Coconut Water Lawsuit: Do Nutritional Claims Hold Water?

Drink Vita Coco or O.N.E. Coconut Water because of its health benefits? Use either liquid as a cure for a nasty hangover? Shocked to learn that, according to a recent study, neither brand of coconut water has as many nutrients they claim? If so, you may be putative members of one or both class action lawsuits filed last week against the manufacturers in Los Angeles Superior Court.

ConsumerLab recently tested the waters, so to speak, of three of the major coconut water brands: Vita Coco, O.N.E. Coconut Water, and Zico. Of those three, only Zico delivered on its nutritional claims. The study found that the other two had "far fewer" electrolytes, sodium and magnesium than the amounts printed on their labels.

In response to the study, the makers of Vita Coco and O.N.E. Coconut Water point out that, unlike Zico's use of concentrate, their waters are made from all-natural products. Because quantifying Mother Nature is inherently a tricky process, they argue, deviations from the amounts stated in their respective labels are to be expected, but in no case exceed the 20% allowance permitted by law.

Nonetheless, Kevin Shenkman, an "avid runner" who purchased and drank Vita Coco and O.N.E. Coconut Water for its "'super-hydrating' attributes," was "disheartened" to learn about the study, reports Thomson Reuters. Naturally, he decided to sue both companies for false advertising and fraud. On behalf of all potential runners, swimmers, cyclists and even non-avid athletes, he is asking for an undetermined amount of damages, official apologies and that both companies run advertising campaigns to correct their claims.

Interestingly, the same article reveals that Shenkman too is a lawyer and the lead plaintiff in a class action suit against Panda Express, claiming that the fast food chain with excellent orange chicken adds chicken powder to its vegetarian entrees.

No court date has been set yet for his latest suit, so we'll have to wait and see if the case holds water. In the meantime, might we suggest that you simply respect the fruits of Mother Nature, drink it for what it is and super-hydrate with a bottle of Gatorade instead?

As opposed to some other fats, it is constant at all heat, keeps for years and does not become harmful when used for burning. You can always fry and sate your preferred meals understanding you are getting a serving of health. The oil changes from from strong to fluid based on heat range.

You're missing the point completely LAWeekly. Coconut water IS respected for what it is: an amazing beverage that contains many electrolytes and minerals. This is why it is so beneficial in rehydrating - the salts aid in its absorption in the gut and intestine. This is why Shenkman consumes the product in the first place. He obviously DOES NOT want to drink an artificially flavored, Coca Cola crap product.

Ending an article in this blatantly ignorant style loses ANY credibility your mediocre writers may have.

I would like to sue Panda Express for not serving any panda. I was very disheartened when I learn that their food contains no panda at all. Their advertising and logo prominently features a panda.

Coconut water is a natural product. I've actually been to the factory in Brasil where Vita Coco is produced and have seen them literally take young coconuts, crack them over a spike, and fill a Tetra Pak with the coconut water. The Tetra Pak packaging is the same that most orange juice cartons are made of and, just like orange juice, because coconuts are a natural product grown from the ground, their nutrition will vary slightly from coconut to coconut. If you did a similar study on orange juice, the results would be similar

The reason Zico's water came out so very consistant is because they take the coconut water to a laboratory to balance the chemicals before sending it to product. Sure, you can have every bottle have the same nutrition but then you're adding chemicals and suddenly the packaging has a long ingredients list you can't pronounce. Which is healthier, having a natural product or having a consistant product loaded with chemicals and preservatives. I'll take Vita Coco anyday. This lawsuit is futile and is a waste of time and money.

Thanks for this article.  My site below ranks high in Google for people searching for the benefits of coconut water, and I will update this article to make sure they are aware of this study.  A LOT of people read it every day.

Will go update it now... but please, stay away from the Gatorade.  It still has far fewer electrolytes, and the loads of sucrose, while not as bad as the old high fructose corn syrup, still isn't doing anyone any favors.

BTW, Panda Express does indeed add chicken stock to their vegetables and rice. They'll even tell you this if you call their 1-800 number (but certainly not advertise it in the restaurants). Sucks, vegetarians totally thought they had a chinese getaway.

Taste Nirvana is actually the best tasting coconut water I've ever tried. I don't drink it for the nutritional claims, I just think it's healthier than soda and so much more refreshing.

..I used to drink Vita Coco a lot,but I switched to C2O coconut water.Both products taste amazing,sorry to hear that they don't meet the nutritional criteria..but still its better to drink that then Coca Cola and the rest of the variety of soft drinks I think

The only good coconut water is the one fresh from the coconut,You also get to eat the jelly that's inside the coconut. Everything else is garbage.

Super-hydrating with gatorade is a joke!  Gatorade is all sugar and is terrible for most people!!!
