And I don't mean Arnold -- although there's good news from him on the solar front -- see stories here and here. (Let a million solar roofs bloom!)
I'm talking about William G. Myers, the Idaho pro-development lobbyist with no judicial experience rated "unqualified" by the ABA whom Bush nominated last July to the 9th Circuit and renominated last week. Myers' nomination went down in filibuster last summer, but the administration isn't giving up. They want the 9th circuit, and they want it bad. Here's what he said in a speech last summer:
Cheney: Recently, Democrats used their obstructionist tactics to keep the Senate from voting on four of the sensible, mainstream nominees the President sent forward. One of them was Bill Myers - (applause) - a fine man, a good friend of Senator Simpson's and mine. He has widespread bipartisan support for his personal integrity, his judicial temperament, and his legal experience. If Bill Myers had made it to the floor for an up-or-down vote, he would have been confirmed to the Ninth Circuit, which, as you know all too well - Audience: Booo! Cheney: The Ninth Circuit is the one that decided we should not be able to say "under God" when we pledge allegiance to the flag. Audience: Booo! Cheney: Sounds to me like they could use some new judges on the Ninth Circuit.
(From the Arizona Daily Star.)
Even more recently, the 9th Circuit reversed a U.S. District Court decision on the BLM's plans to harvest Oregon's timber. I'll bet that bugged Cheney even more.
Yes, I'm even recycling my own post on the subject: What to expect, part I (I always meant to do a part II).

I want to thank you so much for being a great Paper and doing the best job out there. I want to send you my thoughts and hope you have the chance to read and consider them. Thank you very much for your time and have a great day!
Dear Friends:
These that follow are also very important American issues. We have always been a nation that reacts and cares when given the information to do so. Remeber Revlon with the Rabbits eyes in the 1970's, I do I wrote a letter with my mother at our kitchen table in Mineola New York and so did thousands of others and now its abolished! Americans have always cared, but with our hectic work schedules we really dont have a chance to catch all of what is happening these days. We need more human interest stories like the following that promote respect and teach our children how to behave and be civilized. Especially now when just about anything goes no matter how bad it is. I took this from the Humane Society as my family are members. I thought you also may be interested in knowing what is going on too. THank you so much for your time! I hope that you can run with this.
"Mourning doves were designated Michigan's state bird of peace in 1998. Last year, national and state hunting groups launched an all-out attack on Michigan's century-old law protecting mourning doves. They convinced the state legislature to narrowly pass a bill allowing the sport shooting of these backyard songbirds for the first time since 1905, and Governor Jennifer Granholm signed the bill into law—after promising that she would veto any dove hunting legislation.
We need to tell the extremist sport hunting groups like the NRA that the bird of peace shouldn't be blasted to pieces. You can't sign a Michigan petition to protect doves—but you CAN help the doves in another important way
But while elected officials may be held captive by sport hunting interests, we can take the vote directly to the people and restore the dove shooting ban. Today, we are working day and night to collect the necessary 225,000 signatures of Michigan voters to place a dove hunting referendum on the statewide ballot. We've already gathered more than 170,000 signatures, but we only have until March 15 to meet our goal. We have just 12 days left, and we urgently need your help!
We know that if we can place this measure on the ballot, the voters will decide once again to protect these harmless birds. And here's the best news: Just by qualifying for the ballot, we will suspend the new dove hunting law until the voters decide in November 2006. That means the dove hunts scheduled for 2005 and 2006 will be halted, saving up to a million gentle doves who could be killed in those two years alone!
It will take an all-out push over the remaining 12 days to get this measure in front of the voters—The goal will immediately save up to a million doves. Every dime you email your thoughts to her and help out it will save a dove from being blasted out of the sky. Will you help us today?
Since you don't live in Michigan, you may be wondering why I'm asking for your help on this issue. It's because together we can save so many defenseless doves, and because this fight has national significance.
Thank you so much for your generous action today, and always, on behalf of animals.
And also Canada is going to launch its annual Baby Seal hunt again at the end of this month. A very very sad and disgusting thing. Skinning live baby seals in front of its mother - by the hundres of thousands. We outlawed it, they must too. Please run articles with photos so Americans can get outraged and do something positive. Its a great cause and makes us feel wonderful when we feel we can make a difference.
Sincerely, Marie-Louise Ericsen and for the Mourning Doves

Perhaps we ought to remember that this may portend an even greater danger. Jeffrey Toobin's article in March 7 issue of the New Yorker suggests that the Bush administration's submission of this and six other cadidacies whose nominations had previously succumbed to the threat of democratic filibuster is part of a strategy to get rid of the Senate's filibustering, at least as regards judicial nominations, and eventually as regards tax cuts. Scary thought isn't it?
