Kamala Harris Tells U.S. Supreme Court Proposition 8 Must Be Overturned

So, of course, as the U.S. Supreme Court takes up the constitutionality of the matter, the state Attorney General's office is defending your will. Right? Oh, hell no.

A.G. Kamala Harris today filed a brief arguing that the court should do the right thing:

Harris says that Proposition 8, the law banning same-sex marriage, is unconstitutional and should be struck down like Clooney at a college bar.

Her filing comes two days after a group of prominent Republicans, including two former advisers to President George W. Bush, submitted their own legal brief to the court in support of legal gay marriage.

Harris' brief says, in part:

Equal protection under the law is a bedrock of our Constitution and fulfills our nation's binding principle that all people are created equal and should live free of discrimination. I look forward to the day when all Californians are granted their full civil rights and can marry the person they love.

Besides being discriminatory, the law also harms children of same-sex couples, Harris argues:

The state's interest in protecting children, including the over 50,000 children in California being raised by same-sex parents, is poorly served by allowing so many of them to grow up feeling inferior because their family unit is not validated and honored by law. California's interests in protecting all of its children - and their basic dignity and understanding of fairness and justice - are best served by allowing same-sex couples to enjoy the same benefits of marriage as opposite-sex couples.

Amen.

And, uh, the next time the Mormon church sneaks into California to pass such an egregious law, don't be such suckers, people.
