Today was Ed Boks' last day on the job as general manager of L.A.'s Animal Services Department. The

former Christian minister ("Religious values," he recently advised on his personal blog, "call upon us to show kindness and mercy to animals") has easily been the most controversial appointee to that post. He even outstrips Guerdon Stuckey, his embattled predecessor, for the sheer amount of animosity he inspired in some of his constituents.

Admittedly, animal lovers are a finicky group under the best of circumstances (L.A. has run through seven ASD managers in the past 10 years), but Boks' inability to fulfill his mandate to make L.A. a no-kill-shelter city, along with his unilateral suspension of a popular spay-neuter voucher program, a messy sexual-harassment suit and his ill-advised plan for a Hooters for Neuters event, combined to force his resignation last April.

Even today, however, Boks' critics are lambasting his department, claiming that a dog named Stu, which has been impounded for almost four years, will be put down July 23 as the result of department politics. The dog had been locked up on a biting charge a year prior to Boks' arrival in L.A. but, critics claim, Boks had allowed Stu to remain impounded ever since. Jeff de la Rosa, Stu's owner, and his supporters are now trying to pressure the Board of Animals Services Commissioners to spare the dog and send him home. In the meantime, it would seem,  Boks remains to the end a colorful and unforgettable figure in the city's gray, bureaucratic landscape -- although not necessarily for the reasons he'd like.

I am a former Commissioner on the Board of LA Animal Services of the city of Los Angeles, and am currently sitting on the city’s Spay/Neuter Ordinance Advisory Committee, as a District-11 appointee.

Animal Services Dept. wants to kill an owned dog in an obvious miscarriage of justice that is playing out before our eyes. The owner’s due process rights at the administrative hearing and at the administrative Appeal were stymied in multiple ways. 1) Expert evidence supporting the dog was kept out at the hearing level, 2) a city Commissioner hearing the Appeal engaged in ex parte communications with the appellant, formed a personal bias, and pushed the others toward her personal bias formed in that ex parte communication. Evidence that in the four intervening years the dog has had no problems has also been kept out.

The Commissioner engaging in the ex parte communications is gone. A majority of the current Commissioners, having heard the due process accusations, and one of the Commissioners being personally aware of the due process accusations, want to drop the case. However, their efforts have been obstructed. A State Court decision that will let LAAS kill the dog, “Stu” is imminent. But after two separate Commissioners formally requested that an agenda item for a vote to drop the case, the item was kept off the agenda. Their last scheduled meeting for June 8, 2009 would have been their last chance to vote before the State Court decision that will likely kill Stu. That meeting was abruptly canceled for no reason. The public has consistently spoken to save Stu and they have been summarily ignored. The owner has done this mostly without a lawyer, having spent all his money trying to keep his beloved dog alive.

This case goes far beyond the one dog. This case demonstrates the abuse of process which has taken place and the due process violations now being tolerated by the city. As a result of the city not taking responsibility for the past violations, city’s time and monetary resources are being spent to continue its prosecution even after the city’s due process violations came to light.

Even murderers are allowed to go free when their due process rights are violated. In this case, there are so many due process violations I lose count. More detail is in an article at this link:

I’ve been fighting for this dog’s life and fighting for the city’s integrity since I was on the Commission. Stu has been kept behind bars for 4 years already. He’s old now, and probably has only another year or two to live his natural life unless cut short by this travesty.

In my letter of resignation from the Commission on the Board of Animal Services Dept. to Mayor Villaraigosa almost two years ago (http://marie310.blogspot.com/2007/09/resigning-from-laas-commission_03.html), I wrote the following, and it was referring to Stu’s case:
“Recently, the Commission discovered its serious procedural problems with a past appeal. I was not involved with this particular appeal, however, I felt it was the Commission’s sworn duty to right its wrongs, and restore its integrity, when the process was violated, with unfairness and prejudice appearing high and harmful.
“Unfortunately I have learned that certain members of your administration, this department and the Commission are incapable of acknowledging errors, therein misleading the public. Such actions (or inactions) are resulting in the needless suffering and death of many animals, mistreatment of the public, and wasting of financial and human capital.”

It is significant that, in the lower State Court case regarding the owner’s other dog, the Judge ruled in favor of the owner on the same issues of due process.

Meanwhile, this case has been an ongoing battle for four years! For four years, it has been draining city human and financial resources, to pursue a case with due process violations by the city. I’m really astonished with the wasteful and negative behavior of Mr. Todd Leung, the city attorney, along with others who perpetuate this inhumane condition for Stu. I wholeheartedly understand his owner’s frustration, and the growing public anger as the city tolerates this failure of justice.

Since Stu’s owner is not a lawyer, he may not have done a good job framing the due process violations for the Court, but the Commission is aware of them, and so am I. Attached please find my Declaration in the case.

If we are to believe the Mayor’s statements that the city has a budget crisis, shouldn’t we see the City Attorney’s resources better directed than wasted on so many years of litigation over a now 10-year old dog when the initial hearing was tainted with due process violations!?

This is 1) sheer animal cruelty 2) a total waste of our tax-dollars. The city attorney’s office should not be accepting due process violations against any constituent.

I urge you to take immediate measures to correct the procedural and due process violations by withdrawing the city’s opposition to the case. Anything less is supporting constitutional violations. The State Court decision is imminent and this needs to be cleared up right away. I hope you can and will help.

Stu de la Rosa was injured and bit someone. The dog is 11 and has never before or after the single incident been aggressive towards humans. Ed Boks does not care about animals.

This is a travesty. I am just flabbergasted that Jeff de la Rosa's rights have been ignored time and time again and that this animal, Stu, has been living in impound for the last 4 years. This is not how I wish to have my tax dollars spent! Stu needs to be returned to his owner immediately. Enough is enough. I appreciate Marie Atake's informative letter. Let's hope someone has the integrity to step up and right a terrible injustice before it's too late!

This is just unacceptable behavior on the part of the City Attorney Todd Leung, Ed Boks, Linda Barth.

This dog has suffered long enough and in no way, should be put to death because "someone" may have a vendetta against Jeff de la Rosa, Stu, or dogs in general. Perhaps it's egos...you can't live up to the fact that maybe a mistake was made in the first place, so now Stu has to pay, not only by being jailed for 4 years, but now let's kill him so he won't be a constant reminder of our mistake.

To keep this poor dog locked up for 4 years and then KILL him?! That makes no sense whatsoever! What's in it for those involved in wanting to have Stu killed besides self satisfaction of 'winning'?

A life being taken "just because they can"...wow that's compassion at it's finest. Do you people not understand also, the psychological damage you've already caused to Stu's owner, or does that not even matter? It's obvious money isn't an issue for Jeff..but STU's life is and that in itself, shows us HIS character far exceeds any of yours.

Now to demand that Animal Services do your dirty work, when probably most of those people aren't in agreement with killing him either, except for one individual known, is just as cruel. This dog is considered a senior now and should be allowed to live the rest of his days in his home with the people who love him.

Why is it so much to ask for when the facts are clear that Stu has done nothing wrong except to bite out of fear from his own injury. Most people with any basic knowledge of animal behavior knows a dog may bite out of fear when injured. So how does this justify 4 years in hell and then be executed because of someone else's ignorance?

I think it is time this dog and his family get reunited. I feel the dog has done his time just like an inmate in jail and now it's time to release him to go home and be with his loving family.. I think the dog has had enough time being confined in a cell that he should not have been in for 4 years..

Nobody knows why the attorneys are being so aggressive about this case. Villaraigosa's philosophy of never admitting he has done anything wrong seems to have permeated city departments.

The City Attorney's office has flipped over the Stu case and it has become much bigger than whether or not Stu should live or die. For some reason best known to the city attorneys so gung-ho to kill Stu, they feel they cannot budge an inch on Stu because it gives the impression that they have lost. Stu's case has become about ego.

The new City Attorney assumes office on July 1st. Pardoning Stu would be a positive statement of intent about what Los Angelenos can expect under his stewardship.

Allowing his staff to get away with this persecution of a dog would just be an indication that he is really no different from predecessor. The last thing we need in LA right now is "meet the new boss; same as the old boss."

Thank you , Steve, for including Stu in your article. Just some fact corrections:

1. Stu was impounded in Sept.2005. Boks came in January 06 (3 months, not a year).

2. Boks swore to me on September 9, 2006 that he would re-open this case because "something doesn't seem right here." That never happened.

3. It is Boks that refused Stu medical treatment for 3 years , including teeth cleaning, which has caused Stu to have suffered gum infections and lost teeth.

4. Boks took on the persecution of me and the continued prosecution of the Stu case from the start. He published lies and my home address on the City website in an attempt to discredit me.

5. Boks sent 2 animal control trucks to raid my home on Dec.
8, 2006. I had rescued to dogs who were fostered on my street. When 1 got out, he sent the SWAT team, surrounded my home and lit it up like Dodger stadium.

6. In June, 2007 Boks send an officer to my home to threaten me with a search warrant for having "illegal" dogs. I didn't have them. The officer was instructed to threaten me with seizure of my 14 year-old blind and deaf Cocker Spaniel. Why is this relevant. This "visit" happened only 2 hours after I called the Mayor's office to complain about the Boks web postings.

7.RE: dismissed lawsuits. EVERY case which settles out of court is dismissed with prejudiced by the court. If Boks did nothing wrong, they would have gone to trial and risked a 6 figure jury award. For him to say that the "charges" were dismissed is pure Boksian misinformation. You fell for it. Many do.

8. Boks blocked the Board of Animal Services Commissioners from addressing the overly long and inhumane impound of my dog, Stu for 3 months. Finally, public outcry forced him to let the item on the agenda.

The real story here, Steve, which still goes on under Linda Barth, is that the Board of Commissioners is , by law, the Head of the Department of Animals Services. Boks, and now Linda Barth work with "others" to block the Board from meeting when a controversial item is up (See June 8, 2009 meeting) and if the Board does meet, they are told what they may discuss and what they may take action on. Imagine if the Mayor canceled City Council meetings. This is no different.

The wake of death and destruction of people and animals which Ed Boks has left is wide and deep. This is a feature Weekly story which nobody has had the balls to publish. I'm available, as are many others, to assist. Please talk to your editor. Boks can never work in any job involving animals ( or people) again and we need to make that happen. Lead on.

Ed Boks is a disgrace to everything he claims to stand for and a poor excuse for a human being. He may also be a criminal and should be investigated and the matter placed before a grand jury to consider a felony indictment.

Stu the dog should be returned to Jef de la Rosa at once, with apologies and compensation.

Sadly, many people don't understand this: there is NO such thing as a no kill shelter. It works like this, one place claims to be a no kill shelter, and then after a period of time, if the animal is not adopted, they ship it off to a different shelter to do the deed ... just because it's not done at that particular shelter does not make it a no kill shelter. They're still in the business of killing more animals than they adopt out. I hope Stu can go back to his home and that his owner will keep him on a shorter leash to avoid another biting incident. So sad.

#1 Stu had just been the victim of a bite and was injured and the person who was in charge of the care of these two dogs knew it (ASSUMED RISK).
#2 This person was "working", paid or volunteer, working with animals. (VETERINARIAN'S RULE)
#3 This person attempted to place a restraint "collar, leash" over a just bitten ear or (side of head) very sore / untouchable without sedation. (PROVOKED)
Return this man his property. I am a taxpaying Angeleno and I do not want one more of my taxpayer dollars spent dealing with this. Not to house the dog. Not to execute the dog. Not to have the city attorney's time spent dealing with this. Or any other city employee PERIOD Enough is ENOUGH!

I have read all the posts regarding Stu and I agree with most everything people say. I was one of the animal behaviorists who examined Stu, and I can tell you that this dog is not vicious or dangerous, and incident in question happened because the dog was in pain and the person bitten provoke the dog by her actions. Mr. Ed Boks, fortunately has now left, and I can tell you that Boks acted inappropriately to me on several occasions. The whole situation is absolutely ridiculous, the dog should be return to its owner, and the perseverance of his owner to save Stu over the course of the last four years is truly, truly remarkable!

This is one of the cruelest situations I have ever read and makes me wonder how a state that is broke can waste money on this and not do the right thing...return Stu who should never have been taken away anyway to his owner. We kill millions of unwanted dogs every year but this is unbelievabe. Why break the heart of a pet owner? How can we ever trust Animal Control again? Seems like this should be a lawsuit and I rarely believe in them. PLEASE LET STU GO.

On behalf of the American Legal Foundation of Florida I would like to enter our protest against this treatment of animals and citizens by the City of L.A.
Federal Law: 42 U.S.C 1983 is a recourse in Federal Court for violations of Civil Rights by a state, county, or city government official acting under color of law. The 5th and 14th amendments to the Constitution of the United States does guarantee "Due Process" to all citizens. That statute does also grant that if the Court Rules in the favor of the owner of "Stu" that the City of L.A. will also be liable for triple legal fees for the attorney representing Stu and his owner. In a similar case of "Due Process" the Federal Court ordered the public auction of East St. Louis City Owned Property to satisfy the judgment awarded by the jury.

The City of L.A. needs to wise up, killing the dog will not make the lawsuit for violation of civil rights go away. As long as Stu's Owner files action in Federal Court within two years the City of L.A. and it's officials may be paying legal costs for many years to come. Question: Can L.A. Afford this Fight which will be brought in Federal Court?

Why does it seem that Stu's incarceration is being used as a way for Mr Boks to boost his ego? Keeping Stu as a prisoner for 4 yrs is a travesty. Stu should have been released after the rabies' hold. How much money has been spent on this case? The money spent could have been used much more wisely by saving other pets'lives, spaying/neutering and educating people so the pet over population problem can be brought under control. Why has Stu been kept prisoner for 4 yrs only to euthanize him on July 23rd?
Please release Stu, please do not kill him as he has paid with enough of his life. If Stu can not be released to his former owner (for whatever reason) perhaps he can be released to a rescue or an agency who can find him a new loving home, where Stu can live out his days in freedom and happiness.

Poor little Stu had only lightly bitten Jeff's assistant due to the pain from his injured ear when she put a harness on him.
Something that could have happened to Anyone, a very natural reaction indeed! They had it all worked out until the assistant reported the incident a month later to sue! Then Stu was stolen and locked up when his owner Jeff was away from the home and he has been languishing ever since!

The Real Victim in this case is Stu who has been held 4 years for No Good Reason and subjected to what amounts to extreme cruelty & injustice! Stu has been denied a fair trial and it seems that there were many due process violations - a murderer would have gone free in similar circumstances!

Something that could have happened to Anyone, a very natural reaction indeed! They had it all worked out until the assistant reported the incident a month later to sue! Then Stu was stolen and locked up when his owner Jeff was away from the home and he has been languishing ever since!

The Real Victim in this case is Stu who has been held 4 years for No Good Reason and subjected to what amounts to extreme cruelty & injustice! Stu has been denied a fair trial and it seems that there were many due process violations - a murderer would have gone free in similar circumstances!

Humans let pets overpopulate, and our only solution is to kill them? They are not livestock, they are companion animals and worth more to us than we think. Please please reconsider euthanizing Stu. It would be such a tragedy and a waste.

Not only should Stu be allowed to go home to the family that loves him, the agency that was responsible for his incarceration for that last 4 years should be required to pay any and ALL training and rehabilitation costs his family will certainly occur helping their beloved pet adjust to life outside an obviously horrendous prison/kennel facility.

The years Stu has spent in this shelter certainly impacted how he will interact with humans and other animals on the outside. I used to work as associate director of a humane society and if Stu's legal owner is responsible and Stu hasn't been driven out of his mind in the shelter, then LET HIM GO HOME. How many years has this dog been locked up? What is the statute of limitations on violent crimes - aside from murder - in the state of California? Hey, government: be reasonable, just this once, and let the dog go home. You'll make constituents happy and you'll free up a kennel for a dog that is truly homeless.

I also must address the author's comment about "finicky" animal lovers. Sir, do you ever comment on finicky children's or senior's rights advocates? How about fickle rape crisis workers? Wishy-washy teen violence prevention advocates? The people who work in animal welfare do so to help the animals, as do those who enter other human/public service vocations and professions. Until you work in one of these situations, please reserve the use of prejudicial language, as you do not know the toll this work takes on those for whom it is a calling.

This is not just the question of the life of one dog, this is the question of punishing an animal for the acts of humans. Stu had been neglected and abandoned on the streets of L.A. and when the City's own Animal Control missed a chance to save him he was rescued by a concerned citizen. L.A. Animal Control had previous experience with this citizen and there was a hostile relationship between humans.
The Officials of L.A. have used Stu as a weapon to obtain revenge against that citizen. Obviously if a person is willing to take on the responsibility of rescuing an animal then that person truly loves animals. It is expensive and time consuming to rescue.
If you want to extract revenge against an Animal Lover then what is the best weapon? His animals that he has rescued of course. That is what this is all about, the Officials of L.A. want to extract every ounce of revenge against this citizen who is an animal lover. AND TO DO SO THEY ARE MAKING THIS DOG GIVE THE ULTIMATE SACRIFICE ON BEHALF OF THE MAN THAT RESCUED HIM.
What if this citizen was rescuing children from the streets of L.A. that have run away from abuse at home. If after rescuing a child that child committed a minor infraction of L.A. laws whould the City execute the child to extract revenge for their personal dislike of the rescuer?

In Colorado, dog owners have the right to defend their animal just as parents would have the right to defend their child. Worse, the dog has served 4 years of time--half a lifetime sentence for a dog--and now at the end of that long imprisonment you would send him to the executioner. LA needs proof that its authorities care about life and justice--not just the hearsay of a crooked commissioner long-gone. If they do not release him, Stu will become a martyr, and that martyrdom will be far more damaging to their authority than any freedom they might return to him.

Are you trying to tell me that something so simple as losing a dog was beyond all your capabilities???? Tsk, tsk, tsk. Hell, all the Animal Controls I've ever been in lose dogs that were scheduled for euthanasia. If that doesn't work here are 2 other ideas....

A. Get a HUGE crowd together (I'd ask the Mexican family next door- they're a crowd all by themselves) and TAKE the dog by force.
B. Have a friend smuggle the dog out at night and micro-chip him and register him under someone else's name immediately and if someone says something insist it just looks like Stu- change his name to Blue- he won't care. Then force the politicos to waste the tax payers' money trying to get him back - I'm certain that will go well for them- BTW, GUNS come in really handy in cases like this....yee-haw!

And finally, when Stu/Blue gets home- keep him under control- of course, he's a senior now and probably won't be much trouble to anyone anymore.

It's obvious the dogs aren't the only ones trying to pee highest on the tree. Putting poor Stu down is MUCH easier than solving problems like racial strife, poor economy and loss of jobs.
