Federal Judge Slaps Back Dino M. Zaffina in Darts Trademark Battle

Dino M. Zaffina: A U.S. District Judge has barred him from using trademarks or a website for the Southern California Darts Association.

Remember Dino M. Zaffina? The studio sound man was a new(ish) member of the Southern California Darts Association in 2010 when he became angry that his middle initial was not included when players' scores were listed on the association's web site.

As L.A. Weekly Staff Writer Chris Vogel detailed in a Feb. 2 cover story, Zaffina subsequently learned that the 33-year-old association had allowed its incorporation to lapse. Zaffina promptly incorporated under the name and sued "60 darts players and eight stunned Los Angeles-area bars where darts are played regularly," as Vogel reported, for "using the historic name 'Southern California Darts Association,' which Zaffina now legally controlled." He also put up a website under the name and began issuing press releases touting his ownership.

When last we checked in, things weren't going well for the band of darts players formerly known as the Southern California Darts Association. They'd filed a cross complaint in an effort to stop Zaffina, but the judge struck it down. Zaffina had also snapped up rights to the new name that they'd contemplating incorporating under.

That was then. But on Monday, U.S. District Judge R. Gary Klausner issued an injunction that changes the game significantly.


On March 6, the darts players had filed suit in federal court, alleging that Zaffina had violated trademark law and engaged in unfair competition. They filed a motion for a preliminary injunction, asking the judge to stop Zaffina from using their name and their trademarks.

In a nine-page order issued Monday, Judge Klausner granted that motion. In the order, Klausner found that the darts players had a valid, protectable trademark -- and that Zaffina had intentionally copied it "precisely because of [its] reputation." He wrote that the darts players were likely to suffer irreparable harm if Zaffina was not stopped from using the trademark.

Ultimately, a judge must find that a preliminary injunction is in the public interest. Here's what Judge Klausner wrote about that:

Defendants [meaning Zaffina and the entity he incorporated] concede that they are second-comers to the marketplace intentionally trying to trade upon the efforts and goodwill established by Plaintiff. ... Plaintiff has demonstrated that an injunction is in the public interest. Plaintiff has shown that it has spent considerable time, energy, and money to have the public associate its services with the name Southern California Darts Association. By using confusingly similar marks, Defendants are depriving darts enthusiasts of their ability to distinguish among the services of Plaintiff and those of Defendants. As the public has a right not to be confused, the public interest and goals of the [federal trademark law] favor an injunction in this case.

So what does this mean?

While the litigation continues, Zaffina is not allowed to use the darts association trademark. He is not permitted to use any website or URL containing the words "Southern California Darts Association" (although the website Zaffina erected appears to be live as of this morning). Finally, he is not permitted to represent to the public -- including the pubs that host darts -- that he has a right to the darts association name.

Zaffina did not respond to our request for comment yesterday; we'll update this post if we hear back.

However, it's interesting to look back at a press release Zaffina issued on March 28, soon after the darts players filed the federal suit and asked the judge for an injunction.

The release claims that the lawsuit will be good for Zaffina and his association on "many levels." It continues,

An honorable federal judge with an exorbitant amount of experience on the bench, in general, and in hearing matters related to intellectual property, will examine the facts and evidence and will reach a decision.

After the Court takes into consideration all the facts and evidence in [the darts players]'s motion, and in SCDA and Zaffina's opposing papers, and after hearing oral arguments, the ruling will be made public. This will provide the conclusory vitriol spewing individuals with something concrete to assist them in forming an opinion.

In many ways, Zaffina's prediction appears to be correct. An honorable federal judge with "an exorbitant amount of experience" examined the facts. He reached a (preliminary) decision. And that decision has now been made public.

Call us crazy, but we somehow suspect, in spite of the accuracy of those predictions, that this is not precisely the ruling Dino M. Zaffina had hoped for. Perhaps an upcoming press release will set us straight -- but it's safe to say that press release will not be on the Southern California Darts Association letterhead.

There is no doubt that Dino has disturbed many dart players and been a public nuisance, but I do believe the man is sick "Borderline Personality Disorder" he should be locked up in a Psych ward were he will be protected from himself and from causing more harm.  Ultimately that would be best for everyone concerned, including himself and it would save us tax payers some money.

Hmmm, so what does Mr. Zafrano do for a living that he can afford lawyers to sue darts players?  I hope this ends up costing him more than he ever intended.

Dino went to law school but didn't have the brains to pass the bar exam. This, in spite of what he will tell you, made him very angry. He works for a lawyer (the same one who signs all of his lawsuits) and gets help there. Presumably for "special" services rendered. I'd really like to think that this will make him go away, but since he's really pissed off now, he may redouble his efforts. Let's hope he does something smart for a change and goes away. Currently, there are two dart leagues that don't want him, so the rest of you better look out!

Judging from what we've read about Dino's personality, he WILL redouble his efforts. This is a major threat to his over-inflated self-esteem, seemingly bordering on narcissism, and as such he must protect his psychological schema and fight back harder. If he doesn't win next time, he'll probably sue the judge. Men and women like this are psychologically too fragile to handle what they perceive as a major personal slight - and perception is the key. What the rest of us might see as a minor annoyance, they take as a personal attack on themselves. Their self-esteem is like a house of cards - it looks solid enough from a distance, but when you get close enough you see how fragile it really is. To him, this has not been about darts for some time.

I know that, chances are, you weren't being literal (seeing as though the established language of the internet is hyberbole), but I don't think it's full-blown psychosis at all. His actions are textbook for a compensatory cerebral narcissist. Look at Dino's imdb page and notice that his height is 4'2"; most guys like this compensate for their perceived physical inadequacies by making themselves out to be the "smartest guy in the room" - or at least, in their own minds. Look at some of the things he has done and how they match up pretty much perfectly with the diagnostic criteria for narcissistic personality disorder:1. He blows up about something as stupid as them forgetting his middle initial   - From the DSM IV:  "has a grandiose sense of self-importance"; "has a sense of entitlement, i.e., unreasonable expectations of especially favorable treatment or automatic compliance with his or her expectations"2. He becomes so insufferable about it that the other players say "you know what? gtfo." Rather than cut his losses and find a new dart league, Dino proceeds to do all sorts of research into public records in order to find SOME weakness in the SCDA and finds it in a legal loophole, then proceeds to stick it to 'em.   - From the DSM IV: "believes that he or she is "special" and unique and can only be understood by, or should associate with, other special or high-status people (or institutions)"; "lacks empathy: is unwilling to recognize or identify with the feelings and needs of others"; "requires excessive admiration" - also known as narcissistic supply. In some cases, the narcissist in question is a d-bag and cannot GET admiration, in which case they tend to settle for being notorious, infamous, or outright feared. If he can't be Dino M. Zaffina "the coolest guy ever who we should all worship", he'll go with Dino M. Zaffina "the guy who single-handedly ruined darts for southern California and he'll do it again, so don't f**k with him." Either way, as long as you KNOW the name Dino M. Zaffina, he's got his narcissistic supply and he's happy.3. When the judge actually does side with the players, Dino proceeds to put up public notices about how silly the decision was and how he's so sure it's only "temporary."   - From the DSM IV: "has a sense of entitlement, i.e., unreasonable expectations of especially favorable treatment or automatic compliance with his or her expectations"

Now, if/when the SCDA members win, Dino will not be happy with any of this. He will sue the judge or try to get him thrown off the bench - after all, anyone who does not side with Dino is clearly WRONG and should be punished, right? He will also continue to pester the members with frivolous lawsuits and/or possibly start outright defaming everyone involved, because otherwise it would be like admitting that there was a possibility that Dino was NOT right in this case, which cannot happen. See the main difference between a classical narcissist and a compensatory narcissist is that the former fully believes in his own perfection to the point of delusion, whereas a compensatory narcissist is someone who suffers from deep-seated low self-esteem and in order to cope with this has to aggressively counter those beliefs, which he most likely doesn't even realize are at the heart of his behavior. A compensatory narcissist would rather admit to being a classical narcissist before risking admitting that those over-reactionary behaviors at the slightest perceived insult are actually the result of fear that that perceived insult might actually be correct.

tl;dr - Yeah, he's just a textbook narcissist.

This story has always stuck me as a kid getting his feelings hurt and deciding to take his ball and go home.  The smash and grab on the corporate name and the legal maneuvers were part f the same emotional neediness.  Not only do I hope the legal case is resolved in the obvious manner it should I would hope Dino could get the help he clearly needs.
