No Smoking in Your Own Apartment? Santa Monica Moves Toward Such a Ban

Please explain to us how L.A.'s own version of Berkeley, a town once ruled by ultra-lefty Tom Hayden and his band of merry pranksters called Santa Monicans for Renters Rights, has turned into an Amish village where the local government is up your arse with just about everything you do there?

It was a bit of a culture shock to see the city by the sea outlaw smoking on balconies at multi-unit complexes in 2010.

Now the Santa Monica City Council is banning smoking INSIDE your own apartment. Really:


They used to call it the Republic of Santa Monica, in an exaggeration of the town's liberal leanings. Santa Monicans for Renters Rights was about holding down rent and checking development.

How far the city has come. Now it's a nanny state, plain and simple.

The City Council last night voted to outlaw smoking in new apartments and convert those that have been vacated into non-smoking units too. Here's the crux of the ordinance:

... It would deem the units of all new occupancies as non-smoking, including those previously designated smoking that had been vacated.

Not only that, but current apartment and condo owners would have to make all their units smoking or non-smoking and post signs warning as much.

The council went beyond those staff recommendations for the law, however, and demanded a "drop-dead date" for the conversion of all units in the city to non-smoking, reports the Santa Monica Daily Press.

The vote was preliminary, and a final decision will have to be made at a future meeting. But it looks like this is going to happen, so inhale while you can.

Please enact this in West Hollywood!! I come home to my own condo smelling like stale smoke so I have to keep my patio doors open and the fan on at all times just to help it dissipate. I often wake up with itching eyes and a burning throat thanks to the smoker who insists on smoking inside downstairs from me. It's disgusting.

Having lived in an apartment where there were smokers around me, it was pretty unpleasant. I don't think they should ban it but maybe give landlords the right to say you can't smoke on your balcony or leaning out of your windows, to minimize the impact on those around you.

Good!!!! I lived in an Apartment with a Smoker downstairs from my apartment and the Smoke would come up my apartment through the walls and my baby would cough all day and night because of it-

Complex issue. I agree that it should be left to the property owners and resident committees. If you own the apartment and end up renting it to a cancer binging chain smoker you may very well end up with a stink in the walls and ceiling that would require total renovation. You can try to imagine the other numerous unpleasant variables on your own - I'm giving your intelligence the benefit of the doubt. Hopefully you won't disappoint me.

Second hand smoke gets through apartment vents. There is nothing "Nazi" about having the right to breathe clean air. On the other hand forcing people to breathe second hand smoke is very fascistic.

I believe it should be left up to the property owners. However due to health concerns it should be disclosed on a lease that the building is Smokier Friendly indoors and or out.

Listening to SM City Council on NPR months ago, you could tell City Officials really didn't care about what the people wanted. The city continued to use examples based upon studies involving second hand smoke and children's health. Santa Monica is a very restrictive place to live, you can't even smoke in public without someone giving you the "eye". Not to mention that everyone seems to "encourage" vegetarianism. So, they're finally gonna do it, huh? Wow. This is Nazi propaganda right here, right now, in Southern California.

what you don't seem to understand is that other peoples smoke comes in through the vents and windows, open or closed, to adjoining apts and there's no escaping it, my apt is inundated with 2nd hand smoke every night at 11pm, where's my right to not be subjected to other peoples deadly habits?? you want to be inhaling and suffocating on smoke coming out of someone else's body, that's your choice, my choice is not to...what if your baby, kids, parents, family were inhaling it would you be ok with that?? enough with the knee-jerk reactions, think before you speak

If your neghbors complain about your smoking it's because they can smell/inhale it. They shouldn't have to inhale your second-hand smoke. It's your choice to kill your lungs but nobody else should have to do the same because you chose to do so!

I am against smoking as a personal choice and I think in restaurants and certain bars/clubs it should be banned as well, but what a person does in the privacy of their own home is sacred. No....but should the tenant move out, the landlord should keep the entire deposit. Trying to rid the apartment of cigarette stench will be costly.

Absolutely. It's rented property, and properties with smokers tend to require a new paintjob and carpeting when the current tenant leaves. Additionally, its a nuisance for tenants living above and often around the smoker.
