We've Seen Fake iPhones, Panerai Watches And ... Mac Computers? Yes, And They're Legal (For Now)

Last month we told you about the strange saga of a small company called Pystar that makes Apple Mac computer clones that were being sold locally at Rashantha De Silva's Quo Computer in South Pasadena. The only problem with these boxes was that Apple wasn't impressed, and the company successfully sued for copyright violations that would have seemed to put an end to Pystar.

Except they didn't. On Tuesday the company announced it has reached a settlement with Apple, one that observers say might allow the company to continue making its clones but without Apple's operating system installed. Users would then be allowed, or compelled, to install Apple's code on their own.

According to a company statement: "Psystar has agreed on certain amounts to be awarded as statutory damages on Apple's copyright claims in exchange for Apple's agreement not to execute on these awards until all appeals in this matter have concluded. Moreover, Apple has agreed to voluntarily dismiss all its trademark, trade-dress and state-law claims. This partial settlement eliminates the need for a trial and reduces the issues before this court to the scope of any permanent injunction on Apple's copyright claims."

Salon spins the settlement like this: "It looks like it wouldn't necessarily stop Psystar from selling its Mac clones. Instead, the company would be limited to selling its "Open" line of computers without OS X preinstalled, and that responsibility would lie instead with customers. Apparently that's a compromise Apple is willing to live with, and with good reason, since the Mac maker would have to go after many other clone makers if it wasn't."

So there. Viva la fake stuff.

"Fake Mac" doesn't make any sense. These are just non-Apple-branded personal computers. A "Mac" is nothing more than an Appl-branded computer with OS X pre-installed. There's no magic fairy dust in there...

Apple will never be more than a "could have been" story, for the simple fact that they're too greedy. If they licensed their stuff, they would be as successful as IBM, but they won't be. That's why I don't own and Iphone, Ipod or anything Apple.

What do you mean by a "could have been" story? They already are. They have an expansive and dedicated consumer base in many worlds: computer, media players, and the cellular phone market. You know what Apple is, so does the guy down the street. They've set up a pretty strong market and everyone knows about them.
As a hardware company, too, Apple doesn't need to license out their OS to other companies.

I guess, they are targeting the segments that consist of users unable to buy an apple computer due to high cost of ownership. All apple made up of is branding and awareness, therefore spreading the "word" at the lower segments is now easy since the something imitated seals the success of original brand and increases awareness. New "apple"ish computers will put those buyers in range of apple by trying to secure life time equities. Anyway they may have sealed a secret partnership or something like that.

Nothing special? No fairy dust? You clearly haven't seen the inside of a mac. Apple's design team doesn't spend all their time thinking of new ways to paint a computer white- the computer's insides are designed incredibly well for maximum hardware, minimum heat.

@Shadow: Apple is far more than a "could have been." Their operating system is far superior to Microsoft's, and their business model allows for seamless integration.

Nearly everything Apple puts out is built extremely well, like Durr said. I used to be a Microsoft supporter, until I bought a MacBook Pro for a video editing venture, shortly after their switch to Intel. This laptop has been put through the works for nearly two years, and it's still running beautifully.

Think of the Windows environment as being a bunch of shit continually tacked onto itself by millions of people, with a very manipulable system. It's just as easy to create something using one way as it is to create something using a different way. You've got a system that can be manipulated in so many ways, the possibilities are endless right?

Not so much. An OS is much better when it has a well-thought out, rigid structure. This is how OSX is. Because of the standards for OSX applications, each of them work together in harmony with the operating system and other applications. It's rare when I am not able to do the use the same commands in every application (usually I only run into problems when using crappily ported applications from Windows). Combine this with their hardware and it's an easy win.

Anyone who claims Windows is better than OSX simply has not used OSX enough.
