Marijuana Would Be Policed By Calif. Alcohol Authorities Under New Proposal

Who regulates medical marijuana in California?

Well, basically, nobody. State Assemblyman Tom Ammiano wants to change that. Today he announced legislation, introduced last month, that would bring medical cannabis under the policing of the California Department of Alcoholic Beverage Control.

The proposal is called AB 473:


Ammiano's office says it will mandate that the ABC police "the entire supply chain" and "work to eliminate criminal involvement in the industry."

The language of the bill also states that pot would be tested and that guidelines for growing would be established.

The bill would "provide a comprehensive state regulatory structure for medical
cannabis cultivation, processing, testing, and distribution," says a legal counsel's summary.

That seems like a tall order for the ABC, which is stretched thin as it is. (Officials have told us that they often rely, for example, on local police when enforcing state alcohol rules).

ABC spokesman John Carr told the Weekly, however, that "we haven't taken a position on that bill yet."

Ammiano says:

California has been in chaos for way too long. Cities have been looking for state guidance, dispensaries feel at the mercy of changing rules and patients who need medical cannabis are uncertain about how their legitimate medical needs will be filled. This is a concrete plan that will keep medical marijuana safe. We will get it into the right hands and keep it out of the wrong hands.

He compares his proposal to Colorado's system of regulating pot sales.

In the meantime, Ammiano's office says he's introducing a bill that would formally ask federal authorities to step off on enforcement against dispensaries ...

... to give California breathing room to get its medical cannabis house in order without the threat of new widespread prosecutions of medical providers.

If you see it closely, it sure seems a recipe for disaster. At the same time medical marijuana is not oranges and carries a very high proclivity to be abused. Wait and watch should be better rather than condemning the proposed regulation. A safe MMJ environment is categorically better than no environment at all! Stop giving away our rights so you can sell pot and appease the drug worriers! Wimpy damn politicians. This isn't the first time Ammiano. Prop 215 is the best law in the country. Nothing you put out can over ride the commerce clause federally. BUT you can mess up individuals rights by putting limits on them that are too small to grow. Meaning buying and a federal offense. Or by growing more than your limit and get busted as a state offense. Catch 22 we don't need. Forgetaboutit. Do what is right and logical and remove cannabis from the controlled substance list or continue harassing citizens with this silly incremental retardation! Enough already!

Raich v Gonzales granted the Federal government Commerce rights over selling or giving away more than reasonable amounts. States have authority over individuals growing reasonable amounts. Reasonable amounts have been established by the Feds IND program as 300 joints every 25 days or 100 plants per year. The 10th amendment was over ridden due to the Commerce clause. Its the IRS busting buyers clubs, not DEA. CA compassionate use act is the only state law permitting reasonable amounts for anyone for any reason. MMJ states, including CO and WA have limited themselves to a catch 22 impossible situation quantifying amounts that are impossible to grow individually. Forcing sales that are illegal under Fed jurisdiction. No one can grow an ounce or less. Over 30 countries are growing Hemp as the US maintains its ugly prohibition of it.  Enough! Remove cannabis as a schedule#1 narcotic. Including Hemp that should have never been put there in the first place. Stop incrementalizing. Cannabis is safe, end of story.

What a waste! Do we tax tomatoes, oranges, or olives? Yes, but not independently. And, if you want to stop the criminal element [the motorcycle gangs that provide protection] then stop the needless prosecution(s). The only reason the protection is needed is because the traffic cops are looking for handouts. If you let the NorCal product flow then the quantity and quality would drive the Cartel crap out of the market [and keep the revenue in the market]. And, has anyone dealt with the ABC lately? They cannot even shuffle paperwork efficiently. Hence...back to the traffic cops. Brilliant!

You got to be kidding me? This sounds like an attempt to move control of Medical Marijuana in California from private citizens to pharmaceutical companies. This line in particular "We will get it into the right hands and keep it out of the wrong hands" makes me nervous.
