Lawsuit Claims Foie Gras Ban Is Unconstitutional

On July 1, the countdown clock hit zero and California's ban on foie gras went into effect. But, as one might predict, the law barely lasted one full business day before a lawsuit was filed against it. According to the San Francisco Chronicle, a complaint filed in federal district court on Monday alleges that the ban, which prohibits the sale of any product that results from force-feeding a bird for the purpose of enlarging its liver beyond its "normal size," is vague and unconstitutional.

Three plaintiffs filed the lawsuit, including a New York producer of duck products, a Canadian nonprofit organization that represents the interests of foie gras producers and exporters in Quebec, and Hot's Restaurant Group, which operates Hot's Kitchen in Hermosa Beach and Hot's Cantina in Northridge.

The complaint alleges that the ban is vague -- and thus violates the due process clause of the Constitution -- in that the "statute defines 'force feeding' as a process that causes a bird 'to consume more food than a typical bird of the same species would consume voluntarily.' In practice, the vagueness of this purported standard makes it impossible for anyone to know at what point a particular bird has been fed 'more food'" than the law permits.

And because the law affects what out-of-state producers can and can't sell in California -- namely foie gras, but potentially other duck products as well -- the plaintiffs claim that the law interferes with foreign and interstate commerce and violates the commerce clause of the Constitution.

The attorney for the plaintiffs told the San Francisco Chronicle that he will seek a preliminary injunction to stop enforcement of the ban until the case is decided. Ultimately, the plaintiffs are seeking a permanent injunction and a declaratory judgment that the ban is unconstitutional.

If you ban this, you have to ban all commercially produced meat products.  Tyson chicken keeps their chickens in tight pens in rooms with no light their entire lives and manipulates them so they have extra large breasts.  So large, the chickens couldnt even walk if they had been let out of their cages.  Veal?  Not pretty either....still, I dont see them trying to ban either. If you dont like it, dont eat it.

Well at least someone is standing up. Regardless of personal opinion I feel they have a RIGHT to fight for what they believe in. By the way, I love Foie Gras!

The birds are not being tortured.  Cows and chickens are treated way worst to a point where contamination occurs.  People get sick from eating poultry but where is the government's protection?

The FDA regulates food for the protection of the consumer. They do not regulate food to protect the food FROM the consumer.

It's not the food, don't you realize that the government is now DICTATING to the citizens just what you CAN and CANNOT EAT!  That alone is an outrage! Where will it end if we the people allow them to get away with this??!! Damn straight its unconstitutional, including FREEDOM OF CHOICE!  More of our constitutional freedoms being taken away. More recently, the choice of whether or not we wish to purchase health insurance has been taken away from us.  Again, what's next?  Yeah, there may be a "bagillion" other things to eat, but how many more freedoms do we have left?!  Surely you know they're coming after our guns in the next two years.  Next?  Probably something that YOU cherish!

Its Animal Cruelty and its one thing i think that you don't have to eat. jeez.  Plain and Simple, its called Animal Cruelty. Foie Gras needs to be BANNED. I don't care about you all complaining about your constitutional rights. Animals have right's as well and in this County, WE have animal right laws and what they do to these animals is just so darn CRUEL. One less thing you have to eat. Is it really all that important to you to eat foie gras  geez. Have a salad.

It definitely hurts the foie producers. I've had no issues since the first eating foie in ca. Everyone is just giving it away now. Brioche sure has gotten expensive though.

Ugh, please, claiming something is "unconstitutional" has become such a bull-shit go-to. Next it'll be "I can't murder this guy is vague, it's unconstitutional."  Just STFU [not Tien here] and get the frack over it, foie gras is banned, there's only about a bagillion other delicious things you can eat. It'll be fine.

You've never eaten it have you? It's like banning bacon. I'm sure there are a million delicious things out there. But stop it. You can't replace bacon.  And at the rate these animal activists are suing and dictating laws through California politicians, the only "delicious" thing they want you to enjoy is going to be tofurkey.
