Carmen Trutanich Blames Opponent Mike Feuer For Failure of L.A.'s Medical Marijuana Ban

City Attorney Carmen Trutanich has been pushing for a "gentle ban" on marijuana dispensaries all year. So when the L.A. City Council backed down under threat of a referendum and repealed the ban earlier this week, it came as a pretty staggering defeat.

Trutanich has had a few days to think about it, and he's figured out who is to blame: Assemblyman Mike Feuer, who is campaigning to unseat Trutanich in March.

"Los Angeles faces a land-use and a public safety mess because Sacramento politicians like Feuer have failed to act decisively to solve our state's medical marijuana dilemma," said Rick Taylor, Trutanich's campaign strategist, in a statement.

This marks the first time that the Trutanich campaign has directly attacked his well-funded challenger.

Feuer's campaign shot back with a statement of its own: "Mr. Trutanich seems content to cast blame on everyone except himself for his failed leadership as City Attorney," said Feuer spokesman Dave Jacobson.

Trutanich has committed 20 deputy city attorneys to work on medical marijuana issues, with relatively little to show for it. His efforts to prosecute dispensary owners ended in failure, and L.A. is no closer to a workable regulatory regime than it was when Trutanich took office three years ago.

Trutanich pushed for the ban when his earlier attempts at regulation failed in court. But the ban failed in the court of public opinion. Marijuana advocates gathered enough signatures to put the measure on the March ballot. Rather than see voters overturn the measure, the council members calculated that it would be best to do it themselves.

"Trutanich has tried to behave like a bully and shut 'em all down, instead of coming up with a common-sense solution we can all agree on," said John Thomas, campaign manager for Greg Smith, who is also running against Trutanich in March. "The failure rests solely on his shoulders."

When it repealed the ban this week, the council also pleaded with Sacramento lawmakers to clarify the state law around marijuana dispensaries.

"That is a stirring indictment of the incredible lack of leadership on this issue by Sacramento politicians like Feuer," said Taylor, Trutanich's strategist.

Feuer's campaign countered that Trutanich has failed to push for such legislation, and was more focused on a failed effort to obtain grand jury powers. "Mr. Trutanich knew how to find his way to Sacramento when he wanted to expand his own powers, but not once traveled to Sacramento to seek any legislation on medical marijuana regulation," Jacobson said in a statement.

Having defeated the ban, medical marijuana activists are pushing for a "limited immunity" ordinance that would allow well-run dispensaries to stay open, while also giving the city the power to close pot shops that get out of line.

Feuer's campaign said that, if elected, he would also try to strike a balance between securing access for seriously ill patients while also protecting communities around dispensaries.

"There are too many dispensaries in L.A., some of them are magnets for crime and it is too easy to obtain marijuana from many of them," Jacobson said.

Some of you have said fight the power. WE THE PEOPLE are the power; government has somehow forgotten that. If you truly want to fight do so in the voting box. Vote for the ones who know WE THE PEOPLE put them there to represent us. The veil of fear and ignorance is lifting, WE THE PEOPLE are now thinking for ourselves and no longer believing what the government wants us to believe.  The government is not a two party system. The time is now.

 

To anyone who uses Marijuana or hemp in any way: Would you vote for someone that will use your tax money to put you in jail for doing so?

A question to ask each of the individual Council representatives - Did the City Attorney advise the City Council to repeal the gentle ban?

I see the usual folks gathered here who either are Afghani's (with only one name) or are not confident enough of their opinions to attach their real names to them.

 

Moving on... the LA Weekly refuses to recognize that City Attorney Trutanich is far from alone in believing that the state legislature, including state assemblyman Mike Feuer, has failed miserably to provide leadership and has left local jurisdictions with no practical guidance on how to regulate medical marijuana industry. Also, I challenge the LA Weekly to show its readers the evidence it has that 20 lawyers in the LA City Attorney's office are assigned to medical marijuana litigation. The LA Weekly again is blowing smoke.

MEDICAL MARIJUANA SHOPS OUT OF CONTROL IN LOS ANGELES:BROUGHT TO YOU BY MIKE FEUER AND SACRAMENTO’S LEADERSHIP VACUUM

 

Oct. 3, 2012 - The verdict is in: Sacramento politicians like state Assemblyman Mike Feuer have created a huge land-use and public safety mess for the city of Los Angeles by leaving the city largely unable to effectively regulate the almost 1,000 medical marijuana dispensaries now in the city and the many more dispensaries that are poised to set up shop in LA.

 

Last December, State Attorney General Kamala Harris warned that the medical marijuana situation was spiraling out of control and that it was time for Sacramento politicians to stop settling for “half-measures” to solve the situation. In a letter to Senate Pro Tempore Darrell Steinberg and Assembly Speaker John Perez, Harris wrote:

 

“As the state’s chief law enforcement official, I am troubled by the exploitation of California’s medical marijuana laws by gangs, criminal enterprises and others….[S]state law itself needs to be reformed, simplified, and improved  to better explain to law enforcement and patients alike how, when, and where individuals may cultivate and obtain physician-recommended marijuana. In short, it is time for real solutions, not half-measures.” 

 

Last Tuesday, the Los Angeles city council voted unanimously (13-0) to urge state lawmakers, like Feuer, to take decisive action to address the blatant “inadequacies of state law.” That motion said in part: 

 

"WHEREAS,  in December 2011, California Attorney General Kamala Harris advised the State Legislature that new legislation is required in order to resolve questions of law regarding medical marijuana that are currently left unanswered by existing state law; and 

 

"WHEREAS, the City similarly continues to believe that there is a pressing need for reform of the existing California medical marijuana framework, which fails to respond to fundamental issues and which has been inappropriately used as a legal shield to stymie local governments from solving many resulting problems. 

 

"NOW, THEREFORE, BE IT RESOLVED that by the adoption of this Resolution,

the City calls upon the State Legislature to take action (but only in a manner that is consistent  with the federal Controlled Substances Act and does not expose local jurisdictions  to liability for violation of federal law) to address the inadequacies of State  law  regarding  the  cultivation,  recommendation,  and distribution  of medical  marijuana...." 

 

“Los Angeles faces a land-use and a public safety mess because Sacramento politicians like Feuer have failed to act decisively to solve our state’s medical marijuana dilemma,” said Rick Taylor, chief campaign strategist for City Attorney Carmen Trutanich’s reelection campaign. Feuer is running against Trutanich. 

 

“It’s not just candidate Trutanich putting the blame on Feuer and his Sacramento pals for the explosion of marijuana dispensaries that are popping up all over - next to schools, churches and clustered in the Valley and East LA,” Taylor said. “The state’s top law enforcement officer and members of the LA City Council also see Sacramento politicians, like Feuer, as being at the root of this dysfunctional system for regulating – or not regulating – medical marijuana.”

 

“The council motion was embraced by all sides on the medical marijuana debate from Bill Rosendahl to Jose Huizar and Mitch Englander. That is a stirring indictment of the incredible lack of leadership on this issue by Sacramento politicians like Feuer,” Taylor said. 

 

“Gov. Brown has frequently complained that state legislators duck the big issues affecting Californians and prefer instead to micro-legislate on little things,” Taylor said. “The governor has not yet dubbed Feuer ‘Micro-Mike’ but I think that’s a fitting nickname for him.” 

 

Tuesday the LA City Council also voted 11 to 2 to repeal its ban on medical marijuana dispensaries. The vote, however, as the LA Times immediately pointed out, leaves the city with no rules in place to regulate the estimated 1,000 pot shops now in the city. 

 

Both Harris and the LA City Council urged state lawmakers to produce a coherent set of rules to guide the courts and municipalities trying to deal with the medical marijuana issue.

 @john.schwada Mr. Schwada, I appreciated your work as a journalist especially one of the last stories that your did on Fox-11 about over height fences in East Hollywood at the same time the Mayor was having a wall put on his City-owned residence.

 

So with your knowledge and practice of journalistic ethics, I hope that you would retract your comment made about the LA Weekly in your comments saying "The LA Weekly again is blowing smoke"

City Attorney Trutanich is a pathological liar who cannot be trusted. His words are worthless. I don't care who he blames for his failures. When he lost the DA election he blamed the media. When he lost millions of dollars in police litigation cases, he blamed his inexperienced lawyers for missing deadlines and other blunders. When his prosecutions against Occupy LA prosters collapsed, he blamed LAPD for 'paperwork' errors. Now he blames Feuer for his screw ups in regulating medical marijuana.  Does anyone see a pattern here? I suggest another pattern when it is time to vote for a new City Attorney; A.B.C. Anyone But Carmen "Nouche" Trutanich. It worked last time to throw his fat ass out of the DA race, now let's throw him and his cronies out of the CA's office.

Trutanich is 100% to blame for screwing up the medical marijuana ordinance. He was too busy running around spraying insecticide on plates of salad and berating cancer patients to pay attention to the the problem. He wanted to be the 'tough guy' to who could bully his way through a problem that could have been solved by assigning lawyers to write the ordinance who had a background in law enforcement and public safety. Instead, he allowed a bunch of land use lawyers to treat the problem like a planning issue. To now try to blame Sacramento for the problem he created is the classic response from this pathological liar. Bottom line, he was too busy trying to run for DA than to do his job. Do not re-elect Trutanich.
