Illegal Immigrants Can Now Drive in L.A. Without Fear of Having Cars Taken by Police

In a contentious debate that seemed to pit older, white Los Angeles against the more liberal, browner shade of town and the leaders it elected to City Hall, the L.A. police commission today said illegal immigrants could essentially keep their cars when they're caught driving without a license.

The modified rule will allow unlicensed drivers to avoid 30-day impounds if they have insurance, registration and a valid ID.

Under the 4-1 Police Commission vote, such drivers aren't eligible for the deal if ...

... they've had suspended or revoked licenses or had been caught driving without one previously.

The new rule avoids the mandatory 30-day impound usually imposed on those caught driving unlicensed in L.A. and instead allows a tow and impound for just a day or a few depending the drivers' ability to get their cars out of hawk.

Under the old way, unlicensed drivers often lost their cars because the 30-day impounds -- with towing and storage fees that topped $1,200 -- were too costly and sometimes added up to more than the cars were worth.

Immigrants' rights activists argued that cops were essentially taking the vehicles of those who could least afford this to happen -- undocumented workers who can't legally obtain licenses in California.

Several Latino politicians, including Mayor Antonio Villaraigosa, agreed. And few would doubt that LAPD Chief Charlie Beck, in backing the controversial policy change, was bowing to the mayor.

The L.A. police union has been dead against the rule change, arguing that it puts unsafe drivers back on the road and that it's against state law.

In fact the state Legislative Council issued a memo saying California law mandates a 30-day impound for the unlicensed.

But strangely, the office of conservative L.A. City Attorney Carmen Trutanich backed Villairaigosa and Beck by stating that stopping the 30-day impounds would be fully within the law.

Today the police union (Los Angeles Police Protective League) president Tyler Izen sent the Weekly this statement:

The policy change jeopardizes public safety and welfare, as well as the safety of our officers, exposes the City and its officers to liability. The modification directly conflicts with and undermines the official position taken by the City of Los Angeles in Federal Court.

Wait a second.

If I...a native born and raised Angelino....get pulled over by the cops for not having a license, I can be fined and have my car towed.

But if someone here Illegally does the same, they get a free pass because someone theorizes that the impound and fines 'hurt them'?

Fuck THAT! $1,500 dollars HURTS ME!

What the hell is going on here? God damn I hate Mayor Villaraigosa. How the HELL does he stay in office?

Setting aside your anger and bad language, you have a point. Having your car impounded is a hardship on anyone. The end of this punishment must start somewhere. The cops should not be in the business of punishment or profit. Richard.

The new rule applies to you along with everyone else regardless of skin color or immigration status.  Your first sentence is wrong because this policy does apply to you. So calm the hell down for god's sake.  Everyone's such a damn victim, it really gets annoying.

It is time for a class action lawsuit by ALL of the LEGAL US TAXPAYING CITIZENS, against all foreign and domestic individuals and politicians that continue to jeopardize and have been deteriorating our country.  There are laws for a reason, they are not to accommodate any one ethnicity, class, religious affiliation, or cultural diversity.  They are there to protect the LEGAL US TAXPAYING CITIZENS, and if our state and federal representatives and the President of this once great nation will not step forward and do the job they were hired to do, then they need to reimburse the LEGAL US TAXPAYING CITIZENS all monies that have been misappropriated to benefit LAWBREAKERS and everyone of them from the top to the bottom need to be fired.  This is a GREAT NATION, but it is in decline, WAKE THE HECK UP AMERICA!   Let’s find a Lawyer worth his salt, call in the Gray Haired Brigade and let’s give them a lawsuit that cannot be ignored!  I served this country proudly for almost 25 years, now let those we elected serve ALL of us the LEGAL US TAXPAYING CITIZENS for a change!  NO ONE SHOULD BENEFIT FROM BREAKING THE LAW!

This is the first time I've heard it mentioned that the change to the law, "will allow unlicensed drivers to avoid 30-day impounds if they have insurance, registration and a valid ID."

The odds that unlicensed drivers are going to have all these ducks in a row is pretty slim if you ask me.  Maybe 10% of those caught driving without a license might be rolling around in their tia's properly registered and insured whip - but will they also have a valid ID?   So what this really means is that TonyToneToni has done it again.  He's thrown a bone to his base without actually upsetting the LAPD apple-cart/revenue stream.  That's hot shit Tony - pretty good for a guy who couldn't pass the bar.

Let the impounding begin.... erm... I mean continue!!!

To say that others must be racist because their views are different from yours; is by definition the opposite of what America stands for - (Totalitarian Communism) . I support the taxpayers who are NOT in favor of this proposal. As the son of legal immigrants, I am insulted by those who believe breaking the law should have its rewards, while law abiding citizens should face punishment. I support a total impeachment of those who wish to destroy the sovereignty of this country. Those who are impeached should lose everything including their careers. Let them go beg in the streets with the unemployed and ask for compassion and mercy from the people who they cheated. Politicians today are in denial of what is going on around them.

This should be great news for all legal and U.S. residents also - there is no reason for anyone in LA to renew your drivers licenses as the police can no longer impound your cars - this will save huge dollars to all of you not having to obtain drivers licenses - LA police can't just apply the law illegal immigrants otherwise it is DISCRIMINATION - so, legal and U.S. residents in LA - dispense of your drivers licenses - will be interesting to read about the first discrimination law suit from a legal U.S. resident against the police for impounding their car - it'll be a definite win for the first discrimination lawsuit against legal U.S. residents.

Lame ass posters. They still get fined, just not the 30-day impound. Steve Cooley ain't God, it's just his opinion and laws can be changed or created/ The people on the street know that there is biased targeting going on, harassing and trying to bank low income people who are struggling to get by. If they wanna meet their quotas how bout going to Beverly Hills, Santa Monica, and such areas and crack the well to do whiteys for all their cell phone yapping and too-close-for-comfort pedestrian crashes.. they would make a killing.

Lol! I agree 100%. Those racist ass cops, do target immigrants on a daily bases. I see it everyday on my way to work. I work on the Westside and almost like clockwork, i see bike cops pulling over and towing clunkers being driven by Latinos. In the five years driving the same route, i have never seen a Mercedes or a nice car being towed. I think the Governor need to past the law to issue them driver’s license, so to separate out the bad drivers from the good drivers.

On your next drive to the westside, keep driving into the Pacific ocean.  Most reasons for towing "latino clunkers" are because of mechanical disfunctions of the vehicle. A condition similar to your brain disfunction. 

Most "nice" cars are well maintained and have fuel in their tanks.  Could this be why you fail to see so few "nice" cars being towed.  A good driver is a responsible driver which includes a legal drivers licence, insurance and driving a vehicle that meets all safety requirements to be on the road.  Most "latino clunkers" don't fall into this category.

If you take Sunset Blvd. west, you will see the ocean.  Find a peir and then jump off. Leave your keys in your car, an illegal alien will be along soon to drive it away.

People that drive Mercedes, or nice cars, do it legally by obtaining a license to drive and it's the LAW (if you can't get one because you're not in this country legally - then go back to where you came from and do it legally). People that drive Mercedes and nice cars have insurance too, because, it's the LAW.

This is reverse racial profiling at it's finest.

And one more thing...do you know that a cop can impound your car for up to 30 days if he pulls you over for speeding - you're guilty before you're proven innocent?  I know for sure on this...my son lost his vehicle to impound for 30 days at a cost of $1950- it was not wreckless driving either - it was 55mph in a 40 mph - went to court with the ticket and all charges were dropped...except he still had to pay the impound fees.

What the hell has happened to the Golden State..it's only golden if you are a minority and you break the law.

My ancestors wanted to be Americans, not what I see today with illegals. Thinking like this, no concern about law or respect to this country will lead to a civil war. It is illegals who wsnt want want, with unlimited.freebies, ER as their doctors office and multiple identities. We're toast as a state and as a nation. And people who are citizens commit more traffic violations than those who are here illegally. Cops don't target Hispanics , whites, blacks nor Asians . Cops target those drivers who violate the law. Cops are color blind and if they do target a particular type of ethnic group then they can kiss their badge good bye. There is 0 tolerance for racism in a police dept . Illegals don't hurt anyone. They came here with hope and to make a better living. .. My god you people forget that most of our ancestors came here illegally. This is what America is about to give opportunity to people from other nations not just the natives. Even at that most of us aren't even "natives" don't you people ever forget that. Totally wrong.  If I get caught without my license on the road I pay a heavy fine here.And lo and behold, I am a citizen.  Screw this. They are here illegally, driving illegally, whats next?

Dennis, Dennis, Dennis, I would thought you were so much better then other reporters but you're spinning.  Why didn't you include STeve Cooley, DA letter stating that this is a bad idea.  He states the City is at risk for liability if this impound is changed. L.A. County District Attorney Steve Cooley now says LAPD Chief Charlie Beck's plan to go easier on unlicensed drivers may be "contrary to state law."

He has sent a letter to Beck and other police chiefs warning them that it would be a bad idea to change the rules on impounds.District Attorney Steve Cooley wrote, "In our view, such policies are contrary to state law and likely would create risks both to public safety and to public treasuries."

this is ridiculous! not because of the illegal immigration issue, but that the fact that laws are now only applicable to those who can 'afford' to pay the consequences.
