According to the San Gabriel Valley Tribune, the Federal Bureau of Investigation is examining

the actions of an El Monte police officer caught on video last month as he seemingly kicked a suspect who lay surrendered on a lawn. The suspect, Richard Rodriguez, is an alleged gang member and had been in a car with another man as the two were pursued by El Monte officers. TV-news helicopter cameras followed the high-speed chase as the suspects drove through stop signs and, at one point, onto a sidewalk.

Rodriguez eventually abandoned the car, fled to a back yard and lay prone as officers approached him. The officer seen kicking Rodriguez in the head has been identified as George Fierro and the FBI, which began requesting documents from the El Monte P.D. last week, is looking into the possibility that Fierro violated Rodriguez's civil rights.

The L.A. District Attorney's office and L.A. Sheriff's Department had earlier announced they were conducting their own probes into the incident. Fierro has drawn additional attention because he sells a line of gang-themed T-shirts and other casual attire. Called Torcido Clothing, Fierro's company  boasts "some of the hardest authentic jailhouse threads for the streets. Straight from East L.A., Califas . . ."  The veteran officer has been assigned to desk duty since the incident. The Trib article concludes by noting that an El Monte city council member has called on the FBI in the past to investigate that city's police department.

Not all cops are bad... and most of them are doing the work of heroes everyday... even to protect scum like you that give them no respect even though they put their lives on the line for all of us each day.

Umm yeah We do NOT pay for the police to do the duty of giving out Justice.. That is the responsibility of the courts. They MUST obey the law(to a T), because they have been given the authority to enforce the law.

As far as I'm concerned the video I saw of this beating I saw a man committing a felony (Assault while in possession of a firearm). Law Enforcement Professionals do NOT let their emotions get in the way of doing their job. I hope cops like this get put away with the scum they beat.

Two points I would like to make. One, Scum like this gang banger need to be off the street. Second point, Cops like this guy need to be taken off the street. It isn't a "one guy is bad and one guy is good" scenario. This guy was a crook. He needs to go to jail. The cop is there to take him into custody so that he can be put in jail. Anything the policeman does other than apprehend this guy is an abuse of power. I don't deal with crooks very often and on some of the occasions I do I have the opportunity to defend myself and deal with the situation. When I have an interaction with a cop I have no option other than to do whatever he wants. He doesn't serve me, he isn't looking out for my best interest. When my car was broken into outside my store, the responding officer asked what I was doing at my own store after business hours. Cops need to be held to a higher standard, not allowed to break the law when they feel like it. In Orange county they give cops little sticker badges, two, to give out to family members. Those family members will no longer get traffic tickets. Favortism nees to stop.

Any officer invoved in a high speed chase/foot pursuit should be aware that they're on camera and act accordingly. Its pretty much an additional charge to defend yourself from a cop. My own sister faces charges after she hubcapped (there was one on the lawn where she was) a man in the process of raping her friend back in march. The man just happened to be a cop in uniform. This makes HER, not HIM, the criminal. He was suspended until the investigation finishes.

Anyone in a position of power must be held to the highest standards and highest penalties. They're given power over the lot of us, legally and forcefully, and any abuse must be struck down with so much speed and efficiency DARPA wants it on a bomber. Otherwise you've got nothing but a lawless, feudal society.

This gang member probably has done a lot of kicking of his own. And on some innocent or not so innocent beings.

And having said that, an officer is supposed to be able to control himself. It is tough to do. But he has the power. The legal power and hopefully the moral power. The criminal does not. But the officer is supposed to. We expect them to be better. When he took it upon himself to kick the jerk in the head, he put himself on the same level as the man he kicked. And he did it while he was down on the ground.

It cannot be both ways. We either have laws and those that enforce the laws, or we have cops who break it when they feel like it. I don't want to be stopped one day for a bad tail light or for going ten miles over the limit, and run up against a cop having a bad day.

The police try but there are too many with the gung ho attitude that think its their job to dole out justice. Its not. And when a cop does it, they become a criminal and should be prosecuted to the full extent of the law. I don't care how mad they get or how much they personally want some kind of vengeance, its not their job. Investigate, locate, capture, protect and serve. The rest belongs to someone else. And for the a-hole who said to call a gang member when you are being robbed - blow me. Cops are there to identify the bodies, and start investigations. You want protection, do it yourself.

The cops are supposed to be better than the people they arrest. I'm not defending the guy who got kicked at all, but his punishment is decided by a judge and handed out in a jail cell. The police simply aren't trustworthy enough to be given this type of discretion and if we allow this to happy there is little doubt you will see them continue to push what they can get away with. This is how a "police state" starts.

The officer should be fired and then punished as the law requires. Again, the cops should be better then the people they arrest. Once we stop demanding that then law enforcement has little meaning.

Police officer are expected to have criminal justice course as part of their training. This officer must have had a bad childhood and unhappy disposition that he took the law into his own hand. He was unhappy that he had to chase this thug and took his anger at the thug. This officer need psychiatric evaluation. Most officers are kind, helpful and have to worry about their safety in performing public service. Bad apples are every where. Let us not contemn all the police officers and without statistics to prove otherwise, we need to understand them and help them to help us. I am not a police officer and I have had met couple of unworthy policemen, but mostly the good ones.

You all are quick and easy to jump to assumptions about what happened, and whos at fault without see'ing all the facts, not to mention how much stress and adrenaline this cop was probably under after a high speed chase endangering inocent lives. Im not saying he is innocent or guilty of anything, but if i just spent 30min chasing a pos through city streets, i would of beat the crap out of him to, because chances are he is just going to get off with 6mo in prison anyway.

Some of you people are so ignorant it is not surprising the US is so fucked up. It is not the job of a police officer to kick a guy in the head, who had surrendered. It does not matter how much adrenaline he had or any of that other bullshit, his job is to arrest him, and then put forth the evidence at hand so that justice can be laid down by the COURT system. If it was a police officers job to administer justice, we would have no court system, and you can guarantee a lot of you who think the cop did nothing wrong here would be sorry, as you yourself would also be the victim of police abuse of power. What this cop did was a crime, and what the gang member did was a crime.

No matter what,..no matter how great of a man you are police or what ever, when you kick a man when he is down and you have the authority, you are a bigger coward then he is. That is why criminals run and endanger others is because they know that if they give up some cowardly cop will come up and start kicking, hitting, etc, even shoot while he is down.
