Marijuana Dispensary Ban Considered at L.A. City Hall Tomorrow

Hope you're getting your rest this holiday weekend.

Because tomorrow's a big day for the medical marijuana scene in Los Angeles. The L.A. City Council's Planning and Land Use Management (PLUM) committee will take up all facets of proposed bans on medical cannabis in town.

A complete obliteration of Los Angeles' famous and numerous pot shops is on the table. There are two options that the committee will consider for its endorsement:


1). Imposing a "gentle ban" limited ban (PDF) proposed by city Councilman Paul Koretz. According his language it's a ...

... more reasonable approach to compliance could include a limited immunity approach whereby the City proceeds forward with a ban on dispensaries but uses its prosecutorial discretion to abstain from any enforcement action against the limited number of dispensaries that do not violate a set of City Council imposed restrictions. This approach would protect neighborhoods while still assuring limited safe access for patients within the confines of ever evolving case law.

Seems that it remains to be seen how the survivors would be chosen.

2). Banning all dispensaries until California Supreme Court weighs in on a Long Beach case (Pack v. City of Long Beach) that prohibited that city from regulating pot shops in a way that's being done in L.A. too (PDF).

In any case, a medical marijuana advocate told the Weekly over the weekend to expect "fireworks" at the PLUM committee meeting.

Pot supporters will be out in force.

The meeting starts at 2:30 p.m. tomorrow at City Hall's Board of Public Works Roybal Hearing Room (Room 350), 200 N. Spring St. Info (PDF).

[Update at 6 p.m.]: The committee approved both avenues, which will go to the Public Safety Committee Friday before heading to the full council, according to City News Service.

According to City News:

[Councilman Jose] Huizar and fellow committee members Ed Reyes and Mitch Englander also disapproved of a separate plan that would have the city refrain from prosecuting a set of about 100 dispensaries that follow strict restrictions on where they could operate, the hours they could be open, and requirements for tight security.

Interesting.

Strangely, they're calling Huizar's more draconian proposal a "gentle ban" because, while outlawing dispensaries, it would, according to City News ...

... allow mini-collectives of three or fewer patients to jointly grow their own marijuana at one location and would allow patients to transport cannabis.

Mkay.

Guess Koretz's proposal is the gentler ban.

[Added at 11:50 p.m.]: The Los Angeles Times says a "counterproposal" backed by Councilman Bill Rosendahl that would give a reprieve to 100 dispensaries -- a move reminiscent of earlier attempts to outlaw all but 100 pot shops -- was also approved but that key council members weren't giving it much hope.

After listening to Huizar on the radio yesterday, I have left absolutely no doubt that Mr. Huizar is in cahoots with the Mexican drug cartels.  The amount of "Reefer Madness" non-facts, disinformation, and propaganda he spewed made me realize that he is in fact working with the Mexican drug cartels.  This man should be thrown in jail.

You know what would be great.  If we just let the free market bear how many dispensaries the public wants or needs, like we do with most businesses, and the chips will fall into place from there.  I keep seeing people compare marijuana dispensaries to Starbucks, not a fair comparison at all.  It would be more fair compare how many places sell coffee to how many places sell medical marijuana.  The number of businesses that either sell, give away, or supply their employees with coffee are in the tens of thousands in this city alone, if not in the hundreds of thousands.  

Or how about alcohol, it is also in thousands of places around our city.  The free market will bear the weight of how many people either want or need.  Until they can identify a real problem associated with the dispensaries, which they can not, why do they spend so much time trying to regulate them?  I call, you are bluffing, nuff said.

I guess you missed the committee meeting yesterday where CM Englander revealed a list of reported crimes, complaints, and arrests associated with just the stores in his district which was pretty compelling. I'd say that "real" problems have been identified.

Not to mention that it seems to me to always be the pot advocates such as ASA and GLACA that are demanding strict regulation. It's only folks like you associated with post ICO stores that have a problem with regulation.

In my opinion, ASA and GLACA are involved in a racket.  The whole post ICO, pre ICO crap was just a way to separate and divide people amongst themselves.  

I am surely pre-ico, my first collective was in 2005 but that doesn't concern me at this point.  What does concern me is the amount of attention our city council uses in enforcing morals through legislation.  

People aren't concerned with regulating a benign and benevolent substance such as cannabis, they are concerned with the 17 billion that our state is in the hole from the over regulation and reactionary politics.

Jose Huizar is being disingenuous with his proposed ban. Patients have always had the right to grow their own medicine, but many who need their medicine the most are the least capable of doing so.

There is a horrible drug war in Mexico and the reason why the drug cartels are holding their ground with so much force is because they get millions upon millions of dollars from US consumers. Close the dispensaries and the cartels are going to get richer. Unless that's what the US actually wants.... Maybe so, the US will do anything hinder a Latin American coutry's development. More money for the cartels means more US made guns sold to the cartels.... Just saying...  Stop wasting money on this type of BS and pump it into education.

Hard working mom and pop operators. Many collectives grow their own and have patients from Northern California who supply them with extra medicine.

 For cartel grows, forest animals, trees and plants also die from water diversion all to supply are lungs with smoke. Just grow your own or have a goodbud grow it for you. You won't be monetarily contributing to any devastation caused by the "other" source even if you can't see where the pot is coming from. But lets not be blind on purpose.This way u won't haveto 2nd guess and you will sleep much better no doubt.

 Cartels also grow in the National forests in Cali and thrash the land and kill animals with the pesticides that are eaten allto grow high grade pot. Yes high grade. They adjusted to are needssomewhat but in a very morally wrong way to supply some Mexican gang,cartel and mafia run dispensaries.   I smoke but never from a pot shop cause I will not contribute my money to any entity that ravages the beautiful forests and animals. Many that frequent the pot shops don't no or care about the repercussion of the aftermath.

I do not see this happening as the shops have been lied too. If you remember Mr. Trutanich promised to work with the collectives before he got into office and as soon as he was elected, he attempted to create an ordinance that was doomed to failure. Most of the shops I have visited are doing things the right way. Maybe you have not been visiting the right shops.

It's impossible to prove because the pot shops have blocked all attempts to regulate which would make all of this information easily attainable. If they are all on the up and up as you and Joyce claim, how about a little sunshine? Make public all records of the shops including sales tax reports, origins of all "medicine", and criminal backgrounds of all operators. That would go a long way to help alleviate the public perception of the stores.

 Your right! I meant to say 3-4 pot shops on every "major" block and this is NOT exaggerated. Count 5 shops on 1 single block on Vineland Ave. between Victory & Oxnard streets.  You don't see 5 CVS's. liquor stores,etc...on that one block but you do see 5 pot shops. Total overkill and this is the normon ALL the major streets in the SFV. Inside of 3 of the 5 shops on Vineland Ave.they never asked me to show them a doctors rec and let me in the shops with no ID whatsoever. It's a total and complete free for all and they will sell to anybody and their mother if you have some cash and no doctors recommendation. 100% fact!

Let me see if I can explain it to you.  I live a block away from multiple dispensaries in a lovely hillside town called Eagle Rock.  With my home perched higher on the hill, I can see the so called "patients" leave the dispensaries, smoking in their car, running the stop sign on my corner and throwing their trash on my sidewalk as they leave.  Did I mention we have plenty of children in our neighborhood who play outside on their bikes and skates, and plenty of jogger and people walking their dogs?  I'm sure they all really appreciate these dispensaries and the "patients" they have attracted.

The difference is it is done in a controlled environment where people under 18 do not have access without a parent or legal guardian present.  Taxes are being paid and empty commercial spaces are being filled.  Business licenses are purchased, insurance, health care, security, advertisers and many more businesses are supported by this being legitimate and not being a street deal, as you say.

Can you tell me of one street dealer that pays workers comp insurance for their employees?  Do you understand the socioeconomic effect that driving this back to black market will so negatively have on our communities?  We are in a major budget crisis.  People are having trouble making ends meet.  Landlords, tenants, banks, it's hard on everyone right now.  Forcing this back to the streets will create the same environment as when alcohol was made illegal with the 18th amendment.  Is that what you want, Mr.Larsen?

Embezzlement business? Isn't that just called standard business? Lawl, kidding.

Firstly, there is nothing wrong with prostitution (you get what you pay for and call sell whatever is yours), gambling (same philosophy) or weed (c'mon, the hypocrisy is killing me). Alcohol and cigarettes are scientifically proven to be more damaging and addictive than marijuana, so if you in any way support the legality of those two drugs, then you support weed, logically, and I will not listen to you as you mumble ignorant nothings to yourself. 

As for embezzlement business: you're confused, and the United States wouldn't have all these issues with its sociopolitical economics if it wasn't a brazen beacon of lies and greed itself. "Embezzlement business" is the only thing you listed that isn't morally acceptable.
