Why Porn Stars Won't Be Using Condoms, Despite City Law's Debut Today

Condoms are coming to porn shoots in Los Angeles today.

Well, that's the theory, anyway.

A Los Angeles city ordinance that requires condom use at on-location adult video shoots within the city is the law starting today.

But like a lot of things coming from City Hall ...


... it's so-far a law with, er, no teeth.

That's right, even though today is the day porn stars are supposed to be using condoms, there's still no enforcement, uh, tool.

In fact, porn stars are already supposed to be using condoms on-location and everywhere else in the state of California. State workplace safety authorities require it. They just don't enforce it too much.

We can't expect much different from City Hall. The LAPD's not about to be patting down porn stars.

The L.A. City Council was wise, however when, instead of spending money to put an initiative on the city ballot that would have asked you to vote yes or no on condoms in porn, it decided to pass the law itself.

That saved you the $4 million it would have cost to get the AIDS Healthcare Foundation's initiative, for which it obtained enough signatures, on the ballot.

But ... the city is still working on how it would be enforced.

The City Council convened a "working group" to figure out how to make porn stars use these things. The rule is tied to on-location porn permits issued by the city. But, as you well know, a lot of adult video is shot without permits.

The adult video industry says consumers won't buy condom porn, that its own STD testing protocols are effective, and that the business will move out of state if this rule is actually enforced.

Like a lot of things in L.A., that remains to be seen. (The city has battled to regulate marijuana dispensaries in town, but while some have been shut down, dozens if not hundreds of outlaws remain).

On the flip side, the multi-billion-dollar industry's threats to move out of state have been all bark so far. And California is one of very few states where you can legally pay people to have sex ... on-camera.

Nonetheless, props to both sides for, er, sticking it out.

The AIDS Healthcare Foundation has been trying to get mandatory condoms in porn for years and it now working on a countywide voter initiative. The AHF casts the issue as a matter of life and death.

The group is hailing this, the first day of mandatory condoms in L.A.'s on-location porn, as "historic."

The cost of adding the ballot issue to the June primary, at $4 million dollars is likely an exaggeration and cover for an anti-democratic, authoritarian act. Democracy is somewhat expensive, but the alternative is unacceptable to most Americans.

Consider the resolution of OccupyVenice before this decision: "While not taking a specific position on the issue currently before the City Council - the Venice General Assembly unequivocally disapproves of any attempt of any governmental body to take away our right to ballot initiatives - and rather than moving in the direction of eliminating them, we need to encourage more ballot-based democracy in the City of Los Angeles"This move simply shifts the costs supposedly saved on printing ballots to the courts and perhaps police or public health officials who might be compelled by AHF to try to enforce the undemocratically-instituted measure. Perhaps the LA City Council decided to do his for political reasons, to deny cultural conservatives a reason to turn out and demonstrate strength in the June primary, and boost any particular GOP favorite who might impose more censorship of sex in entertainment. Will AHF ultimately compel steamy scenes in mainstream films produced in LA to show use of safe sex, discussions, testing and condoms?

It's really cute how all of you people keep mention the 4 million price tag to put this on the ballot. Yet, none of you mention the healthcare costs when these morons get every communicable disease under the sun and then go to a public hospital. Get this into law and get this scumy industry out! La will save money in the long run

Why should this be an issue, if you know someone is in porn and is susceptible to diseases and viruses, then it is your job to either say yes or no to sex, which spreads diseases. We can only pray that the cure will become available to everyone soon because believe me, they already have a cure. Condoms aren't going to solve the disease dilemma and are a waste of money to enforce. And this late into the industry, it is a tad too late to be taking any new laws and expect industry to follow suit?

 Good thing that $4 million was put into waste. I agree this will be 'historic' if this comes into approval on the legislation. I think this action is not a big loss for the porn movie producers. Hence, they just add some spice on their show.

LA politicians and bureaucrats have no clue how to fix the real problems, so they find distractions and scapegoats. According to the CDC there's 16,000 people walking around LA county with HIV who don't know it -- because they don't get tested (unlike adult film performers who test every 28 days or less).

The solution to offered by LA? Persecute a legal industry that actually does a great job of disease mitigation and prevention (there has not been an on-set transmission of HIV in LA's porn industry since 2004).

That's LA for you -- actually, most of California.
