Cindy Reyna, Model and UC Santa Barbara Student, Faces Deportation

Immigrants' rights activists are coming to the aid of Cindy Reyna, a UC Santa Barbara student and sometime model who they say was arrested and now faces deportation despite being a potential DREAM Act student.

The DREAM Act, which has not been passed on a federal level, would give amnesty to undocumented students who spent most of their lives in the United States: U.S. Homeland Security secretary Janet Napolitano has said immigrants who would be DREAM Act eligible would not be a priority for deportation.

Nonetheless, activists say that Reyna ...


... is facing deportation after she was detained by police for unknown reasons and then turned over to Immigrations and Customs Enforcement officers this week.

They say cops put her in Santa Barbara County Jail last Thursday.

Supporters have started a petition at change.org that asks people to "take immediate action to stop the deportation of DREAM Act-Eligible student, Cindy Reyna ... "

The petition states:

Cindy is a young, ambitious, and hard working student who came to the U.S. at the age of 15 on a visa from Guatemala. Her father, a U.S. citizen tried to petition citizenship for Cindy, but while pursuing her college career she aged out of the broken immigration system. She is a senior at UC Santa Barbara majoring in Communications and Linguistics with a 3.8GPA; her scholastic and personal achievements include interning for Univision, the only Latino/a serving television station in the country, recognition in Santa Barbara City College's Phi Theta Kappa Honor Society as well as the President's honor roll, certificates of special congressional and legislative recognition signed by Lois Capps and Pedro Nava and a Miss Santa Barbara County model.

Supporters say she's now being held at a federal detention facility in Camarillo and that she has been deemed a "priority" for deportation.

... I am very caring, loving, adventurous, and very determined when it comes to facing challenges and achieving my goals.

We have a call into ICE to find out what they have to say about Reyna's case.

[Update at 3:13 p.m]: Santa Barbara Sheriff's spokesman Drew Sugars tells us that Reyna was jailed Wednesday (Feb. 22) at the behest of ICE and spent 8 days behind bars until her release at 8 a.m. this morning ... when she was transferred to the custody of ICE agents.

"I don't know why" she was jailed "since it's an ICE detainer," he told the Weekly.

[Update at 6:24 p.m.]: Sugars of the S.B. County sheriff's office tells us she was arrested Feb. 22 on suspicion of DUI by the CHP. He says ICE put an immigration hold on Reyna after that, keeping her in jail for 8 days.

He says she was technically arrested on suspicion of two violations: DUI and driving under the influence with a blood alcohol level of .08 percent or higher.

ICE spokeswoman Virginia Kice sent us a statement that apparently backs up those claims, though she said Reyna was convicted relatively quickly:

U.S. Immigration and Customs Enforcement (ICE) lodged an immigration detainer against Ms. Reyna Feb. 23 following her arrest by the Santa Barbara County Sheriff's Office for driving under the influence. She was convicted of the DUI charge Feb. 28 and turned over to ICE Feb. 29 based on the immigration detainer. Department of Homeland Security databases indicate Ms. Reyna entered the United States on in Feb. 2004 on a visitor's visa, which authorized her to remain in the country for six months.

Ms. Reyna was processed by ICE Wednesday afternoon and placed in immigration removal proceedings. She is being released under the agency's alternatives to detention program, subject to regular reporting requirements, pending a hearing before an immigration judge. It will be up to the immigration judge to determine whether Ms. Reyna has a legal basis to remain in the United States."

Just because she is hot and nice does not give her the right to be in this country illegally. She is here getting educated, (probably on the taxpayer dime), using the system, and driving drunk. Not to mention the fact that she could not go through the proper channels to get her citizenship legally, in the past 7 years. Like so many others have done. If you can not follow the laws, and are not a citizen then you do not belong here. The UCSB children and professors should start thinking about the legal/ monetary issues of this illegal alien being in the country before they ask everyone to support her. They of all people have first hand experience of the stress that illegals have brought on the education system in the state.(Question for the children: Are you having trouble getting the classes you need to graduate????)....Better think about it!! KEEP HER IN ICE CUSTODY, DEPORT HER AND ALL ILLEGAL ALIENS LIKE HER ASAP!!!

It is amazing how one little bit of stupidity can turn your life upside down. I think she is another example of a person held hostage by the inability of Democrats to compromise with Republicans to get the border secure. All Democrats need to do it agree to authentic enforcement Republicans will fall all over themselves voting for amnesty. Democrats think this issue will help them with "Latinos" when in reality Bush at 40% of the Latino electorate in 2004 and McCain I think 37% in 2008. The arrest and deportation proceeding of UCSB student Cindy Reyna is best reported under the heading of Staged Political Theater - of which the lead role is being played unwillingly, or more likely willingly, by the camera ready Ms. Reyna.

Take note of the comment from the ICE spokeperson on Reyna's quick conviction. If the report of her DUI conviction is accurate, then it must have been a voluntary guilty plea arranged and entered at arraignment or the next day.

Note that Ms. Reyna interned for Univision and has pursued modeling - the notoriety of this incident could help launch her media career. Of course, just because there may be something in it for Cindy Reyna is not enough to get CA CHP and I.C.E  casting a special net to catch one ambitious senior Communications Major and Miss Santa Barbara County contestant.

For that wagging of the dog, look no further than Ms. Reyna's resume listing a cerificate of recognition signed by Lois Capps.

Member of the United States House of Representative Lois Capps (D)  is a soft target for a brutal challenge from Republican allied opponents in the California primary election in 90 days.

The newly drawn boundaries for California Congressional Districts have made Incumbent Lois Capps the axis on which media coverage of Cindy Reyna is made to pivot.

I honestly cannot say if Cindy Reyna is being used to energize conservatives opposed to the Dream Act for a big absentee ballot count in favor of a Republican opponent to Representative Capps.

Or if California Democratic Party strategists calculate  Lois Capps earning a net gain in votes by using Cindy Reyna as the wake-up call to dormant progressive student voters at U.C.S.B. and Cal Poly San Luis Obispo.

In fact, it isn't even clear what election Lois Capps is planning to enter as a candidate.

She currently represents California Congressional District 23, but the boundaries have just been redrawn on all the central coast and Central Valley districts.

 Incumbents and challengers, Democrats and Republicans are engaged in musical chairs to find the best seat to challenge for and retain for the next 5 election cycles.

The music hasn't stopped yet - but the needle gets pulled up this Friday. Thats the deadline for candidates who want their name on the California Primary ballot to submit qualifying paperwork. Will Rep.Capps run in CA District 23 or CA District 24?

Whatever seat Lois Capps tries to sit down in, we already know that the arrest and deportation circus over Cindy Reyna is DEM/REP election year sideshow.

Concerned citizen (who supports Reyna and anyone who has been stopped by the police on "suspicion" only). The last decade has seen the erosion of our constitutional/bill or rights and basic human rights.

What information? What empowerment? I just hear more self-serving fluff. What "actual police/official files" are you referring to? "Justice" merely stated "hearsay." What she saw, and not what "WE" know. What are the numbers? What did this young lady blow on the Breathalyzer. That's what the court looks at. Blow .08 and above, and you are legally DUI. The rest of the FST are the lead in to arrest on "suspicion" of DUI. The breath or blood tests are the slam dunk. So what did she blow? That number is a verifiable fact with very little room for "subjective" interpertation. As for probable cause, that's why LE sets up announced DUI checkpoints and "sniffs" around. The strong smell of alcohol, blurry eyes, slurred speech, and the inability to follow simple directions are some indicators that lead to conducting the FST. Based upon the results of a FST, 2 officers, the one conducting the tests and the one observing the testing, decide-- based upon reasonable suspicion and their professional background-- that a law has been broken. They then upgrade a simple detainment into an arrest. They then conduct further testing-- blood or breath-- to substantiate their "subjective" suspicion scientifically-- that is empirically. So what did Chica blow? Any comments "Justice?"

Wow..let me put myself in her shoes for a minute...model, ambitious..educating myself in a country that I am living in without the legal right to be here. Hmm,, I would appreciate each day that goes by smoothing without getting caught always knowing I am a hidden guest and unlawfully here. I get drunk..take the wheel and get caught. NOW i've got to face my reality..in the courts. With a lawyer and friends I might be able to convince a judge I made a mistake...give me a chance..In the end I might have to return to my country and manage another way to get back to the US..legally! 

Truth is humbling...every American citizen pays for their mistakes...so will Cindy...she was on borrowed time. Cindy is young and ambitious..I sure there are options she can take to secure legal status herejust as many other  undocumented people have who have come before her.Suerte Cindy..time to face your consequences.

Deportation:Ok first of all i didn't hear anything about the parents here. It is the Dad responsibility of not getting Cindy a US citizenship either before or after they moved to the U.S. So Dad Blame yourself for this one shame on you for not doing this for your daughter yuckkkk. As to my understand the Dad is & U.S Citizen of this country. As for the DUI she has to pay the piper. To my understand the immigration can't deport Cindy if her Dad is and American she has the right to be here. Hang-in there Cindy.

We ALL make mistakes. The ones who have written bad comments must be so "perfect" in their ignorance, therefore they do not acknowledge the good things this girl has done. I agree that drinking and driving is wrong, but this girl was NOT drunk. I had the chance to meet her and study her case at one of the facilities she was detained and I saw the police report in which she appeared to have had passed the DUI test, however, she had one drink at the end of the night which made the police officers "suspicious" and they took her to jail. Also based on the report, Cindy was pulled over because of a small traffic infraction, the made a STOP and stopped a little over the white line... REALLY?? They made it such a big deal!!! She appeared to do good on the test as well!!! (according to her Public Defender) She still paid for this mistake though.... and putting her in jail because of an ICE hold, is just outrageous and unfair. It is about time to really focus on the issues that matter... in this case: Fairness for all undocumented students who are here to work hard and get an education for a better future, not only for themselves, but also for America!

Normally I'm up for immigrants rights and reforms but its true she broke the law and many have been deported because of dui why should she be the exception anyone else who comes and works hard need the same opportunities and trying to obtain fame from her situtation to get special treatmentisnt fair to all the other students parents or kids who have been through this.. either evryone gets forgiven or no one...

Under Title 8 Section 1325 of the U.S. Code, "Improper Entry by Alien," any citizen of any country other than the United States who:

*Enters or attempts to enter the United States at any time or place other than as designated by immigration officers; or

*Eludes examination or inspection by immigration officers; or

*Attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact;

has committed a federal crime.

Violations are punishable by criminal fines and imprisonment for up to six months. Repeat offenses can bring up to two years in prison. Additional civil fines may be imposed at the discretionof immigration judges, but civil fines do not negate the criminal sanctions or nature of the offense.--------------------

If you are proud to be Welsh or Scottish and someone calls you English, you would correct them. There are so many issues being commented on in this thread that are inaccurate and misguided.  The CHP checkpoint here in Goleta was set up in a way where they claim to have been checking for DUI's but they were only asking for driver's licenses. The CHP checkpoint was set up here with the knowledge that an AB540 Student conference was taking place.  This location was purposefully targeted.  There are plainclothes officers and planted student officers everyday at UCSB that ask those of us who they profile (as potentially unauthorized) to show them identification for no reason other than suspicion.  

The next issue is that these Santa Barbara police officers showed up to our Chicana/o Studies class, practicing intimidation tactics, to search for students who they suspect are unauthorized. How blind does a society have to be in order NOT to see that the politics of immigration are racialized politics? Latinos are being targeted as suspects of unauthorized entry while institutional forces lull and pull migrants to be apart of the unauthorized workforce every single day.  They are scapegoating our populations and our students and this is a complete violation of human rights and the most blatant form of economic hypocrisy this nation is caught up in.

Let me get this straight. The CHP didn't announce this checkpoint as required by state law because they wanted to taint all the DUI arrests when a sharp lawyer filed a "checkpoint suppression" motion in court. Also, there was nowhere to turn around before the checkpoint?-- another violation of state law. So LE shouldn't target areas where intoxicated people travel or frequent. They should put checkpoints in isolated, rural areas with no population. Undercover cops and student "confidential informants/officers?" are systematically targeting and profiling students in classrooms and on campus simply because they "appear" undocumented. And this has not made the news or been contested by the ACLU? Thay also followed Chica and made her drink, and then they forced her to drive on "public" highways endangering all other drivers, bicylists, and pedestrians. Of course, that explains it. Those damn tricky cops!

Of course illegal immigration is political. It's also criminal. Many Americans are opposed to criminals in the USA-- especially criminals who are not citizens-- and they often request that our legislators to address these social issues. the democratic process tends to limit vigalantism and hanging from a tree. Only cheaters hire "undocumented workers," and they are also breaking the law and need to be punished. Honest, law-abiding Americans do not engage in such practices. They are the ones protesting this policy of un-fair competition. Human Rights does not give an individual the right to break the law so as to obtain an education, housing, health care, food, or employment. Based on that logic-- I can steal from you as long as I use the money to buy a house to shelter myself. Speaking of hypocrisy...read your post.

first of all i'm a u.s. citizen and born in korea. deport her immediately. how could she be responsible and caring when she was caught dui. this country is out of control with illegals. yes, illegals, not "undoucumented person". also, we are sending message out that our u.s. students are so dumb that we need to support these illegals to run our country. what happened to our back bone. she should blame her step father not taking care her immigration problem when she was 15. not just her, every illegals should be out. if they have kids that was born here, take them also. let's take care our u.s. children and all the unemployed americans out there.
