Porn Producers Drugged, Raped, Filmed Woman, She Says in $10 Mil L.A. Suit

A woman claims two men drugged, raped and filmed her. And now she's suing the L.A.-based parent company of a website called Model Mayhem, where the woman claims she met the pair.

The lawsuit, sent to the Weekly by the victim's SoCal-based attorney, Kevin McGuire, was filed in L.A. federal court Friday, he told us.

It seeks $10 million in damages:


Rather than being a site where porn stars hook up with producers -- there is such a thing -- Model Mayhem seems to be a place for amateur and semi-pro models / crazy chicks and the creepy male "photographers" who love them.

Model Mayhem has more than 664,000 women who have posted profiles.

Perfectly normal. Except: The suit alleges that this particular pair of photogs, Emerson Callum and Lavont Flanders, were predators who had done this sort of thing before.

In February they received life in prison for their drugging, raping and filming scheme.

However, the victim's experience is claimed to have happened a year earlier, in February, 2011. So did Model Mayhem know these two were doing this sort of thing?

The lawsuit claims that it, and its El Segundo-based parent, Internet Brands (home of carsdirect.com, Bargainist, and nursingjobs.org), did know, by August of 2010, that these two had been accused of doing this sort of thing.

Fed Complaint

In fact, it argues, the parent company sued the brothers it bought the site from for allegedly failing to warn it that Model Mayhem comprised alleged trolling grounds for potential rapists.

One website, The True Experiences From Model Mayhem, claims:

The downfall behind it is the fact that perverts dwell among the photographers who in turn go after models and threaten their security. Since ModelMayhem allows nudity, many models display nude shots, much like DeviantArt.com.

In the case of this suit's victim, who was identified only as Jane Doe, the suit claims that she was drugged with alcohol and benzodiazepine (the key ingredient in Xanax, Valium, Halcion and other muscle relaxants) and raped her on camera for a porn film they would later sell.

According to the suit (warning, graphic language):

The next morning, Jane Doe woke up in her hotel room feeling disoriented, sick and confused. Jane Doe then noticed that her mouth was swollen and that there was blood in her vaginal area and anal area, as well as blood in the bathtub ...

It claims that the pair were "disguised as talent scouts," set up "fake auditions," and dangled a "fraudulent modeling contract opportunity."

The suit says the woman's rape happened in South Florida.

And if you think this could be a get-rich-quick scheme, note that the victim went to a hospital and notified police ASAP.

We called Internet Brands to get its side of the story but had yet to hear back.

The kind of person who would "model" for a site like this is the same kind of person who would file a phony rape complaint if turned down for a job, sex, or other.

A 'get-rich-quick' scheme? Really? Yes, once she's recovered from the swelling and bleeding in her anus and vagina and, you know, the pyschological scars and all, I'm sure she'll be laughing all the way to the bank.

I don't understand why you would pander to vile misogyny by even suggesting that. You don't have to report the allegations as fact, but this is going to the other extreme.

Pretend Internet journalism fail. This blog post is full of factual errors. Putting "in fact", in front of something does not, in fact, make it fact. Donald and Tyler Waitt are not brothers. They are father and son. Show me a court filing where Internet Brands "sued the brothers it bought the site from for allegedly failing to warn it that Model Mayhem comprised alleged trolling grounds for potential rapists."

not all is incorrect. and I can readily show you where IB sued the Waitts long before this model was contacted by these sexual predators. they had previous knowledge of these guys. you can't have it both ways Pat. they avoided paying the Waitts due to the potential upcoming lawsuits. they sure as hell can't now claim not to have this knowledge. it's in the public court records and MM/IB is gonna be on the hook for a large upcoming payout. mark my words., this suit has teeth!

Whether the suit has teeth will be determined in court, not in blog comments. My comment does not speak to the merits of the suit at all. I take issue with 2 points. The Waitts are not brothers and "sued the brothers it bought the site from for allegedly failing to warn it that Model Mayhem comprised alleged trolling grounds for potential rapists." is not fact because that statement does not appear in IB's suit at all. It is the author's embellishment presented as fact by placing the phrase "in fact" in front of it.

Don and Tyler are, in fact, father and son.

The suit, however, is correct. When Don and Tyler sued Internet Brands for non-payment, Internet Brands countersued on the failure to warn.

The error in this story is in Don and Tyler's relation. That's all.

"The charges against Flanders and his alleged use of the website to lure his victims to the warehouse, as well as the contentions made by his victims with regard to his use of the website, were all known by counter-defendants in July, 8 2007, nearly one (1) year before they entered into the Agreement." 

This is opinion presented as fact because it is embellishment by the author. "sued the brothers it bought the site from for allegedly failing to warn it that Model Mayhem comprised alleged trolling grounds for potential rapists."

This is also opinion presented as fact because I just made it up. "In fact, Internet Brands sued the Waitts for using the font Augie as it's logo, a font that is particularly irresistible to child molesters, rapists, and human traffickers."
