos over to local law enforcement. (And what a stroke of luck, in this digital age, that Berndt made the self-sabotaging decision to develop his kiddie porn the old-fashioned way.)

Still, Berndt wasn't officially fired until March -- likely thanks to an unbreakable United Teachers Los Angeles union contract. The same contract that allows "lemons" to keep their jobs for eternity, no matter their performance. See L.A. Weekly print story: "LAUSD's Dance of the Lemons."

According to a 2009 teacher-effectiveness rating by the L.A. Times, Berndt was seriously lagging in math, and his students scored below average in English progress, as well.

Then there's the obvious fact that no one was watching him. Superintendent Deasy told the press this morning that anyone walking past Berndt's classroom would be able to see right in. And Sheriff's Lieutenant Carlos Marquez says that "During the lunch breaks or recess, he'd go out to the playground and entice [students] back to the classroom."

So where was Principal Martin Sandoval during all this? (A secretary at Miramonte tells us to "call back tomorrow morning," as Sandoval is "in a meeting right now.") Was no one talking to the kids about what they did in class all day?

The students at Miramonte Elementary have been betrayed by the district and the state. Their campus has been left behind to rot, academically: It ranks in the bottom 20 percent of California schools with similar demographics (almost entirely Latino) and in the bottom 10 percent overall.

Teachers being held accountable is a make-or-break situation for vulnerable youth.

Which brings us to Outrage No. 2:

The Sheriff's Department let Berndt roam free for over a year before he was arrested and placed under $2.3 million bail.

During this time, a longtime neighbor of Berndt's tells the Los Angeles Times that he saw the accused child molester riding his bike with a young girl in Hermosa Beach, as recently as a month ago:

Berndt seemed unnerved when [neighbor John McManus] spotted him, the neighbor said, and later told him: "Don't tell my sister I was with this young girl."

The neighbor said Berndt told him the girl was one of his students and that they had ridden the bicycle nearly as far as Marina del Rey and back.

He said he frequently saw Berndt hanging out around the Redondo Beach pier, drinking beer and gawking at girls.

Lieutenant Marquez argues, today, that investigators were "monitoring" the ex-teacher in the months after he was fired, and that any immediate danger was mitigated by the school board's decision to kick Berndt off campus. He tells KNX news radio that the Sheriff's Department wanted to gather all possible evidence before making an arrest. For instance, DNA testing on the semen-covered spoon was only completed about "a month and a half ago." From the Associated Press:

Authorities could have arrested Berndt on misdemeanor charges when the investigation began but chose to build a stronger felony case, Marquez said. He could get a life sentence if he is convicted.

Berndt, who has no previous arrest record, was placed under surveillance and is not believed to have had contact with children during the investigation. The childless bachelor lives a few blocks from two parks and an elementary school.

Jesus Christ. Why couldn't they lock him up in the meantime, while they built the case? If the 40 initial "sex game" photos were damning enough to warrant Berndt's immediate termination, no prosecutor in his or her right mind could turn such hideous evidence away cold-turkey.

LAUSD's decision not to notify parents of the alleged monster in their midst is similarly mind-boggling. Marquez tells the AP that investigators are looking for more victims, and are advising STD testing for some of the students -- medical and emotional baggage they could have been carrying around for an entire year.

We've contacted various legal experts for some insight into how it's even possible for LAUSD and L.A. County Sheriff Lee Baca's department to have dropped the ball this hard.

"Sex game" photos? "Kiddie porn"?  Where are LA Weekly's editors? Where does law enforcement allege that he did any of those things? LA Weekly is usually on the cutting edge of reporting on stories like this, but this time the paper has faltered big time.

Like museums, if you are into the arts, you can try out becoming a tour guide. If you have an advocacy, you can try charitable institutions and offer your skills in maybe, data encoding or a gofer. The hospitals are also a venue where you can be a candy striper.

I'm surprised that fellow staff members didn't notice unusual behavior!!  What about room parents...or parent volunteers?  If he had parents in the classroom, I would think someone would have seen something out of the ordinary in all his years of teaching. And IF he didn't have any parent volunteers, wouldn't that in itself raise some eyebrows?  Every class my kids have had, there are always some parents that volunteer on a regular basis.... I just hope this isn't a case of people having suspicions but never speaking out for fear of being wrong.  Similar to the college sex abuse scandal... if you suspect, tell someone for the childs' sake!  I feel for the kids, God Bless Them....but No Mercy for pedophiles!  I can't wait to hear what the fellow prisoners do to this guy.

It's a month later and still no word from teachers who worked at Marimonte. I think they saw plenty and suspected more. They don't dare break the silence. One did to tell a reporter she ant allowed to talk about it.why? Because the admin was not doing its job well and admin staff was half the size it should have been this things made it difficult to supervise adequately.,I bet Berndt was a very helpful and loyal asset to that prinipal who trusted the veteran teacher and protected him when parents complained and teachers suggested he was up to something.

You can sit there and point fingers toward a principal that has only been at Miramonte for 3 years but the fact is that his job title includes more than prancing around classrooms to monitor every teacher's move, at that rate NOTHING in the school would get done. The truth is that no one expected for a teacher to do something so cruel to these students. You make Martin Sandoval seem like a heartless man who hasn't done anything for that school. How could Mr. Deasy NOT tell the parents of the victims? It's criminal indifference and he should be removed from a position he assumed illegally in the first place. His arrogance is afforded by his relationship with Eli Broad, who apparently owns LA in every sense. To Broad and Deasy these children are apparently little more than livestock . How could school superintended ignore the fact that these children were possibly infected with an STD, AIDS or Hepetitis? It's not unlikely that a child suffered physical injuries while left in this creature's care, the kind a parent could overlook or a child would hide. Moreover, there is clearly the emotional and psychological impact of these children's ordeal to consider, and the fact that Mr. Deasy equivocated, changed his story and ultimately lied about why these parents didn't learn Their children were molested until news broke this week about Berndt's arrest.

Baca contradicted Deasy's attempt to deflect responsibility on his team. No code or protocol would ever endanger a childs life to ensure a successful prosecution. Just pay somebody to wipe out that MF in jail n be done with it.  As a child I was molested too, by many male members of my own family and I can tell you that it took years of therapy and painful self analysis to "get over it" as they say...but the truth is that you never really get over it, it taints your vision of the world, of people, of safety and security, and in some cases causes mental breakdowns.  The only thing you can really do is try to heal and get on with your life.  I f it were up to my way of thinking that f---ker would be dead already.  Small price to pay for the immesurable damage done to those once innocent children.

Since this is the model Deasy wants uphold , the reporter is right to question why the teacher was not already on the ropes given his terrible performance. We know now he was so busy exploiting his little sex slaves he probably I'd have time for lessons. I agree that the focus is a bit murky because this report fails to address the motives of Deasyor his performance as a school leader who 1. Failed to protect children from this monster after he knew what he was doing 2. Provided the monster with an option of retiring with his full pension to deflect the inevitable fall out from this scandal which I suspect he hoped would go away. He then lied about he and the board dismissing Berndt whose version of events is consistent with LAUSD's disturbing deference to Perv policy, which is to do nothing that might suggest that said Perv is guilty as it will be used as evidence gainst the district later when someone files a lawsuit. 3. Contradicted himself in November during a Fox interview about rubber rooms which he sys are full of bad teacher's he cannot fire without spending half a million dollars first because UTLA will fight tooth and nail to protect its members. Teachers and testing. The propaganda perpetuated by way of the tests is designed to undermine teachers and their union so that " philanthropists" can deprofessionalize education. Unrelenting, often ridiculous media coverage of bad teachers is caught in the crosshairs of real news story like this because it exposes Deasy as duplicitous and deceitful. Despite claims that LAUSD is employing test scores to identify teachers who are not meeting benchmarks of teaching standards, this school and teacher's dismal performance were not confronted. Had LAW and LAT been fair and objective investigative reporters instead of creative stenographers, they would have questioned how viable the test data is, how it was npbeing utilized by school officials and they would have considered the obvious flaws it presents as a tool for teacher evaluation.His reporter alludes to all that and provokes another question about the veracity of district officials and while it all seems unrelated there's a very tacit connection. Lausd couldn't bother to scrutinize this school or this teacher when it's performance was substandard. Lausd knew there had been accusation in the past about Brendt's conduct, but failed to remove him and ignored its obligation to monitor him in light of accusations of sexual abuse and consoicuously low cores.someone told this reporter the teacher lured children to his classroom during lunch and recess. This implies admin. and teachers ignored signs that something was ging on. We know they did, and we also know that even nope, John Deasy is more interested n damage control than the welfare of these students. If Berndt was inviting children to visit at recess, it is very possible his exploits included students that were not in his class. And to date Deasy as not yet offered parents full disclosure about the evidence , so some parents are unsure if their child was part of this sick game. In the 13 months of investigation, I cannot see how police failed to question the students . In fact, they assert that keeping the victims parents in the dark was necessary to build their case. How is this possible when no one has more insight or infornpmation about what happened than the victims? Time only conspires against our memory and now the clamor if panic will certainly compromise the integrity of the victims' testimony . Every article Uve read refers to the photos and the spoon with DNA police collected, compelling evidence that will be difficult to discount. Yet an arrest was not made until a year after police had this evidence, and no motion of other evidence is mentioned. Here is a police record confirming a previous accusation of abuse against Berndt that LAUSD claimed in a urgent press release they do not have on file. This ironically illustrates its incompetence as any serious charges should be kept on hand in a special file just for these type of situations. Like me, this reporter understands there is something terribly wrong besides the crimes of this pervert. Deasy is not being transparent, detectives nvolved in the investigation seem to be less than forthright, and the fact that all of them were caught off guard by the arrest is troubling . It seems police were willing to protect and serve Mr.Deasy whose lame explanations and vacillating version of events betray his guilt. He is defensive, deceitful and deflecting attention from his own culpability by firing a Hamiltin HS teacher accused f sexual misconduct and publically announcing the a ccusations made against another teacher Miramonte ES. I don't know if these teachers are guilty. The HS teacher has languished in the rubber years for well over a year and police have not filed charges, which sans there is not much to substansiate accusations against him. Of course, LAUSD makes the rules up as they go along and Deasy will scapegoat this teacher to save himself from what we've seen so fa. As to the seconded MES teacher, it is telling that he has not yet been identified as a sexual predator by anything more than a child's accusation. Yes, it must be taken seriously but given the circumstances, the age of the child, and lAUSd's propensity for manipulating the media and minimizing it's clobility at all costs, I believe we should resist condemning these teachers until we have more concrete information about their situations, I urge this reporter and taxpayers to scrutinize LAUSD, Deasy and law enforcement closely. Earnest inquireys will expose the truths we mee that to protect our children because Berndt is not the only monster in this horror story. Allright, I am a teacher and the scores have a 40% margin of error as a tool for teacher evaluations. The tests are culturally biased as well, and as far as I'm concerned they are a scam Deasy and Philanthropists hope to undermine teachers and thier unions with because they can save billions by turning teachers into temps they churn out through TFA. However, if these are the sores are truly the way they are addressing tecacher quality, it is relevant that they apparently ignored Berndt's dismal scores. As a 30 year veteran teaching 3rd grade at this school, he Didn't have the same mitigating circumstances say a 10th grade ELA teacher faces in light of remediation, accommodations and class size.

I also seriously doubt they watched him 24/7 for many reasons. For one, they simply cannot afford to. The movies make us think it's stake out city when a suspect is on bond, but no way. This mild mannered creep was probably not even a priority. Fromm the time it took to arrest him, we can assume the cops didn't even consider him a flight risk. It's sad, but police are not all that noble or dedicated even when it comes to protecting kids. It's not thier fault. They have to be hard nosed and practical because duty requires this. I am sure they were relieved he was no longer teaching. But I question why they did not alert parents about his potential threat to kids. It suggests they were covering for someone else. I suspect he may not have been arrested at all, but something else happened we have yet to hear about. Itveven crossed mtpy mind that Berndt set himself up. After 30 years he suddenly tses photos to a lab where he knows the exposures are exposed to techs eyeing the quality of photos? He could have cashed out his pension and fled but he didn't... He was my 2nd and 5th grade teacher in the mid 90s, I am now 26. I considered him a mentor/father figure. Nothing of this behavior ever happend during my years @ Miramonte. I felt outraged and disgusted upon watching the news coverage. He taught me so much. I would say he was the best teacher at the school. A part of me is still in shock that he would do such a terrible things to these innocent children. He is the reason the reason why my sisters and I are such big Beatles fans.

To say this behavior dis not happen is too broad a statement. You can only state what you know to be factual, so choose your words carefully. Instead, state that it did not happen to you. Don't be surprised to find other people your age come forward as victims. Pedophiles don't just decide one to day act; likely, he's been doing other things for years and just got more brazen. A 31 year old has already come forth to say that when she was his student, she reported behavior that looked like he was masturbating at his desk and questioned the jar of Vaseline at his desk only to be told not to make up stories, so she subsequently dropped it.

It's a long shot, but he may be innocent. Many teachers are, but unfortunately the photos are really very compelling because a lab worker reported them, police intervened and that's why w know so much about what he allegedly did. You are not the only former student to come forward and say he was an inspiration in your young life. I believe every child who as touched by him in the ways teachers are meant to touch students are victims too. It's disillusioning to discover someone you looked up to and trusted is capable of such monsterous things. People are complex and even a pedophile with perverse impulses can have qualities like compassion and patience. We all struggle with our demons. It seems your teacher's got the best of him. Look, lots of people may be innocent, but this man gagged children and took pictures of them with roaches on their faces and feeding them a white liquid in a spoon, the contents of which was positively identified as his semen, and then personally dropped that film at a processing center wanting the pictures. What part of that seems the least bit innocent? Do his victims need to forgive?
